RE: Peterborough Oil - 94 Bridge Street
On Thursday, June 5, 1997, the Planning Board of the City of Salem opened a public hearing
regarding the application of Peterborough Oil Co., Inc.,665 N. Main Street, Leominster, MA,
under Section 7-18, Site Plan Review of the Salem Zoning Ordinance, with respect to property
located at 94 Bridge Street. The proposed project involves the demolition of the existing block
building and removal of gasoline pumps to allow the construction of a new building of
approximately the same size, as well as the installation of new gasoline pumps and canopy.
The public hearing was closed on July 10, 1997, and at a regularly scheduled meeting of the
Planning Board held on July 10, 1997, the Board voted by a vote of eight(8) in favor, and
one(1) opposed, to approve the application as complying with the requirements of Section 7-18,
subject to the following conditions:
I. Conformance with Plan
Work shall conform with set of plans entitled, "Proposed Service Station Improvements
for Peterborough Oil Co., Inc, Bridge Street, Salem, MA",dated May 1, 1997, revised
through June 26, 1997,containing nine(9)sheets labeled 1-9,prepared by Tyree
Engineering, PC, 9 Otis Street, Westborough, MA 01581.
2. Amendments
Any amendments to the Site Plan or waiver of conditions contained within shall require
the approval of the Planning Board.
3. Utilities
A. Utility installation shall be reviewed and approved by the City Engineer prior to the
issuance of a Building Permit.
B. Drainage shall be reviewed and approved by the City Engineer prior to the issuance of
a Building Permit.
4. Board of A meals
All requirements of the Board of Appeal Decision shall be strictly complied with.
5. Site Lightine
All site lighting shall be installed and maintained in such a way so as to not reflect or
cause glare on abutting properties, or which adversely affect safe vision of operators of
vehicles moving on nearby streets.
6. Landscaping
A. All landscaping shall be done in accordance with the approved set of plans.
B. Trees shall be a minimum of 3 %2" caliper.
C. Sloped granite curbing shall be installed along the radii at each of the two entrance
driveways.
D. Concrete curbing shall be installed within the entire site.
E. The applicant shall work with the City Planner and the City's Landscape Architect to
determine the most appropriate screening and landscaping for the rear of the property,
along Cross Street, and for the side of the property located on Pearl Street. The design
shall include a pedestrian opening at the rear of the property. This plan shall be
submitted to the City Planner for written approval prior to the issuance of a Building
Permit.
F. After all project landscaping is completed, and prior to the issuance of a Certificate of
Occupancy, the applicant, his successors or assigns, shall be required to add further
landscaping if such is required by the City Planner.
7. Signage
Proposed signage shall be reviewed and approved by the City Planner and the Sign
Review Committee.
8. Board of Health
All Board of Health requirements shall be strictly adhered to.
9. Fire Department
All work shall comply with the requirements of the Salem Fire Department.

10. Building Ins ep ctor
All work shall comply with the requirements of the Building Inspector.
11. Underground Utilities
All utilities shall be installed underground.
12. Clerk of Works
A Clerk of Works shall be provided and paid for by the applicant, his successors or
assigns, as deemed necessary by the City Planner.
13. HVAC Equipment
The Applicant shall submit catalog cuts of the HVAC system documenting projected
noise levels shall be submitted to the Planning Department prior to the issuance of a
Building Permit. The dB of the equipment shall be no more than 50 dB as measured at
the nearest property line, and reasonable muffling of the HVAC equipment shall be
installed to further reduce the level of noise from the equipment.
14. Maintenance
A. Refuse removal, ground maintenance and snow removal shall be the responsibility of
the developer, his successors or assigns.
B.Winter snow in excess of snow storage areas on the site shall be removed off site.
15. Construction Practices
All construction shall be carried out in accordance with the following conditions:
A.No work shall commence before 8:00 A.M. on weekdays and Saturdays. No work
shall continue beyond 5:00 P.M. There shall be no work conducted on Sundays and
holidays. Inside work of a quiet nature may be permitted at other times.
B.AII reasonable action shall be taken to minimize the negative effects of construction on
abutters. Advance notice shall be provided to all abutter in writing at least 72 hours prior
to commencement of construction. Notification shall also be submitted to the Planning
Department.
C. Maintenance of all landscaping shall be the responsibility of the applicant, his
successors or assigns. The applicant, his successors or assigns, shall guarantee all trees
and shrubs for a two(2) year period.
D.AII construction shall be performed in accordance with the Rules and Regulations of
the Planning Board, and in accordance with any and all rules, regulations and ordinances
of the City of Salem.
lb. As-Built Plans
As-built plans, stamped by a Registered Professional Engineer or Land Surveyor, shall be
submitted to the Planning Department and Engineering Department prior to the issuance
of a Certificate of Occupancy.
17. Violations
Violations of any condition of this Decision may result in revocation of this permit by
the Planning Board.
I hereby certify that a copy of this decision and plans have been filed with the City Clerk and
copies are on file with the Planning Board. The Special Permit shall not take effect until a copy
of this decision bearing the certification of the City Clerk that twenty(20)days have elapsed and
no appeal has been filed or that if such appeal has been filed, and it has been dismissed or denied,
is recorded in the Essex County Registry of Deeds and is indexed under the name of the owner of
record or is recorded on the owner's Certificate of Title. The fee for recording or registering
shall be paid by the owner or applicant.

