Decision
City of Salem Zoning Board of Appeals
Petition of BASLAND DEVELOPMENT, seeking Variances from lot area and lot
area per dwelling unit on 134 BRIDGE STREET and Variances from required side
and rear yard setbacks, lot width, lot coverage, minimum lot area, and minimum lot
area per dwelling unit on 142 BRIDGE STREET, to allow for the construction of a
two-family house on the property at 142 BRIDGE STREET, Salem,MA, in the
Residential Two-Family Zoning District(R-2).
Petitioner seeks Variances pursuant to the Salem Zoning Ordinance, X64, Table I:
Residential Density Regulations.
Statements of fact:
1. Brian Boches,the property owner and petitioner, represented himself at the hearing.
2. In a petition dated June 24, 2009, the applicant requested Variances from lot width,
side and rear setbacks, lot area and lot area per dwelling unit to accommodate the
construction of a two-family dwelling to replace.another two-family dwelling which
was condemned and demolished.
3. A public hearing on the above mentioned Petition was opened on July 15, 2009,
pursuant to Mass General Law Ch. 40A, % 11. The pubic hearing was closed on
July 15, 2009,with the following Zoning Board of Appeals members present: Robin
Stein (Chair), Richard Dionne,Beth Debski, Annie Harris, Bonnie Belair (alternate),
and JimmyTsitsinos (alternate).
4. At the hearing, several residents spoke,stating they did not oppose the project, but
had concerns relating to parking and congestion. They wished to see adequate green
space on the property, and sufficient buffering between the propertys parking area
and neighbors. They also requested that the fence around the property be replaced.
5. At its meeting on July 15, 2009, the Board of Appeals voted five (5) in favor and
none (0) opposed to grant Variances from the dimensional requirements of§64,
Table I: Residential Density Regulations.

The Board of Appeal, after careful consideration of the evidence presented at the public
hearing, and after thorough review of the plans and petition submitted, makes the following
findings:
1. Special conditions and circumstances exist affecting the parcel or building, which
do not generally affect other land or buildings in the same district, as the property
is oddly shaped and has very little frontage.
2. Desirable relief may be granted without substantial detriment to the public good
and without nullifying or substantially derogating from the intent or purpose of
the zoning ordinance.
3. The applicant mayvarythe terms of the Residential Two-Family District to
construct the proposed new house,which is consistent with the intent and purpose
of the City of Salem Zoning Ordinance.
4. In permitting such change,the Board of Appeals requires certain appropriate
conditions and safeguards as noted below.
On the basis of the above findings of fact and all evidence presented at the public hearing
including, but not limited to,the Plans,Documents and testimony, the Zoning Board of
Appeals concludes:
1. To allow for the construction of the two-family house as proposed, the requested
Variances from dimensional requirements for structures in the Residential Two-
Family zone are granted.
In consideration of the above,the Salem Board of Appeals voted, five (5) in favor(Stein,
Harris,Belair,Debski and Dionne) and none (0) opposed,to grant petitioner's requests for
Variances subject to the following terms, conditions, and safeguards:
1. Petitioner shall comply with all city and state statutes, ordinances, codes and
regulations.
2. All construction shall be done as per the plans and dimensions submitted to and
approved by the Building Commissioner.
3. All requirements of the Salem Fire Department relative to smoke and fire safety shall
be strictly adhered to.
4. Petitioner shall obtain a building permit prior to beginning any construction.
5. A Certificate of Occupancy is to be obtained.
6. Petitioner shall obtain street number from the City of Salem Assessor's Office and
shall display said number so as to be visible from the street.
7. Petitioner is to obtain approval from any City Board or Commission having
jurisdiction including, but not limited to the Planning Board.

8. Petitioner shall replace the fence between 146 Bridge Street and 9 Northey Street.

Dear Mr. Hawkes:
The letters on your progress at 140 Bridge Street have stopped. I have not seen a
building permit from your contractor to repair the porches out front. The leak from the
second floor to first floor bathroom has not been repaired. Your third floor tenant that
you say does not exist has gas and electricity in his name. The lights are on upstairs at
night, and you don't have a Certificate of Fitness for the unit.
You must remove the tenant from the third floor until a Certificate of Fitness is issued.
The front porches must be addressed immediately, and the water leak in the wall of the
first floor bath has to be fixed.
According to General Provisions, Salem Code, Section 1-7; We are allowed to fine you
$150.00 a day for each offence. Regulation 6—Certificate of Fitness carries a fine of
$25.00 a day.
You must comply to these orders within fourteen (14) days or face fines in Salem District
Court.

