MATOS FOR A VARIANCE � 7rp ' FOR THE PROPERTY LOCATED AT 51 BRIDGE STREET (B-1) A hearing on this petition was held May 17, 1995 with the following Board members present: Stephen Touchette, Chairman; Gary Barrett, Albert Hill, Nina Cohen and Arthur LaBrecque. Notice of the hearing was sent to abutters and others and notices of the hearing were properly published in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A. Petitioner is requesting a Variance from parking for the property located at 51 Bridge Street. This property is located in a B-1 district. The Variance which has been requested may be granted upon a finding of this Board that: 1. Special conditions and circumstances exist which especially affect the land, building or structure involved and which are not generally affecting other land, buildings, or structures in the same district. 2. Literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise, to the petitioner. 3. Desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogation from the intent of the district or the purpose of the Ordinance. The Board of Appeal, after careful considerations the evidence presented at the hearing, makes the following findings of fact: 1. Petitioner has operated a hair salon since 1990 and is presently located at 70 Washington Street. 2. Petitioner's hours of operation are from 9:OOa.m. to 4:00 p.m. on Monday, Tuesday,Thursday and Saturday. 3. The building on the subject property is in a state of disrepair and dilapidated and has been vacant for some time. 4. The petitioner has no employees. 5. The property lacks the necessary off-street parking required by the Zoning Ordinance. 6. The lack of parking reduces the property useless as a commercial property. 7. There was no opposition to the petition. On the basis of the above findings of fact, and on the evidence presented at the hearings, the Board of Appeal concludes as follows: 1. Special conditions exist which especially affect the subject property and not the district in general. DECISION OF THE PETITION OF JOSE P. Therefore, the Zoning Board of Appeal voted unanimously, 5-0, ho grant the requested relief, subject to the following conditions : 1. Petitioner shall comply with all city and state statutes, ordinances, codes and regulations . 2. All requirements of the Salem Fire Department relative to smoke and fire safety shall be strictly adhered to. 3. Petitioner shall obtain a Building Permit prior to beginning any construction. L. This occupancy consisting of a commercial space on the first floor and two residential occupancies on the second floor, with open space and storage space in the basement area; requires a complete A. C. hardwired fire alarm system. This will consist of A. C. hardwired smoke detectors, Multiple station (interconnedted type) in the basement, in the commercial spaces, and in the stairways of the residential units. Single Station type smoke detectors shall be required within each apartment unit, protecting each separate sleeping area, and located as directed by this office. Because of the commercial occupancy, the A. C. hardwired units are required. You are hereby ordered to arrange with this office for the permit to install the required fire alarm devices, and the occupancy of the residential portion of this building shall not be permitted until the Certificate of Compliance has been issued , upon completion of the fire alarm system installation and an inspection has been conducted. This order shall be complied with within thirty (30) days. Atty. John Laskaris represented the petitioner before the Board. The business located at the property in question is a wholesale coffee business, Gold Star,and the petitioner has outgrown the building. No roasting is done on the premises. Atty. Laskaris stated that there is a hardship as Mr. Georgilakis simply does not have the necessary 25 feet for a rear yard and he has to enlarge the building. The addition is needed to house trucks and to afford greater storage space. The addition will be cement block and painted. There is no opposition to the petition. I The Board voted to grant the petition requested. The Board found that the reduction of the rear yard from 25 feet to 4k feet would not be detrimental to the surrounding neighborhood. The neighborhood is primarily industrial and business and most of the buildings in the area are non-conforming as to density requirements, The Board found that it could grant the petition as requested without detriment to the surrounding neighborhood and without derogating from the intent of the Salem Zoning Ordinance. The Board found to deny the petition would cause financial hardship to the petitioner and to his business.
