The first floor was all torn out,, and in the process of remodeling. The Fire dept. permit was taken out on 3,'28/02. work has not progressed. No power on the first floor. We went to the second floor I ' where the ahllway was partially blocked in the rear. The front hallway was totally blocked. There were no smoke detectors in the front or rear halls. Inside the house on the second floor, every room was a total mess. No working i smoke detectors, and the only heat was a gas stove in the kitchen. The furnace in the basement was not working, and did not appear to have been working in a while. What I found was the house was in such bad disrepair, and the conditions � I were so bad that it is an extreme fire hazard. Insulate with required insulation on walls and ceilings per code, complete electrical work and bring up to code including hall ways, sheet rock walls and ceilings per code and joint compound or plaster. Plywood floors installed where required. Install new bathroom fixtures. We are currently still in the process of cleaning out the building of all trash. The sub contractors are in the process of pricing out the work for me, when the numbers are complete I will be able to secure financing for the repairs. The carpenter will first repair the first floor ceiling, and make the building structurally safe, and we will remove the rear enclosure. The building will be made weather tight. The electrician and plumber will do there rough work, and then we will finish . The required time period to complete for financing and required work will take approximately six to nine months. Today's inspection showed several life safety items that combine to make the structure "Unsafe" the first floor is completely gutted down to the studs this makes the building very vulnerable to a fast moving fire. The lack of sheetrock and or plaster also eliminates any fire separation between units. The hallways in front and rear stairways are in poor repair and cluttered with trash and debris. The framing on the first floor shows several areas that need to be addressed immediately. Also,the work on the first floor is not properly permitted. Therefore, I am issuing a stop work order on the first floor. I would also like to point out that you never responded to my letter dated March 18, 2004 that required you to arrange for an inspection. It is my opinion that the building is extremely dangerous in it's current condition and should be vacated immediately. If there are any questions contact me directly. History April 27, 2004 Building Commissioner Thomas St. Pierre informed the Defendant that an inspection on April 27, 2004 demonstrated that the single family home was unsafe, e.g., lack of sheetrock and or plaster, front hallway and rear stairway in poor condition and cluttered with trash and debris, naming on first floor in need of repair. Several of these problems could contribute easily to rapid spread of fire. September 19, 2005 Joseph Barbeau, Asst. Building Inspector receives a letter from the Defendant through her attorney that the Defendant intends to address the building code violations, as well as, to clean the building of all trash. The letter from the Defendant stated that she would hire a carpenter who would make repairs to the building as to make it structurally safe. Other promises included making sure that the building was up to code with plumbing, electrical and fire code; and that the building would be made weather tight. This is a property owned by a non-resident landlord that has been a problem since at least '94, and has not gotten better under Ms. Porter's ownership. I have had this property on my radar since I began with this department over two years ago. This property is dilapidated, dangerous, and located on an entry corridor of our city. In August of'05 in this courtroom charges against Ms. Porter were dismissed as part of an agreement that she would repair this structure, with the agreed repairs to commence e violations have been cleared. Such work immediately and to continue until such�as was never commenced, and no further action was taken until charges were again filed in Court. Early this summer at a magistrates hearing Ms. Porter promised to commence this work, still nothing has been done. A second magistrates hearing was not attended by Ms. Porter, so once again here we stand. It is in the best interest of this city that this case be held in this court until such time as all violations have been cleared. A complete inspection was not done at the time because of unsanitary and dangerous conditions which may have endangered an inspector and/or made it impossible to see the entire area. Based upon the findings of the inspection, as written in Attachment A and Attachment B, included in this order the Board of Health has determined that the entire dwelling, including the 1St 2nd floor dwelling units, including the 31d floor is unfit for human habitation. The danger to the life or health of the occupants is so immediate condemnation is ordered immediately and the hearing requirements of 105CMR 410.831 B and C are waived. All occupants of the building are ordered to vacate the building within 24 hours. If any person refuses to leave the dwelling they may be forcibly removed by the Board of Health or by local police authorities on the request of the Board of Health. The City of Salem Building Department will secure this dwelling on April 28, 2004 at or around 3:00p.m. If after one year after the issuance of an order to secure, compliance with the minimum standards set forth in 105 CMR410.000 has not been effected, then the Board of Health may cause the dwelling to be demolished. Any costs borne by the Board of Health are a debt to the City and shall be recoverable from the owner in an action of contract. No dwelling or portion thereof, which has been condemned and placarded as unfit for human habitation, shall again be used for human habitation until written approval is secured from, and the Board of Health removes such placard. No person shall deface or remove the placard, except the Board of Health shall remove it whenever the defect or defects upon which the condemnation and placarding action was based have been eliminated. The kitchen sink has no water and is not working. 