This office represents Joann Twomey and Gary Blattberg, as Trustees of 128 Bridge Street Realty
Trust, the owner of the premises located at 128 Bridge Street Salem.
The premises in question are a mixed use containing exactly four rooms which are let to the public
as lodgings, and it also contains six studio apartments each of which are not let as rooms.
My clients have informed me that a recent inspection by an Assistant Building Inspector and the
Chief of Fire Prevention have re-raised the issue of sprinkling of the subject premises. This issue was
analysed in 1989, and a decision rendered by the Fire Marshall of the City of Salem that the premises
are not required to be sprinklered under the provisions of Massachusetts General Laws Chapter 148,
Section 26H. I have enclosed copies of my 1989 correspondence to the Fire Marshall and his reply and
opinion.
I have enclosed a current copy of Chapter 148 Section 26H,which has not changed, and clearly
defines the Lodging House as a house where lodgings are let to six or more persons, and therefore these
premises are not required to be sprinklered.
Please note that Fire Marshall Turner's correspondence to me dated May 19, 989 states that a copy
of his opinion has been placed on file for reference.

CHAPTER 148. FIRE PREVENTION
Chapter 148: Section 26H Lodging or boarding houses; automatic sprinkler systems
Section 26H. In any city or town which accepts the provisions of this section, every lodging house
or boarding house shall be protected throughout with an adequate system of automatic sprinklers in
accordance with the provisions of the state building code. No such sprinkler system shall be
required unless sufficient water and water pressure exists. In such buildings or in certain areas of
such buildings, where the discharge of water would be an actual danger in the event of a fire,the
head of the fire department shall permit the installation of such other fire suppressant systems as are
prescribed by the state building code in lieu of automatic sprinklers. The head of the fire
department shall enforce the provisions of this section.
For the purposes of this section""lodging house" or ""boarding house" shall mean a house where
lodgings are let to six or more persons not within the second degree of kindred to the person
conducting it,but shall not include fraternity houses or dormitories,rest homes or group residences
licensed or regulated by agencies of the commonwealth.
Any lodging or boarding house subject to the provisions of this section shall be equipped with
automatic sprinklers within five years after acceptance of this act by a city or town.
Whoever is aggrieved by the head of the fire department's interpretation, order, requirement or
direction under the provisions of this section, may within forty-five days after the service of notice
thereof, appeal from such interpretation, order or requirement to the board of appeals of the fire
safety commission as provided in section two hundred and one of chapter six.

As you are aware, this office represents Joanne Twomey and
Gary Blattberg as Trustees of 128 Bridge Street Realty Trust, the

This is to serve as a request for your inspection_ of the
premises and your determination that the subject premises are not
subject to the requirements Of Massachusetts General Laws, Chap-
ter 148, SeCtton 26H, which requires the installation of auto-
matic sprinkler systems in lodging or boarding houses.
The history and present use Of the subject premises is very
Important in making this determination. The present owners have
properly maintained a lodging house license under the require-
ments of Massachusetts General Laws, Chapter 140, Section 24, and
Section 22, which require licensing of lodging houses as defined
in Section 22 as "a house where lodgings are let to four or more
persons. . . " The premises at 128 Bridge Street contain exactly
four rooms which are let to the public as lodgings and also con-
tains six studio apartments. each of which are not let a9 rooms,
but are either lensed or rented as studio apartments with written
tenancy-at-will agreements. Historically, then, the licensing
laws contained in Chapter 140 require a lodging house license due
to the fact that four rooms are let to the public.

Legal Remedies for Tenants of
Residential 13ousing
TUe following is a brief summary of some of the legal remedies tenants may use in order to get housing code violations
corrected:
1: Rent wthholdinp(Massachusetts General laws,Chapter 239,section 8A):If Code Violations Are Not Being Corrected you
may be entitled to hold back your tent payments.You can do this without being evicted if:
A. You can prove that your dwelling unit or common areas contain code violations which are serious enough to endanger
or materially impair your health or safety and that your landlord knew about the violations before you were behind in,
your rent-
B. You did not cause the violations and they can be repaired while you continue to live in the building.
C. You are prepared to pay any portion of the rentinto court if a judge order., you to pay it (For this,it is best to put the
rent money aside in a safe place.)
I Ron it and D do t(Massachusetts General Laws,Chapter l I1,section 127L):The law sometimes allows you to use your tent
money to.make the repairs yourself.If your local code enforcement agency certifies that there are code violations which
endanger or materially impair your health,Wdy,,or welt-being,and your landlord has received written notice of the violations.-

3. RcLalintoccRot Increases or Evictions Prohibited(Massachusetts General Laws,Chapter 186,section 18,and Chapter 239
section 2A):The owner may not increase your rent or evict you in retaliation for making a complaint to your local code
enforcement agency about code violations.If the owner raises your rent to tries to evict within six months after you have made
the complaint,he.or she.will:have,to-show.a good reason for the increase or eviction which is unrelated to your complaint-You
may be able to sue the landlord for damages of he or she tries this.
4. Rent�ersbin(Massachusetts General Laws,Chapter 11,section 127 C-H):The occupants and/or the Board of Health may
petition the District or Superior Court to allow rent to be paid into.court rather than to the owner.The court may then appoint a
"receiver" who may spend as much of the rent money as is needed to correct the violation.The receiver is not subject to a
spending limitation of four months'rent
5. Breach of Warranty of Habitability: You may be entitled to sue your landlord to have all or some of your rent returned if your.
dwelling unit does not meet minimum standards of habitability.
6. Unfair and Deceo iy .Ptacti es(Massachusetts General Laws,Chapter 93A): Renting an apartment with code violations is a
violation of the consumer protection act and regulations, for which you may sue an owner.

