reason(s):
A report has been made to this office that there has been unpermitted construction work
completed in the in the above referenced property and access to the utilities on the property have
been made inaccessible from portions of the building by said work
Under the provisions of 780 CMR, Section 115.6,the State Building Code, access to this property
must be granted for the purposes of this inspection. Please call this office upon receipt of this letter
to schedule this required inspection.
If this property has rental units, these tenants must be notified in advance of this inspection, so that
access to these spaces may also be accomplished.
This inspection must be completed on or before March 14,2012; failure to respond to this
notification will be construed as non- compliance, and as such an Administrative Search Warrant
will be sought, so as to allow the lawful inspection of this property.

Gentlemen:
Pursuant to your request and the request of Mr. Chester. Szczawinski,
owner of the above subject property, the undersigned made a visual in-
spection of the above subject structure for structural ,adequacy and
" compliance with public safety and welfare and conformance with the
Uniform Building Code - Article #7 with respect to the original con-
struction and such. new construction and renovations which were neces-
siGated by damages sustained by the facility in a recent past fire.
The .csrpenter/contractor, Mr. Charles Brewster, of Lynn, Mass. accom-
panied this writer on the facility inspection and the following recd-
mmendations ,and/or corrections were brought to his -attention during the . ,
survey and are herein listed for your advice and information.
A) First Floor Area
1. All wood columns, pott3r-and braces which support upper framing
and/or are used for architectural effect should be adequately ,
pegged, nailed or lagged with clip angles to cause positive
securement and preclude any future shifting and misalignment .
2. The second floor framing is supported by wood beams #which are
trussed with (2) 3/4" diam, steel tension bars. '' The center beam
about mid depth of building and spanning North to South has a
misaligned tension plate at midspan at the bottom of the beam.
The plate should be realigned and the truss bar centered in the
respective groove provided for same.
3. Second floor joists above the bar and lounge area are 2 x 10
r wood, some of which are new and others were original construc-
tion, Floor joists do not appear to have any bridging between
between spans and bridging should be added not in excess of
8'-0" from joist supports.
Some old floor joists are fire charred and should be sprayed with
lime whitewash or other coating to preclude the possibility of
objectionable fire odor.

One or two joists have been previously cut through: extensively to
allow roof rain leader piping enough so as to make their struc-
tural integrity questionable and such joists should be doubled or
replaced: F
4. Roof drain and rain leader piping should be replaced and repaired

in accordance with code..
S. The (1) one story section of .building has its roof framed with.
2 x 8's approximately 12" o.c. Due to the heavy snow loads which
can develop on this flat roof, `it is recommended that the joist
trimmer or ribbon.which is. side nailed to wood studs of 2nd story-
receive supplimentary support by way of cripple studs (2 x 4)
extending from under trimmer to top of steel beam below. : Cripple
studs should be placed under every 3rd joist. -
These low roof joists are also installed without bridging and if
solid bridging cannot be added without difficulty, a continuous
1 x 3 strap should be nailed to bottom of joists at mid span for
lateral support.
Towards .the front�of' the building the roof joists frame .the opposite
} wiry and the joist or joists acting as a trimmer joist should be
doubled and be continuous-to the above mentioned steel beam and
stud wall support.
6. The most rear wood antique column (approx. 8" x 8") is acting as
a structural support, however, the top of the column under the
wood beam isnot cut square or uniform to provide equal bearing.
The wood column should be cut for uniform bearing and shimmed up ,
as required.
B) Basement Area
1. At the rear basement area (approximately under toilet areas)
a wood sill beam resting on masonry wall is extensively rotted
at a point where a wood floor beam frames into this rotted
section. A new supplimental pipe column should be added next
I; to masonry wall to provide new support for wood floor beam.

a crawl space." The wood floor framing over this crawl space
is supported by masonry piers which need some attention as to
alignment, centering and being plumbed for adequate support,
NOTE: It would also be 'advisable to provide some ventilation
and air movement within this crawl space if none exists.
C) Second (2nd) Floor Area
1. The second floor area had not yet been renovated at the time
of writers visit. There was considerable charring from fire
damage and should be corrected as previously noted in this
report. Otherwise; framing and structure seemed sound,
2. Old vent piping connections to chimney flues should be removed .
and properly sealed,
3, hoof drain and pipe leader should be made tight in accordance
with code and. accepted practice.
4. The south side stud wadi (exterior) is ballon framed to steel
beam,below and should be fire-stopped adequately at the floor '
level.
5. . Excess dividing partitions and cumbersome or redundant dropped
ceilings should be demolished and a light weight suspended
ceiling .provided in accordance with Owner's needs.
D) EXTERIOR
1. The vertical siding joint halfway up the rear exterior wall is
sprung open and as such is vulnerable to leaking which could
cause considerable damage and should be corrected.