This letter is to formalize a conversation I had with one of your store Manager. The tent
on the corner of your property violates City of Salem Zoning Ordinance, Building codes
and Fire Prevention Regulations.
1. Salem Zoning—Section 7-18 Site Plan Review
When your building was constructed, a definitive site plan was submitted and
approved by the Planning Department. This plan does not show any structures,
tents or the structure on the corner. You would need to apply to the Planning
Board to alter anything on your site.
2. State Building Code 780 CMR, Section 110.2 Permits— State Building Code
Requires,a building permit for temporary structures. Included in this application
would be a Certificate for the tent regarding flame spread and smoke generation
as well as the amended site plan mentioned in the previous paragraph.
Fire Regulations
Salem Fire Prevention has informed me that the State Fire Marshall's Office
accompanied our Fire Department, and cited you on several violations, including,
the propane heater.
Because of the serious threat to life safety, I am declaring the tent an "unsafe structure"
per the State Building Code 780 CMR, Section 121.1 established by Mass General Law
143 Sections, 6.7.8.9 and 10. You have until noon on Friday the 31st to remove the
structure. If you fail to comply, this Department will remove the structure.
There is no appeal from this order. If you feel you were aggrieved by this order, you may
refer to Mass General Law 139, Section 2

In accordance with §116 Construction Control of the Massachusetts State Building
Code 61h Edition, we are providing field review for the referenced project.
On January 14`h, 1998, 1 performed a final field review of construction at this location.
At this time, construction of the site was substantially complete. Based on my field
review, site features appear to be in general conformance with the approved building
and site plans. Due to the winter season, the final topcoat of bituminous paving and
final landscaping for the site will be performed at a later date. It is anticipated that
these two final activities will be completed no later than April 15`h, 1998. Attached is the
standard construction control form as provided by your office filled out as required and
as appropriate for this project.

In accordance with §116 Construction Control of the Massachusetts State Building
Code 6'" Edition, we are providing field review of the referenced project.
On December, 5, 1997, 1 performed a field review of construction at this location. At
this time, construction activities included site work, product piping work, installation of
the dispenser frames and steel construction of the building. The site had been rough
graded and all existing pavement and structures have been removed. The new building
block construction had already been installed. It is my understanding that within the
next week the roof trusses for the building will be installed.
At this time, all work appeared to be in general conformance with the approved site
plans. We will provide further inspection as the project proceeds.

DECISION ON THE PETITION OF MICHAEL J. APOSTOLOS REQUESTING A VARIANCE FOR 94 BRIDGE
STREET
A hearing on this Petition was held on October 29 and continued to November 19,
1980 with the following Board Members present on November 19, 1980 at which, time
the Board took action on the petition: Mr. Douglas Hopper, Chairman, Messrs. Piemonte
and LaBrecque, and Associate Member Luzinski. Notices of the hearing were sent to
abutters and others and notices of the hearing were published in the Salem Evening
News in accordance with Massachusetts General Laws, Chapter 4OA.
The Petitioner has requested. a variance for the property at 94 Bridge Street.
The property in question is currently used as a gas station, truck rental and
towing business. The variance is needed to construct an addition to the existing
non-conforming structure at the site. A variance is required because the building
is in an R-2 district where the proposed use would otherwise be prohibited. The
Petitioner did not request nor did the Board consider whether the requested relief,
could have been granted by the issuance of a special permit for the extension of an
existing non-conforming use.
The Board of Appeals, after consideration of the evidence presented at the
public hearing and after viewing the property makes the following findings of fact:
1. The structure on the property is, despite the fact that it is non-conforming,
attractive in appearance.
2. The area surrounding the property is a residential area with well maintained
single and multi-family homes.
3. The Petitioner's plans for this property will substantially reduce the visual
impact of the Petitioner's business on the surrounding neighborhood and will there-
fore be beneficial to the City.
On the basis of the above findings of fact, and the evidence presented at the
public hearing, the Board of Appeals concludes as follows:
(1) The Petitioner's land is unique to the surrounding area because of its
current use and its existing structure.
(2) These conditions affect the property in question but do not generally affect
the zoning district in which the property is located_
(3) The conditions described above, which affect the land in question, but. not
the zoning district generally, cause the following special hardship: Unless the
variance, with conditions, is granted the property will not be improved and the entire
neighborhood will suffer.
(4) The desired variance may be granted without substantial detriment to the
public good because the proposed plan will in fact improve the appearance of the
property and will improve the appearance of the surrounding neighborhood.

