On 4/27/89 original report, you were notified that the front main entry door to this apartment was nailed shut from both inside apartment and bolted from hallway as well. A crawl space was under stairway to third floor from which you could see that the main means of egress was bolted. You were told it was not a legal means of egress and were to contact Building Inspector immediately. Fortunately, your tenants were vacating at the time. On 4/27/90 , you were also advised that a Certificate of Fitness inspection was conducted of this apartment prior to another tenant and AFTER all permits issued and matter of door resolved. On 5/22/89, a reinspection was conducted of common areas and there were still outstanding violations. To the best of our knowledge, the apartment appeared vacant. On 7/21/89 , another reinspection was conducted of the common areas with outstanding violations. On 8/16/89 ,a reinspection was conducted of common areas by Sharon Cameron and violations still remained. Meantime.; court hearings were secheduled for 9/28/89 , at which time you were advised that all permits be obtained and variances were required, facts of which you had been made aware of by the Building Inspectors . Hearing was held on 10/30/89 at which time you did -not appear. On 12/6/89 , Mr. Grant rescheduled to 12/20/89 at which time you did not appear. Matter referred upstairs District Court on 2/7/90 and you did not appear for first call so a warrant was issued. Later on 2/7/90; you went to District Court to have the warrant removed and the matter was set up for 2/14/90 . On 2/1/90 , a reinspection wasconducted of common areas and it was noted there was a tenant in apartment 02 . You later stated that she moved in because her apartment across the way was being renovated and it happened before you could stop her . (See report dated 2/1/90 notifying you that you had been made aware that you could not place a new tenant in that apartment until everything had been resolved.from 4/27/891Egressstill bolted and nailed shut) . On 2/14/90 , you told the District Attorney 's assistant that you had workmen on the premises and that you had spent $5000 . 00 for the work. Inspector Dave Harris and requested that he go on site as soon as possible to speak with your workmen and check the work .being performed. Mr. Harris told me no permits had been taken to do this work nor any variances granted. Mr. Harris told me he then went on site and there were no workmen there nor any work being performed. You stated to the District Attorney that work was in progress as we spoke and that you had incurred considerable costs. On 2/21/90 , a reinspection was conducted of Mrs. Diaz Figueroa' s apartment and common areas. Outstanding violations are listed on the first page of this report. You and Mr. Harris and two workmen were on site at this time and Mr. Harris advised that there had been no permits taken, the apartment was illegal and issued a 'Stop Work' order. We noted at the time that a new door had been constructed and there were some steps leading inside the .apartment in the living room. Also noted was a new stairwell leading to the third floor, all constructed illegally. We also spoke about the 2/23/90 re-appearance at Salem District Court and you questioned why you should make an appearance. This date was set by the District Attorney' s office. Another abutter expressed concern about trash disposal , but did not oppose the petition. 5. Three off-street parking spaces are provided. 6. Off-street parking is limited in the area. On the basis of the above findings of fact, and on the evidence presented, the Board of Appeal concludes as follows: 1 . Special conditions do not exist which especially affect the subject property but not the district in general . 2. Literal enforcement of the provisions of the Ordinance would not involve substantial hardship to the petitioner. 3.