On 10/8/99 you filed a complaint with this office regarding the above premises. After
reviewing all the information submitted, the Board must dismiss your complaint for the following
reason:
Work that was performed on 61 Bridge Street did not exceed 30% of the assessed
value of the building, triggering the requirement that all public entrances shall be
accessible. In addition the building inspector for the city of Salem, Mr. Thomas St.
Pierre has confirmed that no work was performed on the step at the street side
entrance.
(Complaint # 99 - 180)
Any person aggrieved by the above decision may request an adjudicatory hearing before the
Board within 30 days of receipt of this decision by filing the attached request for adjudicatory
hearing form. If after 30 days, a request for an adjudicatory hearing is not received, the above
decision becomes a final order and the appeal process is through Superior Court.

Dear Mr. Daignault
Regarding your concerns about 61 Bridge Street and the 521 CMR compliance issues.
The architect, Richard Griffin , has indicated that he felt his plan complied with the intent
of 521 CMR.
This project did not trigger the 30 % figure, but they did make handicap accommodations
both in a rami at the rear of the building and in both sets of bathrooms.
My approval of the project was based on these factors. The plans for this project are
available in this office.

Lynn Bridge Street, Salem, I informed you of 521 CMR compliance concerns.
Lynnfield I am now writing to make you aware of 521 CMR Sections 3.3.1 & 3.3.1a as the
Manchester full and fair cash value was not 30% or more at 61 Bridge Street in Salem.

Rockport At 61 Bridge Street in Salem, the front entrance was renovated. In my opinion,
the owner should apply for a variance to the front entrance. In the variance
Rowley application, the owner must explain why a ramp is not feasible to construct at
Salem the front entrance.

3.3.3 Alterations by a tenant do not trigger the requirements of 521 CMA 33.16 and 33.2 for other tenants.
However,alterations, reconstruction, remodeling,repairs, construction, and changes in use falling
within 521 CMR 33.16 and 33.2,will trigger compliance with 521 CMR in areas of public use,for
the owner of the building.
3.3.4 No alteration shall be undertaken which decreases or has the effect of decreasing accessibility or
usability of a building or facility below the requirements for new construction.
3.3.5 If alterations of single elements,when considered together,amount to an alteration of a room or space
in a building orfacility,that space shall be made accessible.
33.3.6 No alteration of an existing element,space,or area of a building or facility shall impose a requirement
for greater accessibility than that which would be required for new construction.
3.4 CHANGE IN USE
When the use of a building changes from a private use to one that is open to and used by the public,
an accessible entrance must be provided,even if no work is being perforated. When a portion of a
building changes use from a private use to one that is open to an used by the public,then an accessible
route must be provided from an accessible entrance even if no work is being performed
3.4.1 RESERVED FOR FUTURE ACTION: Changes in use,from private to public,in private residential
homes where no work is being performed.
3.5 WORK PERFORMED OVER TIME
When the work performed on a building is divided into separate phases or projects or is under separate
building permits, the total cost of such work in any 36 mouth period shall be added together in
applying 521 CMR 33,Existing Buildings,
3.6 MULTIPLE USES
When a building is occupied by two or more uses,the Regulations which apply to each use shall apply
to such parts of the building within that use.
3.6.1 521 CMR 33,Existing Buildings shall apply based upon each use and not on the entire building.
Example: If a three story building valued at$300,000 has one floor of retail use and two floors of
residential use,the full and fair cash value of the retail portion shall be 1/3 of the total value which
would be$100,000.
3.7 PARTIAL APPLICATION
When only a portion of a building is subject to 521 CMR,the full and fair cash value shall be prorated
by the ratio of the square footage of that portion to the square footage of the whole building.
Example:Where the whole building is 100,000 square feet,the full and fair cash value is$1,000,000,
and the pact subject to 521 CMR is 10,000 square feet{one-tenth of the total},then the fill and fair
cash value of the part subject to 521 CMR would be one-tenth of$1,000,000 or$100,000.
3.7.1 If the Board determines that such proration would cause an inequitable result, the Board may
otherwise calculate thefull and fair cash value of the portion of the building. .