Acting on complaints from the Salm Health Department, this office inspected
the above referenced property. Our findings were that the front porches are in
unsafe condition. This puts you in violation of the Massachusetts State Building
Code, Section 123 (Unsafe Structures) .
You have until 12:00 noon the day following receipt of this letter to begin
repairs on the porches.
Violation Penalties: Anyone who shall violate a provision of this code shall
be punishable by a fine of not more than one thousand dollars ($1,000) or by im-
prisonment for not more than one year, or both, for each violation. Each day during
which any portion of a violation continues shall constitute a separate offense.
Failure to comply with this notice will result in this office taking legal
action against you in the courts.
Please contact this office to obtain a building permit to perform the work
on the porches.

Inspection
On Wednesday, August 13 , 1998 , I conducted an inspection
of the property located at 140 Bridge Street was
conducted in accordance with the Massachusetts State
Building Code 780 CMR, 121 . 0 (Unsafe Structures ) ,
Accompanying me were members of the Salem Fire and Health
Departments .
Findings
The inspection conducted confirmed that the building front
and rear decks and stairs are in a state of considerable
disrepair, structurally unsafe and missing supports .
Order to Make Structure Safe

You are hereby ordered to immediately hire a structural
engineer to determine the safety of the front decks and
have the engineer develop drawings to be submitted for a
building permit to replace these decks . You shall also
have a contractor apply for a building permit to install
temporary supports with the new drawing are being
prepared.

Building Inspector to conduct a full inspection of the
property.

Legal Remedies for Tenants of
Residential Housing
The following Is a brief summary of some of the legal remedles tenants may use In.order to get housing code violations
corrected:
1., Rent Withholding(Massachusetts General Laws,Chapter. 239,section 8A): If Code Violations Are Not Being Corrected you
may be entitled to hold back your rent payments.You can do this without being evicted if:
A. You can prove that your dwelling unit or common areas contain code violations which are serious enough to endanger
or materially impair your health or safety and that your landlord knew about the violations before you were behind in
your rent-
B. You did not cause the violations and they can be repaired while you continue to live in the building.
C. You are prepared to pay any portion of the rent into court if a judge orders you to pay it. (Por this, it is best to put the
rent money aside in a safe place.)
2. Ren it nd D n (Massachusetts General Laws,Chapter 111,section 127L):The law sometimes allows you to use your rent
money to make the repairs yourself.If your local code enforcement agency certifies that there are code violations which
endanger or materially impair your health,safety,or well-being,and your landlord has received written notice of the violations,
you may be able to use this remedy.If the owner fails to begin necessary repairs(or to enter into a written contract to have them
made)within five days after notice or to complete repairs within 14 days after notice,you can use up to four months'rent in any
year to make the repairs.
3. Rttaliat=Rent Increases or Evictions Prohibited(Massachusetts General Laws,Chapter 186,section 18,and Chapter 239,
section 2A):The owner may not increase your rent or evict you in retaliation for making a complaint to your local code
enforcement agency about code violations. If the owner raises your rent to tries to evict within six months after you have made
the complaint,he or she will.have.toshow a good reason for the increase or eviction which is unrelated to your complaint.You
may be able to sue the landlord for damages of he or she tries this.
4. Rent Receivership(Massachusetts General Laws,Chapter 11, section 127 C-H):The occupants and/or the Board of Health may
petition the District or Superior Court to allow rent to be paid into court rather than to the owner.The court may then appoint a
"receiver" who may spend as much of the rent money as is needed to correct the violation.The receiver is not subject to a
spending limitation of four months'rent
5. Breach of Warranty of Habi ability:You may be entitled to sue your landlord to have all or some of your rent returned if your
dwelbng unit does not meet minimum standards of habitabdity.
6. Unfair and Deceptive Practices(Massachusetts General Laws,Chapter 93A): Renting an apartment with code violations is a
violation of the consumer protection act and regulations, for which you may sue an owner.

