Pursuant to the provisions of said sections, you are herby notified that a certain unsightly
condition exists on premises specifically described as graffiti which injures neighboring
property and the public health, safety and welfare. You are therefore notified at once and
in any event within 30 days from the date of this notice, to remove said unsightly
condition from the property and hereafter to keep the said property free there from.
In the event you fail to complete such work within the time hereinabove mentioned, the

1. Signs/banners displayed on fence with no permit.
You are hereby ordered to remove the illegal signsibanners immediately and to notify this

course of action you have taken to rectify this violation. Failure to do so will result in

TO ERECT AN ADDITION TO EXISTING STRUCTURE AT
106 BRIDGE STREET.
This is a direct appeal by the Petitioner, Systems Improvement , Inc . , by its
Vice-President, Herbert G. Weiner, 106 Bridge Street , Salem, from the applic-
able terms of the density regulations of the City Zoning Ordinance to allow
the erection of a 16 ' x 18 ' addition on the Saunders Street side of their
building.
A hearing was held on this appeal on August 13 , 1973 , pursuant to notices
mailed postpaid to the Petitioner, Board Members , abutters , abutters to
abutters , and others , and advertisements were duly published in the Salem
Evening News , advising of this Public Hearing.
Chairman John M. Gray, Sr. opened this meeting with Board Members Donald
Koleman, Arthur Labrecque , William Abbott , and Associate Member, Warren Baughn
present.
The Petitionerwas represented by Herbert G. Weiner, Vice President of Systems
Improvement , Inc . The site in question is located on a parcel bounded by
Bridge Street , Saunders Street, and Cross Street. The proposed addition is
approximately 25 feet more or less from Saunders Street, and, according to
the Petitioner, is needed to protect the employees from exposure in case
of bad weather and hazardous working conditions in and around the recycling
pit of the Petitioner' s car wash located on the premises . The Petitioner
also stated that the erection of the proposed addition would even off the
building and shield from the structure the recycling pit and, therefore ,
improve the appearance of the building. The plan submitted by the Petitioner
drawn by John V. Emerson is made a part of the record herewith.
No one appeared in opposition.
The Board, after carefully - considering ,the evidence introduced, and the
architect ' s plan, felt that although the site is in an R-2 zoning district
restricted to two-family use only, the expansion of the non-conforming use
would not be detrimental to the neighborhood.
The Board also felt that the Petitioner was under hardship due to the
particular use of the building. The Board found that the expansion of the
non-conforming use in this case would not be in derogation to the use and
intent of the Zoning By-Law.
The Board voted unanimously to GRANT the variance sought .

VARIANCE FOR 106 BRIDGE STREET, SALEM
A hearing on this petition was held January 25, 1984 with the following Board
Members present: James Hacker, Chairman; Messrs. , Charnas., Hopper, Luzinski and
Associate Member Bencal. Notice of the hearing was sent to abutters and others
and notices of the hearing were properly published in the Salem Evening7News in.
accordance with Massachusetts General Laws Chapter 40A.
Petitioner requests a Variance to allow him to enlarge the existing structure and
to conduct an automobile muffler repair and service shop in this R-2 district.
The current owner of the premises is Systembs'Improvements, Inc. Petitioner also
requests Variance from minimum lot area, lot width, lot coverage, side yard, front
yard and parking requirements. -
The Variance which has been requested may be granted upon a finding of the Board
that:
a. . special conditions and circumstances exist which especially affect
the land, building or structure involved and which are not generally
affecting other lands, buildings; and structures in the same district;
b. literal enforcement of the provisions of the Zoning Ordinance would in-
volve substantial hardship,. financial or otherwise, to the petitioner; and
c. desirable relief may be granted without substantial detriment to the
public good and without nullifying or substantially derogating from the
intent of the district or the purposes of the Ordinance.
The Board of Appeal, after hearing the evidence presented at the hearing, makes the
following findings of fact:
1 . The premises, formerly a car wash, have been in a derelict and
deteriorating condition for approximately one year;
2. The lot is peculiar in shape, is bordered on one side by an old railroad
right of way and on its other three sides by streets - a condition which
makes it impossible to acquire more space;
3. Because of the site and. shape of the lot, a literal enforcement of the
Ordinance would render the property extremely difficult to market in
an area, though R-2, which is heavily commercial.
On the basis of the above findings of fact and on the evidence presented at the
hearing, the Board concludes as follows:
1 . Special conditions exist which affect this lot which do not generally
affect the district;
2. Literal enforcement of the Ordinance would work a substantial hardship
upon the petitioner;

3. The Variances can be granted without substantial detriment to the public

Therefore, the Board of Appeal voted unanimously to grant the Variances requested
as more fully described in a plan submitted to the Board, provided that:
1 . Refuse is to be stored indoors-on-the-premises-except that rePpse may be
stored-out-doors if in a dumpster s`urounded by a fence with a gate;
2. Hours of operation to be 7:30a.m. to 6:00 p.m. , Monday through Saturday;
3. The property must be landscaped;
4. All previous non-conforming uses will no longer be permitted; and
5. Gas tanks and pumps on or under the premises must be removed_

At a meeting of the Board of Appeals on Wednesday, July 28 , 1971 , the Mem-
bers present were Chairman John M. Gray, Sr. , William F. Abbott , Joseph F.
Doyle , James Boulger and Arthur Labrecque , and Associate Members Emery P.
Tanch and J . Norman Welch, Jr.
The matter of the appeal of James L. Kelley , Jr. , Yellow Cab, Ir.c . , 106
Bridge Street was considered. This particular case had been discussed and
heard several times on motion of reconsideration but no decision had ever
been filed according to the Statute .
On Monday , July 26 , 1971 in this matter a vote had been taken but _only
three members of the regular Board had voted in favor, therefore , it was
considered advisable to reconsider the entire matter which was done .
At the invitation of the Board , the Solicitor for., the City of Salem , Albert
R. Pitcoff, was present and addressed the Board. He stated. that the Chair-
man of the Board had requested him to state to the Board the particular
jurisdiction of the Board in this matter . Mr. Pitcoff said that in view
of the record in this case to date which he had reviewed, it was his con-
sidered opinion that the Board should vote "Leave to Withdraw Without
Prejudice" .
Mr. Gray stated that on account of reasons that he had , he did not intend
to vote on this particular case at this time , whereupon under the Sta-t-ute
as made and provided he designated Associate Member Emery P . Tanch as a
voting member in this case . This was adopted without objection.
Emery P . Tanch moved that the Petitioner in this case be given Leave to.
Withdraw Without Prejudice ; Joseph F. Doyle seconded the motion; the vote
as recorded by the Secretary is as follows :