3.1 SCOPE
All work performed on public buildings or facilities (see definition), including construction,
reconstruction, alterations,remodeling, additions,and changes of use shall conform to 521 CMR..
3.1.1 To determine the scope of compliance,refer to 521 CMR 32,New Construction and 521 CMR 3.3,
Existing Buildings. In the absence of jurisdiction by 521 CMR,780 CMR: the State Building Code
may apply.
3.2 NEW CONSTRUCTION
All new construction of public buildings shall comply fully with 521 CMR-
3.3
MR3.3 EXISTING BUILDINGS
All additions to,reconstruction, remodeling,and alterations or repairs of existing public buildings
or facilities,which require a building permit or which are so defined by a state or local inspector,shall
be governed by all applicable subsections in 521 CMR 3,JURISDICTION.
For specific applicability of 521 CMR to existing multiple dwellings undergoing renovations,see
521 CMR 9.2.1.
3.3.1 If the work being performed amounts to less than 30%of the full and fair cash value of the building
and
a. if the work costs less than$100,000,then only the work being performed is required to comply
with 521 CMR
or
b. if the work costs$100,000 or more,then the work being performed is required to comply with
521 CMR In addition,an accessible public entrance and an accessible toilet room,telephone,
drinking fountain (if toilets, telephones and drinking fountains are provided) shall also be
provided in compliance with 521 CMR
Exceptions: Whether performed alone or in combination with each other,the following types
of alterations are not subject to 521 CMR 33.1.(When performing exempted work,a memo
stating the exempted work and its costs must be filed with the permit application or a separate
building permit must be obtained.)
General maintenance and on-going upkeep of existing,underground transit facilities will
not trigger the requirement for an accessible entrance and toilet unless the cost of the work
exceeds$500,000 or unless work is being performed on the entrance or toilet.
3.3.2 If the work performed amounts to 30%or more of the full and fair cash value of the building the entire
building is required to comply with 521 CMR-
a.
MRa. Where the cost of constructing an addition to a building amounts to 30%or more of the full and
fair cash value of the existing building,both the addition and the existing building must be fully
accessible.
a. Curb Cuts: The construction of curb cuts shall comply with 521 CMR 21.
b. Alteration work which is limited solely to electrical mechanical,or plumbing systems;to
abatement of hazardous materials;to retrofit of automatic sprinklers and does not involve
the alteration of any elements or spaces required to be accessible under 521 CMR Where
electrical outlets and controls are altered,they must comply with 521 CMR.
c. Roof repair or replacement,window repair or replacement,repointing and masonry repair
work.

complaint against Michael Hill, owner of the property at 61 Bridge Street in Salem for
Lynn violating 521 CMR Section 25.1 & 25.2 - entrances. Enclosed is a photograph of the
Lynnfield front entrance of 61 Bridge Street, Salem (enclosure 1). Both doors enter into one
room. The front entrance has been renovated with the new doors. No ramp has been
Manchester constructed and therefore it remains non-accessible.

The owners permit was for renovation of the existing business use group only. In order

required by the State Building Code and possibly the Board of Appeals due to the number
of parking spaces required.

I am responding to your letter of October 12, 1999, regarding 61 Bridge
Street, Salem. This letter is to address the reported violation of Section 25.1 of
CMR 521, that the front entrance was renovated and is not accessible.
As the attached letter from the City of Salem Building Department states,
both my-architect.and>the City of Salem Building Department agreed the project
complied with the intent of 521 CMR. The front entrance directly abuts the City
of:Salem's''sidewalkand"the'fif§t'fldo"r'is`15"`above'the:sidewalk' Massive"
structural renovations would have been required to accommodate a ramp to
reach the first floor level. The cost of building this ramp would have been as
much•as the cost of the rest of the renovations.
I have installed a handicap ramp at the rear of the building and two
handicap bathrooms. Per Section 25.6 of 521 CMR I am installing a sign
indicating the location of the new exterior accessible ramp constructed at the
rear entrances.
I hope you will find my efforts are sufficient to meet the intent of 521 CMR.

To Whom It May Concern
This letter is in regards to the installation of a fire suppression system
at 61 Bridge St. Under the Building Code any new building with more than
two units an automatic fire suppression must be installed. However under
the Existing Building Code any level 2 or 3 renovation also requires
the installation of an automatic fire suppression system needs to be installed
in any building that has more than two units. Due to the fact that you have exceeded
a level 2 renovation and an automatic fire suppression system is required to be
installed. If you don't agree with my opinion than you should consult
a design professional for a full code review.

Dear Mr. Polansky
. I am rejecting your Building permit application because there were no sprinkler
plans submitted with the building plans. Being a mixed use building a fire suppression
system must be installed. Due to the amount of work being done on the property
including the reframing of the roof you have triggered a level two Alteration
according to the International Existing Building Code section 504. This level of
Alteration requires the building to have a fire suppression system installed.
If you feel aggrieved by my interpretation of the code you can appeal my
