DECISION ON THE PETITION OF THEODORE KUSZMAR FOR A {
VARIANCE AT 109 BRIDGE ST. (B-1) c�
A hearing on this petition was held on August 22, 1984= wit�lthe following Board
Members present: Edward Luzinski, Vice Chairman, Scot'l. Charnas, Secretary,
Robert Gauthier and Associate Member, Richard A. Bencai. Ndtice of the
hearing was sent to abutters and others and notices of the hearing were
properly published in the Salem Evening News in accordance with Massachusetts
General Laws Chapter 40 A.
The petitioner has requested a Variance from lot coverage and rear and side
setbacks to construct an addition to his store at 109 Bridge St. in this
B-1 district.
The Variance which has been requested may be granted upon a finding of
the Board that:
A. spacial conditions and circumstances exist which especially affect
the land, building or structure involved and which are not generally
affecting other lands, buildings and structures in the same district;
B. literalenforcement of the provisions of the Zoning Ordinance would
• involve substantial hardship, financial or otherwise, to petitioner;
and;
C. desirable relief may be granted without substantial detriment to
the public good and without modefying or substantially derogating
from the intent of the district or the purpose of the Ordinance.
The Board of Appeal, after hearing the evidence presented at the hearing,
makes the following findings of fact:
1. There was no opposition raised by neighbors and abutters.
2. The store on the lot was there before the zoning laws were inacted.
3. The shape of the lot and building makes any expansion except the
one proposed impractical.
4. The enactment of the bottle and can deposit law is putting a
strain on existing space within the present facility.
On the basis of the above findings of fact, and on the evidence presented
at the hearing, the Board of Appeal concludes as follows:
1. Special conditions exist which affect this lot but which do
-- not affect the district generally.

2. Literal enforcement of the Ordinance would work a substantial
financial hardship upon petitioner.
3. The variance requested may be granted without substantial
detriment to the public good, and without substantially dero-
gating from the intent and purpose of the Ordinance.
Therefore, the Zoning Board of Appeal voted unanimously to grant
petitioner the variance requested in order to construct the addition des-
cribed in the plan submitted to the Board subject to the following conditions:
1. A six foot high stockade fence be constructed the entire length
of the new addition which faces 113 Bridge ST.
2. All deliveries to the store, except those from a tractor-trailer.
be made on Arbella St.
3. The petitioner must install an approved fire alarm system, maintain
adequate egress and lighting and maintain an approved hearing
system within an enclosed boiler room.

Gentlemen:
As it will be impossible for me to attend the Aug.22nd hearing in
person, I respectfully request that this letter be read to the Board on
the night of the hearing, Aug.22, and that the Board consider favorably
the recommendations set forth in the letter.
At present, I am spending a great deal of money to restore the property
immediately adjacent to Mr. Kuszmar's store. This fact can be verified
by the Salem Redevelopment Authority, which has recently provided funding
to aid in the historic building's restoration. My property and building,
located at 113 Bridge St. , will significantly decrease in aesthetic value
with Mr. Kuszmar's proposed addition, especially if the new addition is
similar in appearance to the already-existing store.
Because I do not wish to thwart Mr. Kuszmar's plan entirely, I strongly
recommend that every effort be made to maintain a favorable aesthetic
appearance. For this reason, I recommend that a wooden stockade fence be
constructed at the height and the entire length of the proposed addition.
In this way flowers and vines could be planted against the fence to land-
scape the grounds and mask the addition from the 113 Bridge St. property.
If this fence were built, I would have no strong objection to Mr. Kuszmar's
proposed addition, for I believe that only in this way could the residence
and the business harmoniously coexist.

As a result of public notice received concerning the Board of Appe;.l
hearing for the above listed name and address, the Salem Fire
Department , requeSta the following items to be placed on record .
1. The Salem Fire Department has not been provided a plan as of
this date, showing the proposed addition.
2 . Approval is withheld until this office has been contactefi
with plans in such clarity and detail so as to provide us
with the conditions of construction, to permit this- office
to render an opinion, concerning the additional fire loading
and access. for fire fighting purposes.
3 . This occupancy shall be required at the time of construction
to meet all provisions of the current Mass . State Building Code
and the Fire Code. This shall require installation of an
approved fire alarm system, adequate egress and lighting,
approved heating system within an enclosed boiler room,
and adequate access to the exterior of the structure for fire -
fighting purposes.

As a result of public notice received concerning the Board of Appeal
hearing for the above listed name and aaaress, the Salem Fire
Department, request:; the following items to be placed on record .
1. The Salem Fire Department has not been provided a plan as of
this date, showing the proposed addition.
2. Approval is withheld until this office has been contacted
with plans in such clarity and detail so as to provide us
with the conditions of construction, to permit this office
to render an opinion, concerning the additional fire loading
and access for firefighting purposes.
3. This occupancy shall be required at the time of construction
to meet all provisions of the current Mass. State Building Code
and the Fire Code. This shall require installation of an
approved fire alarm system, adequate egress and lighting,
approved heating system within an enclosed boiler room,
and adequate access to the exterior of the structure for fire
fighting purposes.