Therefore, the Board of Zoning Appeals unanimously voted in favor of granting the
requested relief. . A variance is therefore granted, to the Petitioner on the follow-
ing terms and conditions:
1, within three weeks from the date of this decision, the Petitioner shall
submit to the Building Inspector signed contracts for (a) the paving of* the parking
area in the rear of the property, (b) the landscaping of the property in accordance
with the plan submitted to the Board, which plans include the planting of six foot
shrubs and trees in the rear of the property, and "(c) the removal of a dead tree in
the rear of the property.
2. The first floor addition to the property shall be used exclusively for
storage.
3. The second. floor addition shall be used exclusively as an office.
4. All landscaping, tree removal': and paving shall be completed by June 30, 1981.
5. This variance is also extended to authorize a previously constructed 12 foot
by 18 foot addition to the property which was not previously approved by this Board,
6. This variance is expressly conditioned upon the completion of the above
described landscaping, paving and tree removal. Any failure to complete this work
will constitute a violation of this variance which will nullify the granting of the
variance and subject the petitioner to appropriate sanctions including but not
limited to the fines and penalties outlined in Mass. General Laws, Chapter 40A,
Section 7.

PERMIT FOR THE PROPERTY LOCATED AT 94 BRIDGE STREET�(R-2)
A hearing on this petition was held March 19, 1997 and continued to
April 16, 1997 with the following Board Members present: Gary
Barrett; Chairman, Nina Cohen, Albert Hill, Paul Valaskatgis and
Arthur LeBrecque. Notice of the hearing was sent to abutters and
others and notices of the hearing were properly published in the
Salem Evening News in accordance with Massachusetts General Laws
Chapter 40A.
Petitioner is requesting a Special Permit to allow the enlargement of
the existing non conforming use and Change of Use to permit a
mini-mart for the property located at 94 Bridge Street.
The provision of the Salem Zoning Ordinance which is applicable to
this request for a Special Permit is Section 5-3(j ) , which provides
as follows:
Notwithstanding anything to the contrary appearing in this Ordinance,
the Board of Appeal may, in accordance with the procedure and
conditions set forth in Sections 8-6 and 9-4, grant Special Permits
for alterations and reconstruction of nonconforming structures, and
for changes, enlargement, extension or expansion of nonconforming
lots, land, structures, and uses, provided, however, that such
change, extension, enlargement or expansion shall not be
substantially more detrimental than the existing nonconforming use to
the neighborhood.
In more general terms, this Board is, when reviewing Special Permit
requests, guided by the rule that a Special Permit request may be
granted upon a finding by the Board that the grant of the Special
Permit will promote the public health, safety, convenience and
welfare of the City's inhabitants.
The Board of Appeal, after careful consideration of the evidence
presented at the hearing and after viewing the plans, makes the
following findings of fact:
1. Petitioner proposes to renovate property by demolishing existing
structure and erecting new structure while expanding existing
non-conforming use as gas station to include convenience store
and gas station.
2. After meeting with neighbors and listening to concerns relative
to projected noise and nuisance from proposed plans, petitioner
agreed to the following changes from original plans (subject to
approval by the Planning Commission) :