State Sanitary Code, Chapter I: General Administrative Procedures and 105 CMR 410.00: State Sanitary Code,
Chapter II: Minimum Standards of Fitness for Human Habitation, a reinspection was conducted of the property
located at 128 Bridge Street occupied by(Lodging House)conducted by Virginia Moustakis, Senior
Sanitarian on Wednesday,June 18,1997 at 9:15 A.M..
Notice: If this rental unit is occupied by a child or children under the age of 6 years, it is the property owner's
responsibility to ensure that this unit complies fully with 105 CMR 460.000: Regulations for Lead Poisoning
Prevention and Control. For further information or to request an inspection, contact the Salem Health
Department at 741-1800.
You are hereby ORDERED to make a good-faith effort to correct the violations listed on the enclosed inspection
report.
Failure on your part to comply within the time specified on the enclosed inspection report will result in a
complaint being sought against you in Salem District Court. Time for compliance begins with receipt of this
Order.
Should you be aggrieved by this Order, you have the right to request a hearing before the Board of Health. A
request for said hearing must be received in writing in the office of the Board of Health within 7 days of receipt of
this Order. At said hearing,you will be given an opportunity to be heard and to present witness and documentary
evidence as to why this Order should be modified or withdrawn. You may be represented by an attorney. Please

Legal Remedies for Tenamts of
Residential Housing
The following is a brief summary of some of the legal remedies tenants may use In order to get housing code violations
corrected:
1. Rent Wi hholding(Massachusetts General laws,Chapter 239,section 8A):If Code Violations Are Not Being Corrected you
may be entitled to hold back your rent payments.You can do this without being evicted if:
A You can prove that your dwelling unit or common areas contain code violations which are serious enough to endanger
or materially impair your health or safety and that your landlord knew about the violations before you were behind in-
your rent_
B. You did not cause the violations and they can be repaired while you continue to live in the building.
C. You are prepared to pay any portion of the rent into court if a judge order., you to pay it.(For this,it is best to put the, .
rent money aside in a safe place.)
2. Repair and Deduct(Massachusetts General laws,Chapter 111,section 127L):The law sometimes allows you to use your rent ,
money to make the repairs yourself.If your local code enforcement agency certifies that there are code violations which
endanger or materially impair your health,mfety,.or weI}-being,and your landlord has received written notice of the violations.
you may be able to use this remedy.If the owner fails to begin necessary repairs(or to enter into a written contract to have thedi^
made)within five days after notice or to complete repairs within 14 days after notice, you can use up to four months'rent in;any

3. Rmaliatory Rent Incrrasrs or Evictions Prohibiters(Massachusetts General Laws,Chapter 186,section 18,and Chapter 239
section 2A):The owner may not increase your rent or evict you in retaliation for making a complaint to your local code
enforcement agency about code violations.If the owner raises your rent to tries to evict within six months after.you.have made
the complaint,he or she will:haveao-show.a good reason for the increase or eviction which is unrelated to your complaint_You
may be able to sue the landlord for damages of he or she tries this.
4. Rent�rship(Massachusetts General Laws,Chapter 11,section 127 C-H):The occupants and/or the Board of Health may
petition the District or Superior Court to allow rent to be paid into court rather than to the owner.The court may then appoint a
"receiver" who may spend as much of the rent money as is needed to correct the violation.The receiver is not subject to a
spending limitation of four months'rent

violation of the consumer protection act and regulatious, for which you may sue an owner.

The following is a brief su .
mmary of soe`of the legal remedies tenants may use in,order to get
housing code violations corrected.: .,

1. Rent Withholding(Massachusetts General Laws, Chapter 239, section 8A): If Code Violations Are Not
Being Corrected you may be entitled to hold back:your--rent payments: You can do this without being evicted if:
You can prove that your dwelling unit or common areas contain code violations which are serious
enough to endanger or materially impair,your health of safety and that your landlord knew about the
violations before you were behind in your rent.
You did not cause the violations and they can be repaired while you continue to live in the
building.
You are prepared to pay any portion of the rent into court if a judge orders you to pay it. (For this,
it is best to put the rent money aside in a safe place)

2. Repair.and Deduct Nassachusetts General Laws,Chapter K section 127L) ThFlaw sometimes allows
you to use your rent money to make the repairs yourself. If your local code enforcement agency certifies that

3. Retaliatory RentIucreases or Evictions'Proliibited'(Massacfiusetts General Laws,Chapter 186, section
18, and Chapter 239, Section 2A): The owner may not increase your rent or evict you in retaliation for
making a complaint to your local.code enforcement agency about code violations.If the owner raises your
rent to try to evict within six months after you have made`the complaint lie or she will have to show a good
reason for the increase oreviction-which is unrelated to your complaint.-.You maybe able to sue the landlord
for damages or if he or she tries this.
4. Rent Receivership(Massachusetts General Laws Chapter B,s&ti6n'127 C-H): The occupants and/or the
Board of Health may petition the District or Superior Court to allow rent to be paid into court rather than to
the owner.The.court may then appoint_a"receiver's o-who may spend as much of the rent money as is needed
