Dear Mr. Cerullo,
You have asked about the status of an occupancy permit for the building at 122 Boston Street. I issued a letter
on January 212015, in which I removed the Occupancy of the entire building. The letter included my
requirements for the owner, Trinh Ma, to complete before an occupancy permit would be issued. We also
posted the Building with a legal notice revoking the Occupancy Permit.
In late April „I was informed that the building was again being occupied. I visited the property and informed
the owner that she was in violation of Mass State Building Code and again referred to my previous letter which
had the requirements necessary to obtain an Occupancy Permit . Since that time ,the owner did hire an
Architect to do a code review and that document was produced by Architect Paul Lessard and was received on
May 5h of this year.
To date no Building permit has been pulled,no Building inspections have.been.conducted andthe building
remains illegally occupied.

A hearing on this petition was held January 21 , 1987 with the following Board
Members present: James Hacker, Chairman; Messrs. , Fleming, Luzinski and Strout.
Notice of the hearing was sent to abutters and. others and notices of the hearing
were properly published in the Salem Evening News in accordance with Massachusetts
General Laws Chapter 40A.
The petitioners are requesting a Special Permit to extend nonconforming structure
and use to allow construction of an addition in this R-2 district.
The provision of the Salem Zoning Ordinance which is applicable to this request
for a Special Permit is Section V B 10, which provides as follows:
Notwithstanding anything to the contrary appearing in this Ordinance, -the Board of
Appeal may, in accordance with the procedure and conditions set forth in Section
VIII F and IX D, grant Special Permits for alterations and reconstruction of noncon-
forming structures, and for changes, enlargement, extension or expansion of noncon-
forming lots, land, structures, and uses, provided, however, that such extension,
enlargement or expansion shall not be more detrimental than the existing nonconform-
ing use to the neighborhood.
In more general terms, this Board is, when reviewing Special Permit requests,
guided by the rule that a Special Permit request may be granted upon a finding
by the Board that the grant of the Special Permit will promote the public health,
safety, convenience and welfare of the City's inhabitants.

after viewing the plans, makes the following findings of fact:
1 . There was no opposition;
2. The owners have operated there business at this site for the
past seven (7 ) years without complaints from the neighborhood.
On the basis of the above findings of fact, and on the evidence presented at the
hearing, the Board of Appeal- concludes as follows:
1 . The granting of the Special Permit requested will prorote the
convenience and welfare of t:ne City'S inhabitants;
2. The relief reouested can be Sranted without substantial detriment to
the public good and without nullifying or substantially derogatin^ fro_:,
the intent of the district of the purpose of the Ordinance.
