Re: enforcement of sign ordinance on 80 Margin Street (NAPA)
Dear Mr. Femino,
This letter will serve as an official answer to your request for enforcement regarding alleged violations of the
Salem sign Ordinance at 80 Margin Street. The sign permit was issued in 1993 (copy provided to you).The sign
was issued a building permit and 25 years have gone by since the issuance of the Building permit for a sign.
Therefore, under Mass Zoning Law 40A, section 7. after six years ,the City cannot take any enforcement
actions regarding the sign.
I have stated this several times to you and have included it in an e-mail with you. You have the right to
Appeal my decision' to not take any enforcement action' on the sign.That Appeal needs to be filed with the
Salem Zoning Board of Appeals within 30 days of this notice.
You cannot appeal this to the Mayors office,the City Council, Legal Department or any other City body or
department. Unless an Appeal is filed with ZBA,this is the final correspondence regarding this sign.
I understand that you may still be requesting documents regarding the sign and other items pertaining to the
property at 80 Margin Street. You have the right to do so under State Law and your request is to Joanne
Roomey,who will be happy to provide you with steps you need to follow to make a formal Public records
request.