2. The bathroom sink is falling off the pedestal and leaks into the first floor. 3. The shower leaks into the first floor bathroom. 4. The kitchen stove is in disrepair. 5. The heat is not working it appears the heat has not been working for some time, the baseboard heat has a build up of dirt, dust and grime. 6. On the first floor of the building there is tub full of septic water. 7. What appears to be the bathroom on the first floor there is a build up of mold on the wall. 8. The tenant states there is an infestation of mice as well as possums or raccoons that live in the basement. 9. The building has no smoke detectors. 10. The overall sanitary conditions of the property are extremely bad. The building appears to be uninhabitable. 11. The front entrance is completely blocked causing a major fire hazard. 12. The back hall is littered with a trash barrels and computer monitors, also creating a fire hazard. 13. There is large plastic tote in the basement full of water. The framing on the first floor shows several areas that need to be addressed immediately. Also,the work on the first floor is not properly permitted. Therefore, 1 am issuing a stop work order on the first floor. 1 would like to also point out that you never responded to my letter dated March 18, 2004 that required you to arrange for an inspection. (D) Common Areas: In any dwelling,the owner shall be responsible for maintaining in a clean and sanitary condition free of garbage, rubbish,other filth or causes of sickness that part of the dwelling which is used in common by the occupants and which is not occupied or controlled by the occupant exclusively. (1)The owner of any dwelling abutting a private passageway or right-of-way owned or used in common with other dwellings or which the owner or occupants under her or his control have the right to use or are in fact using shall be responsible for maintaining in a clean and sanitary condition free from garbage,rubbish,other filth or cause of sickness that part of the passageway or right-of-way which abuts her or his property and which s/he or the occupants under her or his control have the right to use,are in fact using, or which s/he owns. Second, your letter dated May 31, 1994 points up what can be vigilantism in neighborhood associations. Obviously, someone called your office complaining that I 'm bringing in outside trash to 134 Bridge Street with a pick up truck. This is pure calumny. when your office received this complaint, I was automatically considered guilty and a certified letter was fired off by you ordering me to cease and desist with copies going to Tim Flynn, DPW, Fire Prevention, Building Inspector, Ward Councillor. You did not give me the courtesy of a phone call to check the validity of the charge by the unnamed accuser, nor did you identify the source of your information. If you had called you would have learned that I have contracted with Mr. Moretta to take the trash out every Tuesday morning. The "trash barn" is located on 134 Bridge Street property approximately 30 yards from Northey Street. In his infinite wisdom, Mr. Moretta decided it was easier and quicker to load his pick up truck and drive the truck to the curb, rather than hand carry two bags at a time. He seems z to think it is the best procedure and will continue following the practice in the future. I look forward to hearing from you that you have written the "informer" of your findings. This is a property owned by a non-resident landlord that has been a problem since at least '94, and has not gotten better under Ms. Porter's ownership. I have had this property on my radar since I began with this department over two years ago. This property is dilapidated, dangerous, and located on an entry corridor of our city. In August of'05 in this courtroom charges against Ms. Porter were dismissed as part of an agreement that she would repair this structure, with the agreed repairs to commence immediately and to continue until sucNd's the violations have been cleared. Such work was never commenced, and no further action was taken until charges were again filed in Court. Early this summer at a magistrates hearing Ms. Porter promised to commence this work, still nothing has been done. A second magistrates hearing was not attended by Ms. Porter, so once again here we stand. It is in the best interest of this city that this case be held in this court until such time as all violations have been cleared. Therefore, I pray the court will continue this matter for a period not to exceed 120 days, or until this work has been completed, inspected, and approved by all city departments. Thank you. Commonwealth v. Phyllis Porter 0636CR003089 t Jurisdiction: District Court has original jurisdiction over misdemeanors and violations of rules and regulations made by public officers. See MGL c. 218, § 26. State Building Code are rules and regulations enforceable by Building Commissioner. MGL c. 143, § 94(a) Provides in pertinent part as follows: "Whoever violates any provision of the state building code...shall be punished by a fine of not more than one thousand dollars or by imprisonment for not more than one year, or both, for each such violation." Violation in current case MGL c. 143, § 6 (a.k.a. Mass. State Building Code 780 CMR 122.0) Single family home at 136 Bridge Street, Salem, MA is owned by the Defendant for investment purposes and is currently Uninhabitated, open to the weather and especially unsafe in case of fire. History April 27, 2004 Building Commissioner Thomas St. Pierre informed the Defendant that an inspection on April 27, 2004 demonstrated that the single family home was unsafe, e.g.; lack of sheetrock and or plaster, front hallway and rear stairway in poor condition and cluttered with trash and debris, framing on first floor in need of repair. Several of these problems could contribute easily to rapid spread of fire. September 19, 2005 Joseph Barbeau, Asst. Building Inspector receives a letter from the Defendant through her attorney that the Defendant intends to address the building code violations, as well as, to clean the building of all trash. The letter from the Defendant stated that she would hire a carpenter who would make repairs to the building as to make it structurally safe. Other promises included making sure that the