A. Building footprint reduced to 2,600 square foot max;
B. Reduced parking spaces to 11;
C. Removed all parking from rear property line;
D. Rear border will receive extensive plantings.
E. Landscaping island at Bridge Street property line will limit
crossover traffic between pumps;
F. Dumpster will be located next to building;
G. Signage locations to be decided on Bridge Street;
H. Building facade will reflect neighborhood, with clapboard siding,
asphalt shingle room and dormers.
3. The plan as altered met the enthusiastic approval of Eric
Williams, of 4 Pearl St, Jack Cempellin, of North River
Neighborhood Association, and Paul Ward of Pearl St. and the
N.R.N.A. Regina Ward also appeared in support of the petition.
On the basis of the above findings of fact, and on the evidence
presented, the Board of Appeal concludes as follows:
1. The Special Permit requested can be granted without substantial
detriment to the public good or without nullifying and substantially
derogating from the intent of the district or the purpose of the
ordinance.
2. The granting of the Special Permit requested will promote the
public health, safety, convenience and welfare of the City's
inhabitants and may be granted in harmony with the neighborhood.
Therefore, the Zoning Board of Appeal voted unanimously, 5-0 to
grant the Special Permit requested, subject to the following
conditions:
1. Petitioner shall comply with all city and state statutes,
ordinances, codes and regulations.
2. All construction shall comply with all city and state statutes,
ordinances, codes and regulations.
3. All requirements of the Salem Fire Department relative to smoke
and fire safety shall be strictly adhered to.
4. Petitioner shall obtain a building permit prior to beginning
any construction.
5. A Certificate of Inspection shall be obtained.
6. Petitioner is to obtain approval from any City Board or
Commission having jurisdiction including, but not limited to,. a

Inspection conducted on site at 900 A. M. on VW79. Present were ,,,

' John Powers, Electrical Insp, Michael Dennedy, and myself.
All areas of - the structure were inspected with special attention to - -
areas of charring. The roof at the northerly end of the structure^ : ':.
appears to 'have been cracked and separated at the point where it ,me,ets
the side wall. Two blocks on the upper portion of the wall appear to°#
be pulled into the structure. Heavy fire appears to have developed Jh
the center bay and the storage room directly in the rear of the . center
bay. The fire appears to have spread into this storage area through , t.
;. , broken windows over the tire racks. An area adjacent to the main elao,
cal board was charred but only from a point about three .feet off the �T
` floor to the ceiling. It was noted that a zip cord wire was burnt
and showed signs of a bare wire, which was adjacent to an electrical; `_
junction box, which had been damaged by the opening of the sliding door
which leads from the garage to the office area. This junction box `=,

also showed signs of wires which were damaged by :the scrap in
of the movement of the junction box. A small charring was noted: on a`
the wall adjacent to this box with the zip cord burned and melted. ;

The Electrical inspector Michael Dennedy agrees that a spark

This wire was spliced into another wire which was used for the tonics
machine also. This was an illegal splice.
' Mr.- Apostolos stated that they were backing a car up to the door;, y
prior to bringing the vehicle inside ,for the night. This may have +
been the cause for the bell to ring and create the spark, as then
car rode over the bell air hose.

It therefor is ,coneluded that the probable cause is an `electrical , , _
are from the broken electrical wire, which ignited flammable vapors', .
in the area. This could occur even with the front door open.

Dear Mr. Apostolos,
Due to complaints of unregistered cars and some type of oil problem, a
February 8, 1988 site inspection of your business establishment located at
94 Bridge Street, Salem, Ma was conducted by a member of this Department.
The following was noted:
I . No evidence of any oil problems (spills, improper disposal ,
etc.) was noted in or around premises.
2. Several unregistered cars stored in an orderly and secure
fashion in the lot behind the Service Station. The lot is
fenced in and locked.
Upon completion of the site . inspection, a conversation between yourself and
the investigating inspector took place and the following was stated:
All waste oil is stored in proper containers and removed from the
premises on a regular basis by a Professional Disposal Firm (C.Y.N. )
The unregistered vehicles stored in the rear lot have been towed
and stored under Police Authorization. Vehicles are stored only
until the Police Department issues a disposal order, at which time
the vehicles are removed from the premises. No salvage operation
of any type takes place on these vehicles.

Dear Mr. Apostolosa
It will be necessary for me to refuse to issue a permit for
an addition to the property at the corner of Bridge and
Pearl Street. This is an R-2 District, and the addition
would be an extension of a non-conforming use, which must
be granted by the Board of Appeal.
There is a possibility that the Board will meet on the
24th of June, and they would require two sets of working
plans and two plot plans. If you wish to be heard at that
time all necessary data must be in this office by May 28,1974.
We are enclosing a copy of the rules of the Board for
presenting a proper appeal for a variance, also, forms which
must be filed in triplicate with the working plans and plot
pians. A check for. $26.25, payable to the Salem News Publishing
Company is required to cover the cost of advertising notice
of this Public Hearing.