Dear Mr..,Tremblay:
I have been asked to determine the zoning- status on property located at 142
Bridge Street, Salem, Massachusetts. My opinion follows:
The property in question is a two story, wood frame dwelling which, I
understand, has five rooms and a bath on the first floor and this is mirrored on the
second floor.
Mr. Hawkes supplied copies of letters from Roland Plourde and Robert Plourde
whereby each stated that they lived in the building (Roland from 1935 and Robert from
1960) and that people lived on the second floor during their period of occupancy.
Robert Plourde has moved back into the property and could be spoken to concerning
his memories of the occupation of this property.
Mr. Hawkes indicated in his letter that he had found substantial evidence which
showed that the property had been occupied all the time while the Plourde's were living
in the property.
A review of random Polk's directories indicate that in 1951 two families were
living at the property, those of Joseph Plourde and of Arthur Pelletier.
A'review of the Polk's directory for the year 1935 indicated that two families
were living at the property, they being those of Mrs. Nora A.' Campbell and Mrs.
Agnes Kanellos.

Based on the foregoing evidence as submitted it would be my opinion that this
family is a nonconforming two family and has been at least back to 1935.

Dear Mr. Hawkes:
In accordance with Massachusetts General Law, Chapter 111, Sections 127A and 127B and
105 CMR: 410.000: Chapter II, State Sanitary Code, Minimum Standards of Fitness for Human
Habitation, an inspection of the above-cited dwelling was conducted by me, Joanne Scott, Health
Agent of the Salem Board of Health on September 18, 1996. A copy of the findings of the
inspection is attached.
Based upon the findings of the inspection and a determination by the Building Inspector, John
Jennings, also enclosed, the Board of Health has determined that the entire dwelling is unfit for
human habitation. The danger to the life or health of the occupants is so immediate that
immediate condemnation is ordered and the hearing requirements of 105 CMR 410.831(B)
and (C) are hereby waived. The occupants are ordered to vacate the building within one
day of receipt of this order. If any person refuses to leave the dwelling they may be forcibly
removed by the Board of Health or by local police authorities on the request of the Board of
Health.
If a written petition for hearing for a hearing is not filed in the office of the Board of Health
within seven days of receipt of this order,the subject dwelling shall be placarded by the Board of
Health. At said hearing you will be given the opportunity to be heard and to present witnesses
and documentary evidence as to why the dwelling should not be placarded. You may be
represented by an attorney. Please also be informed that you have the right to inspect and obtain
copies of all relevant-inspection or investigation reports, orders, and other documentary

information in the possession of the Board of Health and that any adverse party has the right to
be present and be heard.
Upon removal of the occupants from the dwelling you are ordered to secure the building. If
after one year after the issuance of an order to secure, compliance with the minimum standards
set forth in 105 CMR 410.000 has not been effected,then the Board of Health may cause the
dwelling to be demolished. Any costs borne by the Board of Health is a debt to the City and
shall be recoverable from the owner in an action of contract.
No dwelling or portion thereof which has been condemned and placarded as unfit for human
habitation shall again be used for human habitation until written approval is secured from, and
such placard is removed by,the Board of health. No person shall deface or remove the placard,
except the Board of Health shall remove it whenever the defect or defects upon which the
condemnation and placarding action was based have been eliminated.

The following is a brief summary of some of the legal remedies tenants may use in order to get housing code violations

Legal Remedies for Tenants of
Residential Housing
The following is a brief summary of some of the legal remedies tenants may use In order to get housing code violations
corrected:
1. Rent Withholding (Massachusetts General laws,Chapter 239,section 8A): If Code Violations Are Not Being Corrected you
may be entitled to hold back your rent payments.You can do this without being evicted if:
A. You can prove that your dwelling unit or common areas contain code violations which are serious enough to endanger
or materially impair your health or safety and that your landlord knew about the violations before you were behind in-
your rent.
B. You did not cause the violations and they can be repaired while you continue to live in the building.
C. You are prepared to pay any portion of the rent into court if a judge orders you to pay it. (For this, it is best to put the
rent money aside in a safe place.)
2. Rr,p it and d Dedu (Massachusetts General Laws,Chapter 111, section 127L):The law sometimes allows you to use your rent .
money to make the repairs yourself.If your local code enforcement agency certifies that there are code violations which

Dear Ms. Moustakis:
We have corrected the following violations found in
your report of May 10, 1994 as the result of the call from
Mrs. Kuszmar.
1. ) The three cars have been tagged and will be moved.
2 . ) The doghouse has been removed.
3 . ) Fence panels removed and stored.
4. ) Refrigerator and clothes washer moved to
Northey Street to be picked up by city on
May 18, 1994.
5. ) Rt. rear hallway cleaned.
7. ) Open bulkhead has been closed preventing entrance
for rats, raccoons, squirrels, dogs, cats and other
animals, including skunks, woodchucks, groundhogs,
mice, chipmunks, bats, rabbits, snakes and insects,
including bees, flies, mosquitos, moths, red ants,
weevils, carpenter ants, lady bugs, and dragon flies.
(I just wanted to prove I 'm much more imaginative
than Mrs. Kuszmar although I admit it's tough to
outdo the one about a raccoon dragging dog feces
into the cellar. )

