Main Street, Leominster, MA, under Section 7-18, Site Plan Review of the Salem Zoning Ordinance, with respect to property located at 94 Bridge Street. The proposed project involves the demolition of the existing block building and removal of gasoline pumps to allow the construction of a new building of approximately the same size, as well as the installation of new gasoline pumps and canopy. The public hearing was closed on July 10, 1997, and at a regularly scheduled meeting of the Planning Board held on July 10, 1997, the Board voted by a vote of eight(8) in favor, and one(1) opposed, to approve the application as complying with the requirements of Section 7-18, subject to the following conditions: I. After all project landscaping is completed, and prior to the issuance of a Certificate of Occupancy, the applicant, his successors or assigns, shall be required to add further landscaping if such is required by the City Planner. 7. Signage Proposed signage shall be reviewed and approved by the City Planner and the Sign Review Committee. 8. Board of Health All Board of Health requirements shall be strictly adhered to. 9. Fire Department All work shall comply with the requirements of the Salem Fire Department. r 10. Building Ins ep ctor All work shall comply with the requirements of the Building Inspector. 11. Underground Utilities All utilities shall be installed underground. 12. Clerk of Works A Clerk of Works shall be provided and paid for by the applicant, his successors or assigns, as deemed necessary by the City Planner. 13. HVAC Equipment The Applicant shall submit catalog cuts of the HVAC system documenting projected noise levels shall be submitted to the Planning Department prior to the issuance of a Building Permit. The dB of the equipment shall be no more than 50 dB as measured at the nearest property line, and reasonable muffling of the HVAC equipment shall be installed to further reduce the level of noise from the equipment. 14. Maintenance A. Refuse removal, ground maintenance and snow removal shall be the responsibility of the developer, his successors or assigns. B.Winter snow in excess of snow storage areas on the site shall be removed off site. 15. Construction Practices All construction shall be carried out in accordance with the following conditions: A.No work shall commence before 8:00 A.M. on weekdays and Saturdays. No work shall continue beyond 5:00 P.M. There shall be no work conducted on Sundays and holidays. Inside work of a quiet nature may be permitted at other times. B.AII reasonable action shall be taken to minimize the negative effects of construction on abutters. Advance notice shall be provided to all abutter in writing at least 72 hours prior to commencement of construction. Notification shall also be submitted to the Planning Department. C. Maintenance of all landscaping shall be the responsibility of the applicant, his successors or assigns. The applicant, his successors or assigns, shall guarantee all trees and shrubs for a two(2) year period. APOSTOLOS REQUESTING A VARIANCE FOR 94 BRIDGE STREET A hearing on this Petition was held on October 29 and continued to November 19, 1980 with the following Board Members present on November 19, 1980 at which, time the Board took action on the petition: Mr. Douglas Hopper, Chairman, Messrs. Piemonte and LaBrecque, and Associate Member Luzinski. Notices of the hearing were sent to abutters and others and notices of the hearing were published in the Salem Evening News in accordance with Massachusetts General Laws, Chapter 4OA. The Petitioner has requested. a variance for the property at 94 Bridge Street. The property in question is currently used as a gas station, truck rental and towing business. The variance is needed to construct an addition to the existing non-conforming structure at the site. A variance is required because the building is in an R-2 district where the proposed use would otherwise be prohibited. The Petitioner did not request nor did the Board consider whether the requested relief, could have been granted by the issuance of a special permit for the extension of an existing non-conforming use. The Board of Appeals, after consideration of the evidence presented at the public hearing and after viewing the property makes the following findings of fact: 1. The structure on the property is, despite the fact that it is non-conforming, attractive in appearance. 2. The area surrounding the property is a residential area with well maintained single and multi-family homes. 3. The Petitioner's plans for this property will substantially reduce the visual impact of the Petitioner's business on the surrounding neighborhood and will there- fore be beneficial to the City. On the basis of the above findings of fact, and the evidence presented at the public hearing, the Board of Appeals concludes as follows: (1) The Petitioner's land is unique to the surrounding area because of its current use and its existing structure. (2) These conditions affect the property in question but do not generally affect the zoning district in which the property is located_ (3) The conditions described above, which affect the land in question, but. not the zoning district generally, cause the following special hardship: Unless the variance, with conditions, is granted the property will not be improved and the entire neighborhood will suffer. (4) The desired variance may be granted without substantial detriment to the public good because the proposed plan will in fact improve the appearance of the property and will improve the appearance of the surrounding neighborhood. Notice of the hearing was sent to abutters and others and notices of the hearing were properly published