This problem, which is an ongoing problem for more than. four years, has been recently getting worse. We were told to put in. writing our complaint and send it in to your office. Here are the problem's which , would deal with your office: i i 1 . They have boats piled up over 20 feet high right up against our fence. i 2. They put broken trailers or wood peices right up to ,the fenced part of our yard. Which. has also damaged our fence very badly. 3. They also have killed many of our shrubbery which bas been there for almost 20 years until they came and put boats up to the fence and run. the motors in which. the oil and water runs into our yard. (I realize that last part has nothing to do with. your dept. , but the boats that are doing the damage are. ) I would also like to state that we went to court with. James Irving the owner in 1987. At that meeting be was told tolkeep the running of motors to a complete stop. And to keep the boats away from our fence by at least 12 ft. JameslIrving also stated himself at this meeting that he wouldibe moving to another location as of Februrary 1988. He does have another location now, and he is doing more and more 'here at the property on Bridge St. He is not moving at all. And this upsets us very much that the system in Salem is failing us residents so badly. When we moved here some 20 years ago Wayside Furniture was here and we never had a problem with. them at all. Brake and Clutch has been here to and we never hadl them either. Now here is Jimmy's and all goes down hill. Load- ing, unloading or other handling of boxes, crates, con- tainers or building materials or similar objects and the engaging in manufacturing activities between the hours of 11:00 p.m. and 7:00 a.m. the following day in such a manner as to cause a noise disturbance across a residential real property boundary. (5) Construction and blasting. Operating or permitting the operation of any tools or equipment used in construction or demolition work between the hours of 5:00 p.m. and 8:00 a.m. the following day on weekdays or at any time on Sundays or holidays (such that the sound therefrom cre- ates a noise disturbance across a residential real property boundary) or the operation of drilling and/or blasting equip- ment used in construction,reconstruction,repair,or demo- lition work between the hours of 5:00 p.m. and 8:00 a.m. the following day on weekdays or at any time on Satur- days, Sundays, or holidays, except for emergency work of public service utilities,or by special variance issued by the building inspector pursuant to the Salem Code of Ordinan- ces, and notification of same.to the police department-_ (6) Vehicle or motorboat repairs a?ul testing. Repairing, rebuilding, modifying or testing any -motor vehicle, motorcygle_o motorboat in such a manner as to cause a noise disturbance across a residential real property boundary. (7) Explosives, firearms and similar devices. The use or firing of explosives, firearms or similar devices which create impulsive sound so as to cause a noise-distur- bance across a real property boundary or on a public space or right-or-way, without first obtaining a special variance issued pursuant to the Salem Code of Ordi- nances. (Such permit need not be obtained for licensed game-hunting activities on property where such activi- ties are authorized.) (8) Vibration. Operating or permitting the operation of any device that creates vibration which is above the Supp.No.14 1151 i § 16%-2 SALEM CODE § 16V.-3 % vibration perception threshold of an individual at or beyond the property aoundary of the source if on pri- vate property or at one hundred (100) feet from the f source if on a public space or public right-of-way. For the purposes of this subsection, "vibration perception threshhold" means the minimum ground or structure borne vibrational motion necessary to cause a normal person to be aware of the vibration by such direct means, as, but not limited to, sensation by touch or �. visual observation of moving objects. (9) Horns, signaling devices, etc. The sounding of horn or signaling device on any automobile, motorcycle, street- car or other vehicle on any street or public place of the city, except as a danger warning; the creation by means of any such signaling device of any unreasonably loud or harsh sound; and the sounding of any such device for an unnecessary and unreasonable period of time.The use of any signaling device except one operated by hand or electricity; the use of any horn, whistle or other device operated by engine exhaust; and the use 1 of any such 'signaling device when traffic is for any — reason held up. (a) Any person who violates any provision of this chapter shall be fined for each offense not more than twenty-five dollars ($25.00). . Blenkhorn, C.H.O. representing the Health Department. Mr. Blenkhorn read a letter sent to Jimmy's Marine on July 16, 1987 regarding noise and wash water running on Mrs . Fraczek's property from motors run at Jimmy's Marine. Mr. Blenkhorn stated Building Inspector was sent a copy of letter to help with this problem. As of this date no reply from Building Inspector. Aslo read letter from Mrs. Fraczek concerning this problem. Mr. Blenkhorn read a letter from Councillor Kevin Harvey with regard to this problem. Jay Irving asked where they wanted him to run motors so that wash water will not run onto Fraczek property? They suggested inside of building with vent in roof and drain on floor. Mr. Blenkhorn asked at this time where the letter they requested for method of running and testing of motors inside was. Jay said he would have to check on it . Mrs . Ewart stated they run motors when children are in yard, she also stated it would be better to run motors inside of building. Mrs . Fraczek stated children are afraid of noise from motor and they come in the house. Mr. Fraczek wanted to know why before they moved into area they did not have a hearing before giving them a permit? Mr. Blenkhorn stated that was a question for the Building Inspector. Mr. Fraczek said they have mediation Bearings and Mr. Irving does not comply. Mr. Blenkhorn suggested they check with other businesses to see what they do about running motors etc. Mr. Blenkhorn gave Jay Irving copies of letters he read concerning this on- going problem. That being the location of Jimmy' s Marina on Bridge Street. While Bridge Street is zoned for business, there should be made a provision for the residents that own homes in the area. Since Jimmy' s Marina has moved to Bridge Street the nieghborhood has been in constant termoil. The property line of Jimmy' s Marina does not, to my knowledge, extent to the curb stone, as Jimmy' s Marina apparently thinks. Boats and trailers are continually left on the sidewalk.