building was up to code with plumbing, electrical and fire code; and that the building would be made weather tight. September 26, 2006 Complaint issued for violations of MGL c. 143 /Mass State Building Code October 26, 2006 Pre-Trial Probation Order issued by this Court (Judge Cometta) —which stated that the Defendant shall take steps necessary to remedy all state and local code violations at 136 Bridge Street. March 22, 2005 Incident Report Re: Phyllis Porter, 136 Bridge Street On March 22,2005 Joe Barbeau representing the Building Office, and Chris Wilcock of the Assessors Office met with Phyllis Porter, owner of 136 Bridge Street, ostensibly for the purpose of a Assessors Office walk through inspection. Ms. Porter was being sought on a Warrant,by the Salem Police Department, Mr. Barbeau excused himself and contacted the Salem PD to alert them to her being on the 136 Bridge Street site. Two cruisers with their two officers arrived and placed Ms.Porter into custody. Mc Barbeau secured the premises, and he and Mr. Wilcock departed this location. Therefore, I am issuing a stop work order on the first floor. I would also like to point out that you never responded to my letter dated March 18,2004 that required YOU to arrange for an inspection. A complete inspection was not done at the time because of unsanitary and dangerous conditions which may have endangered an inspector and/or made it impossible to see the entire area. Based upon the findings of the inspection, as written in Attachment A and Attachment B, included in this order the Board of Health has determined that the entire dwelling, including the 1s` 2nd floor dwelling units, including the 3`d floor is unfit for human habitation. The danger to the life or health of the occupants is so immediate condemnation is ordered immediately and the hearing requirements of 105CMR 410.831 B and C are waived. All occupants of the building are ordered to vacate the building within 24 hours. If any person refuses to leave the dwelling they may be forcibly removed by the Board of Health or by local police authorities on the request of the Board of Health. The City of Salem Building Department will secure this dwelling on April 28, 2004 at or around 3:00p.m. If after one year after the issuance of an order to secure, compliance with the minimum standards set forth in 105 CMR410.000 has not been effected, then the Board of Health may cause the dwelling to be demolished. Any costs borne by the Board of Health are a debt to the City and shall be recoverable from the owner in an action of contract. No dwelling or portion thereof, which has been condemned and placarded as unfit for human habitation, shall again be used for human habitation until written approval is secured from, and the Board of Health removes such placard. No person shall deface or remove the placard, except the Board of Health shall remove it whenever the defect or defects upon which the condemnation and placarding action was based have been eliminated. The kitchen sink has no water and is not working. 2. The bathroom sink is falling off the pedestal and leaks into the first floor. 3. The shower leaks into the first floor bathroom. 4. The kitchen stove is in disrepair. 5. The heat is not working it appears the heat has not been working for some time, the baseboard heat has a build up of dirt, dust and grime. 6. On the first floor of the building there is tub full of septic water. 7. What appears to be the bathroom on the first floor there is a build up of mold on the wall. 8. The tenant states there is an infestation of mice as well as possums or raccoons that live in the basement. 9. The building has no smoke detectors. 10. The overall sanitary conditions of the property are extremely bad. The building appears to be uninhabitable. 11. The front entrance is completely blocked causing a major fire hazard. 12. The back hall is littered with a trash barrels and computer monitors, also creating a fire hazard. 13. There is large plastic tote in the basement full of water. Today's inspection showed several life safety items that combine to make the structure"Unsafe", the first floor is completely gutted down to the studs this makes the building very vulnerable to a fast moving fire. The lack of sheetrock and or plaster also eliminates any fire separation between units. The hallways in front and rear stairways are in poor repair and cluttered with trash and debris. The framing on the first floor shows several areas that need to be addressed immediately. Also,the work on the first floor is not properly permitted. Therefore, I am issuing a stop work order on the first floor. I would like to also point out that you never responded to my letter dated March 18,2004 that required You to arrange for an inspection. First, were the uncalled for remarks by Sharon McCabe that caused the cancellation of a *7200 prepaid one year lease agreement for Apt. #2 at 136 Bridge Street, Salem. At the time it happened you and I discussed it. And I 'm not sure that we 've heard the last of that. Second, your letter dated May 31, 1994 points up what can be vigilantism in neighborhood associations. Obviously, someone called your office complaining that I 'm bringing in outside trash to 134 Bridge Street with a pick up truck. This is pure calumny. When your office received this complaint, I was automatically considered guilty and a certified letter was fired off by you ordering me to cease and desist with copies going to Tim Flynn, DPW, Fire Prevention, Building Inspector, Ward Councillor. You did not give me the courtesy of a phone call to check the validity of the charge by the unnamed accuser, nor did you identify the source of your information. If you had called you would have learned that I have contracted with Mr. Moretta to take the trash out every Tuesday morning. The "trash barn" is located on 134 Bridge Street property approximately 30 yards from Northey Street. In his infinite wisdom, Mr. Moretta decided it was easier and quicker to load his pick up truck and drive the truck to the curb, rather than hand carry two bags at a time. He seems z to think it is the best procedure and will continue following the practice in the future. I look forward to hearing from you that you have written the "informer" of your findings.