12 . ) Shed cleaned and closed as of 5/16/94
All of the above items have been completed.
6. ) There is nothing wrong with these steps. Mrs.
Kuszmar has had a hangup over these steps for
2 years. They were new 3 years ago and reinforced
in the fall of 1992, just to appease her.
Mr. Tremain looked at them a year ago. I will
not do anything more to these steps until Judge
Doyle orders me to. I am prepared to bring to
court the man who built them.
13. ) The roof at 142 Bridge Street had a massive repair
job in the fall of 1993 . (New in 1982) It didn't
leak again until there was a large snow and ice
build up in February 1994. It damaged the roof in an
area that had never before leaked. The day after the
leak, the temperature plunged and of course there was
no leak. About a week later, the temperature warmed
to 430 F and with an experienced roofer we repaired
the leak.
The roof hasn't leaked since. During that period,
according to the weather bureau, we have had over 15" of rain.
This year rainfall is almost 6" above normal and there were
3 storms with 1.75" of rain falling in less than 24 hours. For
the month of May 4" of rain have already fallen and the month
is just half over.
We have repeatedly checked with the tenant to make
certain there were no leaks and, as recently as this past
weekend.
With all due respect I am not going to do anything to that
roof until July unless ordered to do so by Judge Doyle.
Please return at your earliest convenience for an
inspection.

Dear Ms. Broeder:
This situation with Mrs. Kuszmar at 134 Bridge
Street is quite intolerable. She is 80 years old, not in
the best of health and not very happy. She refers to her
apartment as a "filthy dump" and constantly complains.
In 1993 I have received more complaints from Mrs.
Kuszmar than from all of my other tenants combined from
the year 1982 to the present.
The Salem Fire Dept. has responded five times to her
calls this year, once with three pieces of equipment, the
chief ' s car and two police cars, all for no reason.
Winter is coming, a period of constant complaints about
the temperature of her apartment. She insists on wearing
large fluffy slippers, under pants and a sleeveless cotton
dress and nothing more. When I complain about her mode of
dress, she says it' s none of my business.
This past winter the Board of Health went there on
several occasions and each time found the temperature at
least 50 abode the required minimum.
Mrs. Kuszmar needs to be in a modern building where
she has full control of her environment.
If you have anyone in your organization that can
counsel or help Mrs. Kuszmar, I would appreciate it.
Certainly she would be happier.

102.1 General: Except as provided in Section 113.1, a permit shall not be required
for ordinary repairs to buildings and structures.
SECTION 103.0 INSTALLATION OF SERVICE EQUIPMENT
103.1 General: When the installation, extension, alteration or repair of an
elevator, moving stairway, mechanical equipment, refrigeration, air conditioning or
ventilating apparatus, plumbing, gas piping, electric wiring, heating system or any
other equipment is specifically controlled by the provisions of this code or the
approved rules, it shall be unlawful to use such equipment until a certificate of
approval has been issued therefor by the building official or other agency having
jurisdiction.
SECTION 104.0 MAINTENANCE
104.1 General: All buildings and structures and all parts thereof, both existing and
new, shall be maintained in a safe and sanitary condition. All service equipment,
means of egress, devices and safeguards which are required by this code in a
building or structure, or which were required by a previous statute in a building or
structure, when erected, altered or repaired, shall be maintained in good working
order.
104.2 Owner responsibility: The owner, as defined in Article 2, shall be
responsible for the safe and sanitary maintenance of the building or structure and
its exitway facilities at all times, unless otherwise specifically provided in this code.

conditions along with the unregistered motor vehicles filling up the yard and
alleyway of 130 Bridge Street.
This area, and these yards are to be cleaned out and the motor vehicles removed.
These conditions are jeopardizing the health, safety and well beingoof your
tenants as well as the general public in this congested neighborhood.

Smoke detector must be repaired so it works properly at all times .