in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A. Petitioner is requesting a Special Permit to allow the enlargement of the existing non conforming use and Change of Use to permit a mini-mart for the property located at 94 Bridge Street. The provision of the Salem Zoning Ordinance which is applicable to this request for a Special Permit is Section 5-3(j ) , which provides as follows: Notwithstanding anything to the contrary appearing in this Ordinance, the Board of Appeal may, in accordance with the procedure and conditions set forth in Sections 8-6 and 9-4, grant Special Permits for alterations and reconstruction of nonconforming structures, and for changes, enlargement, extension or expansion of nonconforming lots, land, structures, and uses, provided, however, that such change, extension, enlargement or expansion shall not be substantially more detrimental than the existing nonconforming use to the neighborhood. In more general terms, this Board is, when reviewing Special Permit requests, guided by the rule that a Special Permit request may be granted upon a finding by the Board that the grant of the Special Permit will promote the public health, safety, convenience and welfare of the City's inhabitants. The Board of Appeal, after careful consideration of the evidence presented at the hearing and after viewing the plans, makes the following findings of fact: 1. Petitioner proposes to renovate property by demolishing existing structure and erecting new structure while expanding existing non-conforming use as gas station to include convenience store and gas station. 2. After meeting with neighbors and listening to concerns relative to projected noise and nuisance from proposed plans, petitioner agreed to the following changes from original plans (subject to approval by the Planning Commission) : DECISION OF THE PETITION OF PETERBOROUGH OIL CO.REQUESTING A SPECIAL PERMIT FOR THE PROPERTY LOCATED AT 94 BRIDGE STREET (R-2) page two A. Landscaping island at Bridge Street property line will limit crossover traffic between pumps; F. Dumpster will be located next to building; G. Signage locations to be decided on Bridge Street; H. Building facade will reflect neighborhood, with clapboard siding, asphalt shingle room and dormers. 3. The plan as altered met the enthusiastic approval of Eric Williams, of 4 Pearl St, Jack Cempellin, of North River Neighborhood Association, and Paul Ward of Pearl St. and the N.R.N.A. Regina Ward also appeared in support of the petition. On the basis of the above findings of fact, and on the evidence presented, the Board of Appeal concludes as follows: 1. The Special Permit requested can be granted without substantial detriment to the public good or without nullifying and substantially derogating from the intent of the district or the purpose of the ordinance. 2. The granting of the Special Permit requested will promote the public health, safety, convenience and welfare of the City's inhabitants and may be granted in harmony with the neighborhood. Therefore, the Zoning Board of Appeal voted unanimously, 5-0 to grant the Special Permit requested, subject to the following conditions: 1. Petitioner shall comply with all city and state statutes, ordinances, codes and regulations. 2. All construction shall comply with all city and state statutes, ordinances, codes and regulations. 3. All requirements of the Salem Fire Department relative to smoke and fire safety shall be strictly adhered to. 4. Petitioner shall obtain a building permit prior to beginning any construction. 5. A Certificate of Inspection shall be obtained. 6. Petitioner is to obtain approval from any City Board or Commission having jurisdiction including, but not limited to,. a the Planning Board. Heavy fire appears to have developed Jh the center bay and the storage room directly in the rear of the . center bay. The fire appears to have spread into this storage area through , t. ;. , broken windows over the tire racks. An area adjacent to the main elao, cal board was charred but only from a point about three .feet off the �T ` floor to the ceiling. It was noted that a zip cord wire was burnt and showed signs of a bare wire, which was adjacent to an electrical; `_ junction box, which had been damaged by the opening of the sliding door which leads from the garage to the office area. This junction box `=, . also showed signs of wires which were damaged by :the scrap in of the movement of the junction box. A small charring was noted: on a` the wall adjacent to this box with the zip cord burned and melted. ; The owner. The only point to be considered also is that the electrical inspector;_; had to make was that he can not positivly state that the spark. occured just at the time of the explosion only. It may have been an on going occurance, ' This wire was spliced into another wire which was used for the tonics machine also. This was an illegal splice. ' Mr.- Apostolos stated that they were backing a car up to the door;, y prior to bringing the vehicle inside ,for the night. Several unregistered cars stored in an orderly and secure fashion in the lot behind the Service Station. The lot is fenced in and locked. Upon completion of the site . inspection, a conversation between yourself and the investigating inspector took place and the following was stated: All waste oil is stored in proper containers and removed from the premises on a regular basis by a Professional Disposal Firm (C.Y.N. ) The unregistered vehicles stored in the rear lot have been towed and stored under Police Authorization. Vehicles are stored only until the Police Department issues a disposal order, at which time the vehicles are removed from the premises. No salvage operation of any type takes place on these vehicles.
