Concerning to us is the event being held on the 31". The website states that a mass is being held and advertises 132 people plan to attend. The issue is when the Satanic Temple came in to this office, they identified themselves as an art gallery(A-3)(which would normally be classified as an Assembly three use group) and that the total capacity would be less than 50 occupants which under the Mass State Building Code 780 CMR section 303 (2) allows the use group to be downgraded to a Business use group.. This allowance (which you utilized)restricts your occupancy to 50 occupants. To allow for an increase in capacity, a code review would need to be done, submitted. to and approved by this office prior to an increase in any capacity. Therefore any event held in excess of 50 people will be a violation of the Mass State Building Code . At the public hearing,no members of the public spoke in favor or in opposition to the proposal.