Legal Remedies for Tenants of
Residential Housing
The following Is a brief summary of some of the legal remedies tenants may use In order to get housing code violations
corrected:
1. Rent Wi hFioldiu(Macsaehtseiti Genial Laws,Chapter 239,section 8A):If Code Violations Are Not Being Corrected you
may be entitled to hold back your rent payments.You can do this without being evicted iF.
A. You can prove that your dwelling unit or common areas contain code violations which are serious enough to endanger
or materially impair your health or safety and that your landlord knew about the violations before you were behind in
your rent-
B.
entB. You did not cause the violations and they can be repaired while you continue to live in the building.
C. You are prepared to pay any portion of the rent into court if a judge orders you to ply it (For this, it is best to put the
rent money aside in a safe place.)
2. Rrp it nd D ut(Massachusetts General Laws,Chapter 111, section 127L):The law sometimes allows you to use your rent
money to make the repairs yourself.If your local code enforcement agency certifies that there are code violations which
endanger or materially impair your health,safety,or well-being,and your landlord has received written notice of the violations,
you may be able to use this remedy.If the owner fails to begin necessary repairs(or to enter into a written contract to have them
made)within five days after notice or to complete repairs within 14 days after notice,you can use up to four months'rest in any
year to make the repairs.
3. R to iato Rent Increases or Evictions Prohibited(Massachusetts General Laws,Chapter 186,section 18,and Chapter 239,
section 2A):The owner may not increase your rent or evict you in retaliation for making a complaint to your local code
enforcement agency about code violations. If the owner raises your rent to tries to evicrwithin six months after you have made
the complaint, he or she will:have.to show a good reason for the increase or eviction which is unrelated to your complaint-You
may be able to sue the landlord for damages of be or she tries this.
4. Rent Receiversbin(Massachusetts General Laws,Chapter 11, section 127 C-H):The occupants and/or the Board of Health may
petition the District or Superior Court to allow rent to be paid into court rather than to the owner.The court may then appoint a
"receiver" who may spend as much of the rent money as is needed to correct the violation.Ile receiver is not subject to a
spending limitation of four months'rent
5. Breach of Warranty of Habi ahility: You maybe entitled to sue your landlord to have all or some of your rent returned if your
dwelling unit does not meet minimum standards of habitability.

Legal Remedies for Tenants of
Residential Housing
The following Is a brief summary of some of the legal remedies tenants may use In order to get housing code violations
corrected:
1. Rent Withholding(Massachusetts General Laws,Chapter 239,section 8A): If Code Violations Are Not Being Corrected you
maybe entitled to hold back your rent payments.You can do this without being evicted if:
A. You can prove that your dwelling unit or common areas contain code violations which are serious enough to endanger
or materially impair your health or safety and that your landlord knew about the violations before you were behind in
your rent.
B. You did not cause the violations and they can be repaired while you continue to live in the building.
C. You are prepared to pay any portion of the rent into court if ajudge orders you to pay it. (For this,it is best to put the
rent money aside in a safe place.)
2. Repair and Deduct(Massachusetts General Laws,Chapter 111,section 127L):The law sometimes allows you to use your rent
money to make the repairs yourself.If your local code enforcement agency certifies that there are code violations which
endanger or materially impair your health,safety,or well-being,and your landlord has received written notice of the violations,
you may be able to use this remedy.If the owner fails to begin necessary repairs(or to enter into a written contract to have them
made)within five days after notice or to complete repairs within 14 days after notice,you can use up to four months'rent in any
year to make the repairs.
3. Retaliatory Rent Increases or Evictions Prohibit (Massachusetts General Laws,Chapter 186,section 18,and Chapter 239,
section 2A):The owner may not increase your rent or evict you in retaliation for making a complaint to your local code
enforcement agency about code violations.If the owner raises your rent to tries to evict within six months after you have made
the complaint,he or shewill:have to show a good.reason for the increase or eviction which is,unrelated to your complaint..You
may be able to sue the landlord for damages of he or she tries this.
4. Rent Receivership(Massachusetts General Laws,Chapter 11, section 127 C-H):The occupants and/or the Board of Health may
petition the District or Superior Court to allow rent to be paid into.court rather than to the owner.The court may then appoint a
"receiver"who may spend as much of the rent money as is needed to correct the violation.The receiver is not subject to a
spending limitation of four months'rent
5. Breach of Warranty of Habitability: You may be entitled to sue your landlord to have all or some of your rent returned if your
dwelling unit does not meet minimum standards of habitability. '
6. Unfair and Deceptive Practices(Massachusetts General Laws,Chapter 93A): Renting an apartment with code violations is a
violation of the consumer protection act and regulations, for which you may sue an owner.

