BAKERS ISLAND (002) -0 LQU2aUb Baker' s Island SEP el 1991 Salem, MA 01970 CITY OF MEN "'ALTH DEPT September 1991 Mr. Robert Blenkhorn Health Agent Salem Health Department 9 North Street Salem, MA 01970 Dear Mr. Blenkhorn, The undersigned abutters to Mr. Frank McCarthy' s lot #108 on Baker' s Island have been informed by him of his intent to build a dwelling and therefore he should be applying to the Health Department for your certification that he is in compliance with the Title Five Sanitary Code. We wish to inform you, and through your office the DEQE, that as abutters we have serious misgivings regarding this property being able to comply with the Title Five regulations particularly as they apply to leaching field requirements for the following reasons : 1 . This lot is comprised of granite ledge and bony soil with very little pervious soil above the granite base . It in all probability, therefore, can not pass a percolation test. 2 . The Baker' s Island drinking water supply from our well system is already of marginal quality and we therefore feel that any additional septic/leaching field effluent could threaten the entire potable water supply for all Baker' s Island residents . In view of the above concerns we insist that prior to the construction of a septic/leaching field facility on the subject lot 310 CMR 15 . 00 through 15 . 03 are strictly adhered to. Furthermore because of the fragile health and ecological conditions existing on Bakers Island in general and this lot in particular it is imperative that no variance or relaxation the CMR's be granted. Accordingly we request that you provide the undersigned abutters with sufficient notice as the date and times the Health Department may wish to conduct site examinations, percolation tests, and or any other work on lot 108 that pertains to the applications for leaching field approval in order that they may attend such tests . Also we request that the undersigned be furnished with copies of all applications, plans, and drawings in connection with septic/leaching field projects pertaining to Lot 108 . Finally, in reviewing Mr. McCarthy' s application for a building permit we note that his application states that he wishes to build a garage or shed. Should this be his desire we have no objection to such 'a ' "structure providincr such building be specifically designated as a garage or shed and that any building permit approved for the subject structure state that "no human occupancy is permitted. " In other words we insist on an either "fish or fowl" classification- for this building. The reason for our concern regarding this matter is that the proposed elevations for this "garage" (see attached) suggest that living quarters could be incorporated within this building. The use of Andersen sliders and dormer windows , in our view, suggests a very elaborate "garage" for a simple island with no roads and no automobiles . In order to avoid future expense, inconvenience and litigation for Mr. McCarthy we suggest that the building inspector advise him of the specific nature of any building permit to build a garage, shed or storage area. It would indeed be unfortunate if Mr. McCarthy' s fertile imagination leads him to believe that he can construct a bogus "garage" to camouflage living quarters which he subsequently occupies with only a wink and a nod from his duped building inspector and abutters . We trust that the building inspector will advise him that his only option to achieve building occupancy remains through compliance with the Title Five Sanitary Code. Because of Mr. McCarthy' s flagrant inconsistency in that he has advised us he intends to build a dwelling and the building inspector that he intends to build a "garage" we believe it is the building inspector' s responsibility to determine exactly what he plans to build and advise us accordingly. Should you have any problem with any aspect of this letter we trust that you will communicate same to us immediately otherwise we shall assume that our requests as abutters are in compliance with the requirements of the Title Five Sanitary Code. The signatures of the abutters together with their addresses and phone numbers are attached. They are on separate sheets of paper because due to their far flung locations they could not be brought together to sign this letter at one time. cc: Building Inspector, City of Salem, 2 Salem Green, Salem, MA 01970 Mr. Frank McCarthy, 12 Maverick Ct. Enclosed is a copy of the building permit application for this address. Although the application clearly indicates the building as a garage, I had questioned Mr. McCarthy of the intended use. Mr. McCarthy was quite aware that the use of the building was for storage only. If the building is ever occupied as a dwelling, please contact this office. Sincerley, \ 4— / David J.
