The major alteration, the change of the enclosed rear stairs to a rear deck with stairs was a change made during construction. The Salem building department agreed with the architect that an exterior stair that met the One and Two Family Residential Stair Dimensions was sufficient to provide an adequate second means of egress for the building. I have found that the rear stair is in compliance with the One and Two Family Section of the Eighth Edition of the Massachusetts f Building Code CMR 780, comprising the 2009 International Residential Code plus State of Massachusetts Amendments. This allows for an R2 building that is fully sprinklered per NFPA 13 to have four units and three floors above grade. It specifies a 50' maximum travel distance. I understand this to be the distance to the enclosed means of egress stairway that the building satisfies; otherwise the allowance for three floors would not make sense. The other ambiguous question in the building code is the requirement for rescue openings. Section 1018.2 asks for rescue openings in compliance with Section 1025 that exempts the requirement for rescue openings in buildings that are fully sprinklered. The openings that are available meet the 24"widex20" high dimensional requirement, but are less than the required 5.7 square feet of opening required for R2 dwellings. Also, it is also noted that any apartment building over 4 units required emergency lighting, which this building currently has. In addition, the following violations are being corrected: 1 . Additonal rails for front and rear stairways will be installed. 2 . Smoke detectors and emergency lighting have been repaired. 3 . All bathrooms are vented. 4 . An electrician has been contacted to install adequate light 5 , switches and Mass. Electric will be contacted to re-install the three additonal light meters, plus a house meter . 6 . I have been applying for a Certificate of Fitness when a unit is ready for a new tenant ; the current tenant began her tenancy before Certificates were required. I hope the discrepancy between my records quid your, office in the matter of a 6 unit building .can be resolved; the bank never would have given me a mortgage for the amount requested for anything other than a 6-unit building. Also, an inspection of the property was conducted on August 3, 1993 and the following violations were noted and must be corrected: 1. Rails must be installed on both sides of the front & rear stairs. 2. Emergency lighting and smoke detectors must be repaired immediately. 3. Proper vents are to be installed in the bathrooms. 4. The lights in the main halls must be on house meter and there should be adequate switches. 5. Each apartment must have it's own electric meter and one house meter. 6. A Certificate of Fitness must be obtained prior to renting of units.