legal action, it is advisable that you consult an attorney.If you cannot afford to consult an attorney,you should contact the

Dear Mr . Hawkes :
On August 13 , 1997 I was requested to conduct an
inspection of the premises at 140 Bridge Street
by the City of Salem Health Department , and the following
code violations were found.
1 . Facia and sofitt at front of building require repairs .
2 . Missing ballaster on front porch need to be repaired.
3 . Missing ballaster in stairwell front hall .
4 . Ceiling in bathroom in first floor apartment needs to
be replaced .
5 . Ceiling in kitchen needs to be patched .
6 . No smoke detectors in apartments .
7 . Bath & kitchen sinks leak .
8 . No lights, no smoke detectors in rear hallway
9 . No smoke detectors in basement .
10 . Clean debris from basement, old water heaters ect .
11 . Electrical wires need to be repaired by a license
electrician over the electrical panel .

DECISION ON THE PETITION OF SALEM BRIDGE STREET REALTY TRUST (WILLIAM S..
HAWKES, TRUSTEE) REQUESTING A VARIANCE FOR 140-142-144 BRIDGE STRET.T
A hearing on this petition was initially held on February 20, 1980 at
which time the hearing was continued to March 19, 1980 in order to allow the
Salem Fire Marshall and the Salem Planning Board to comment on the petitioner's
request for a variance. Notices of the hearing were sent to abutters and
others and a notice of the hearing was published in the Salem Evening News
on February 6, 1980 and February 13, 1980 in accordance with Massachusetts
General Laws Chapter 40A.
On March 19, 1980 the hearing on this petition was continued with the
following Board Members present: James H. Boulger, Jr. , Chairman, Messrs.
Hopper, LaBrecque, Feeherry and Hacker.
The Petitioner has requested a variance for the property at 140-142-
144 Bridge Street to place three existing multi-family dwellings located at
this property on separate lots thereby requiring variances from minimum lot
area, minimum lot area per dwelling, minimum lot width, minimum lot coverage,
minimum front, side and rear yard set backs with respect to each newly
created lot, in accordance with plans . (as amended) on file with the Board. .
The Board of Appeals, after consideration of the evidence presented at
the public hearing and after viewing the property makes the following findings
of fact:
1. At the present time as shown on the plans (as amended) on file with
the Board, there are three multi-family dwellings at 140-142-144
Bridge Street, a three-family dwelling on Lot 1, a three-family
dwelling on. Lot 2 and a two-family dwelling on Lot 3.
2. The Petitioner purchased these dwellings several months ago and has
since done substantial work to repair and improve the appearance of
the properties. The work done by the petitioner has involved sub-
stantial expense.
3. For the Petitioner to sell the dwellings, they must be separated onto
individual lots; this is necessary in order to facilitate financing.
4. The Planning Board has expressed no opposition to the granting of
the variances requested by the Petitioner.
5. The Salem Fire Marshal has expressed no opposition to the granting
of the variances requested by the Petitioner.
6. The Petitioner has, as requested by the Board of Appeals, agreed to
deed a four foot right-of-way onto Bridge Street to the property
designated Lot 3, while reserving an easement in that four foot strip
for Lots 1 and 2.
On the basis of the above findings of fact, and the evidence presented
at the public hearing, the Board of Appeals concludes as follows:

(1) The dwellings in question have existed on one lot on Bridge Street
since the early 1900's. The variances requested by the Petitioners
will in no way change the use of the structures. The dwellings in
question are, because they are currently located on one lot, unique
to the area in question.
(2) The conditions described above especially affect the structures in
question but„do not generally affect the zoning district in.which
the buildings are located.
(3) The conditions described above which affect the land in question,
but not the zoning district generally cause the following hardship:
without the requested variances, the petitioner cannot separately
finance the dwellings.
(4) The requested variances may be granted without substantial detriment
to the public good because the variances will not change the use
of the properties in question.
Therefore, the Board of Zoning Appeals unanimously votes in favor of
granting the requested variances to the petitioner.
In accordance with the plans (as amended) on file with the Board of
Appeals, variances are hereby granted from minimum lot area, minimum lot area
per dwelling, minimum lot width, minimum lot coverage, minimum front, side
and rear yard set backs with respect to each newly created lot as shown on
the plan (as amended) on file with the Board of Appeals.
