(Petitioner) FOR A VARIANCE ATC-85_BRID� /A BARTON STREET (B-1 ) , RUSSEOO GREEN, JR. ;(DWNER) A hearing on this petition was held September 24, 1989 and continued until November 16, 1989 and November 29, 1989 with the following Board Members oresent: James Fleming, Chairman; Richard Bencal, Vice Chairman; John Nutting, Secretary; Richard Febonio and Associate Member Arthur LaBrecque. Notice of the hearing was sent to abutters and others and notices of the hearing were properly published in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A. Petitioner is requesting Variances from density, setbacks, use and parking to allow office, storage, sales and distribution use in this B-1 zone. Procertv_ is owned by Gempire Realty Trust, Russeoo Green, Jr. , Tr. The Variances which ^ave been requested may be granted upon a finding of -he Board that: a. special conditions and circumstances exist which especially affect the !and, building or structure involved and which are not generally affecting --*her lands, buildings and structures in the same district; . b. literal enforcement of the provisions of the Zoning Ordinance would Involve substantial hardship, financial or otherwise, to the petitioner; c. desirable relief may be granted without substantial detriment to the tublic good and without nullifying or substantially derogating from the intent of the district or the purpose of the Ordinance. The Board of Appeal, after careful consideration of the evidence presented at the hearing, and after viewing the plans, makes the following findings of fact: 1 . Both support and opposition to the plan was presented. 2. The lot previously contained a mixed business and residential use. 3. The petitioner met with the Salem Fire Dept. for their assistance with a business of this type. 4. The petitioner met with and attempted to satisfy all concerns of neighbors, abutters and others. 5. This type of business is a type that generates very few on site sales, most are done at residences. 6. The property, as it now exists, is an eyesore and the new building will add much to the area in keeping with the City's master plan. DECISION ON THE PETITION OF EASTERN PULMONARY SERVICES, INC. (OWNER) FOR VARIANCE AT 85 BRIDGE ST./1 BARTON ST. , SALEM page two On the basis of the above findings of fact, and on the evidence presented, the Board of Appeal concludes as follows: 1 . Special conditions exist which especially affect the subject property out not the district generally. 2. Literal enforcement of the provisions of the Ordinance would work a substantial hardship on the petitioner. 3. The relief requested can be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent of of the district or the purpose of the Ordinance. Therefore, the Zoning Board of Appeal voted unanimously, 5-0, to grant the relief requested, subject to the following conditions: Petitioner comply with all requirements of the Salem Fire Dept. 2. Proper numbering be obtained from the City of Salem Board of Assessors. 3. All construction be done as per the plans submitted and as per all existing City and State Building Codes. . 4. All dimensions be as per the plans submitted. 5. Parking to be provided and maintained as shown on the plans. 6. That safety precautions during construction be undertaken to take into account the residential nature of the neighborhood. 7. Truck deliveries be made between 9:00 a.m. and 2:00 p.m. . 8. A six (6) foot high fence be built along the North side of the property and be maintained by petition, heirs and/or assigns. 9 Hours of operation, except for emergencies, shall be 7:30 a.m. to 7:00 p.m. , Monday to Friday. No regular business hours shall be on Saturday, Sunday or Holidays, except for emergencies. 10. Allstorage of product shall comply with all applicable city and state codes. 11 . The material was tested in accordance with the American Society for Testing and Materials Standard Test Method E 648-86, "Critical Radiant Flux of Floor-Covering Systems using a Radiant Heat Energy Source." This teat, also known as the Flooring Radiant Panel, is identical to the Federal Test Method Standard Number 372 and the National Fire Protection Association Test Method Number 253. It measures the critical radiant flux at flame-out of horizontally mounted complete flooring systems exposed to a flaming ignition source in a graded radiant heat energy environment intended to simulate the actual conditions that have been observed and defined in full-scale experiments. The test to applicable only to floor covering systems which duplicate or simulate accepted installation practices. Tests on individual components of a system are of limited value and are not valid for evaluation of the entire flooring system. This standard should be used to measure and describe the properties of materials, products, or assemblies in response to heat and flame under controlled laboratory conditions. It should not be used to describe or appraise the fire hazard or fire risk of materials, products, or assemblies under actual fire condition. However, results of this test may be used as elements of a firs risk assessment which takes into account all of the factors which are pertinent to an assessment of the fire hazard of a particular and use. The teat results apply only to the specimens tasted and are not necessarily indicative of apparent identical or similar materials. All test data are on file and are available for review by authorized persons. Il. PURPOSE The Flooring Radiant Panel test measures the level of incident radiant heat energy on the floor covering system and is expressed as Critical Radiant Flux in watts per square centimeter. It provides a basis for estimating one aspect of flamespread behavior for floor covering systems installed in corridors or exitways of buildings. The Imposed radiant flux simulates thermal radiation levels likely to impinge on the floor of a corridor whose upper surfaces are heated by flames and/'or hot gases from a fully developed fire in an adjacent room or compartment. III. TEST PROCEDURE A minimum of three (3) sets of the floor covering system must be tested. A specimen measuring 20 centimeters by 100 centimeters is mounted in a horizontal specimen holder in the test chamber. The radiant panel generates an energy flux distribution ranging along the the 100 centimeter length of the test specimen of approximately 1.0 watts per square centimeter to a minimum of 0.1 watts per square centimeter. The test is initiated by an open flame from a pilot burner that is brought into contact with the specimen for 10 minutes. The specimen is allowed to burn until it self-extinguishes, at which time it is removed from the tact chamber and the point of farthest flame front advance measured. The Critical Radiant Flux is then computed from the Flux Profile Curve determined during the calibration of the toot apparatus. IV. Hacker, Piemonte and Feeherry. Notice of the hearing was sent to abutters and others and notices of the hearing were properly published in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A. The Petitioner has requested a Special Permit to expand a non-conforming structure and modify a non-conforming residential use by the construction of a 10' x 16' bedroom in the rear of the existing structure and an 8' x 14' rear exit and storage area. The building at 85 Bridge Street is in a B-1 district but it is a non-conforming use as it include; four residential units and a Laundromat. The Special Permit which has been requested may therefore be granted upon a finding by the Board of Appeal, that the grant of the Special Permit will promote the public health, safety, convenience and welfare. The Board of Appeal, after considering the evidence presented at the hearing, and after viewing the property, makes the following findings of fact: (1) The proposed additions to the property will have virtually no impact on the area. No additional residential units will be created, no existing residential units will be enlarged, and no off-street parking will be lost. (2) The Petitioner's request was unopposed by any abutters. On the basis of the above findings of fact and on the evidence presented at the public hearing, the Board of Appeal concluded unanimously that the proposed use will promote the public health, safety, convenience, and welfare and that the proposed use is in harmony with the Zoning Ordinance. Accordingly, the Board voted unanimously in favor of granting a Special Permit to the Petitioner. The Special Permit is therefore granted in accordance with the following terms and conditions: (1) The Petitioner may construct a 10' x 16' bedroom and a 8' x 14' rear entrance to the property in accordance with the plan submitted to the Board.
