A public hearing on the above Petition was opened on November 18, 2015 pursuant to M.G.L Ch. 40A, § 11 and closed on that date with the following Salem Board of Appeals members present: Rebecca Curran, Peter A. Copelas,Mike Duffy,Tom Watkins,Jimmy Tsitsinos. The Petitioner seeking a Variance requesting relief from Sec. 5.1.5 Parking Design of the Salem Zoning Ordinance to allow at 30' curb cut and to modify a previous Zoning Board of Appeal decision to reflect the new parking plan. Statements of fact: 1. Joseph Skomurski, the petitioner,presented the petition. 2. In the petition date-stamped October 27, 2015, the Petitioner requested Variances requesting relief from Sec. 5.1.5 Parking Design of the Salem Zoning Ordinance to allow at 30' curb cut and to modify a previous Zoning Board of Appeal decision to reflect the new parking pian. 3. The petitioner presented a new parking plan dated July 28,2015 revised on August 16,2015 to realign three (3) parking spaces from the rear yard to the side yard to allow the addition of greenspace and prevent paving the entire rear yard as previously approved on "Lot 5." 4. The requested relief,if granted,would allow the Petitioner to exceed the 24'maximum allowable curb cut to have a 30' curb cut along Planters Street at "Lot 5" and to modify a previous Zoning Board of Appeal decision to reflect the new parking plan dated July 28,2015,revised on August 16,2015. 5. At the public hearing no members of the public spoke in favor of, or in opposition to, the petition. The Salem Board of Appeals, after careful consideration of the evidence presented at the public hearing, and after thorough review of the petition, including the application narrative and plans, and the Petitioner's presentation and public testimony, makes the following findings that the proposed project meets the provisions of the City of Salem Zoning Ordinance: Findings for Variances for the original variance for the project: 1. Special conditions and circumstances that especially affect the land, building, or structure involved generally not affecting other lands, buildings and structures in the same district is that the existing lot is an odd shape narrow lot. _ Vity of Salem Board of Appeals December 2,2015 Project:43 Bridge Street Page 2 of 2 2. Literal enforcement of the provisions of the Ordinance would create a substantial and unique hardship as the lot is narrow and would restrict the petitioner from using the parcel.Literal enforcement of the bylaw would result in a building envelope that is too narrow to construct a house. 3. The desired relief may be granted without nullifying or substantially derogating from the intent ofthe district or purpose of the City of Salem Zoning Ordinance. The existing building on the property is blighted, and the proposed new construction would be in keeping with the general density of the neighborhood. The Board now finds that the request for the Variance for a larger curb cut is a minor modification to the original plan and the reconfiguration of the parking spaces to provide greenspace to the rear of the property is positive. On the basis of the above statements of facts and findings, the Salem Board of Appeals voted five (5)in favor (Rebecca Curran, Peter A. Copelas, Tom Watkins,Mike Duffy,Jimmy Tsitsinos) and none (0) opposed, to grant a Variance requesting relief from Sec. 5.1.5 Parking Design of the Salem Zoning Ordinance to allow at 30'curb cut and to modify a previous Zoning Board of Appeal decision to reflect the new parking plan safeguards: at "Lot 5" shown on the plan dated August 16, 2015, subject to the following terms, conditions and Standard Conditions: 1. The Petitioner shall comply with all city and state statutes, ordinances, codes and regulations. 2. All construction shall be done as per the plans and dimensions submitted to and approved by the Building Commissioner 3. All requirements of the Salem Fire Department relative to smoke and fire safety shall be strictly adhered to. 4. Petitioner shall obtain a building permit prior to beginning any construction. 5. A Certificate of Occupancy shall be obtained 6. A Certificate of Inspection shall be obtained. 7. Petitioner shall obtain a street numbering from the City of Salem Assessor's Office and shall display said number so as to be visible from the street. 8. Since the ticket was received back in December I have tried multiple times to contact the Building Department to find out what the ticket was in reference to. As you can see by the enclosed copy nothing was checked or referenced as to the violation and I'm not going to pay something that I do not know what it's about. Each time I called I was promised a call back and a month and a half later I have still not received a call. This letter was first reference I received as to what the violation was actually for. Either filling out the violation correctly or return call,that was promised multiple times, could have avoided the delay in payment. A payment will be going out today. A hearing was held on this appeal on July 27, 1970 with all of the Board members present with the exception of Mr. Doyle. The Petitioner - Ida S. Sevinor - was represented by Louis E. Baker, attor- ney, who presented a statement (attached) giving reasons for requesting a Special Permit for granting the petition. In addition to Mr. Baker, the following also appeared in favor: James H. Sands (Employee ) and William Sevinor. In opposition to the granting of this petition were the following: Councillor Joseph O'Keefe, Councillor Michael Ruane, Mrs. Marie Donovan, Planters Street , Mrs. Arthur Campbell, 14 Planters Street, Mrs. Abby Baker, 18 Planters Street, Mrs. Eva Bliss, 12 Planters Street, Joseph Perreault, 21 Planters Street and Mrs. Florence King, 10 Planters Street. Mr. O'Keefe opposed the petition as being an extension of a nonconforming area in an R-2 district, also, violation in using two trailer trucks on the property for permanent storage and the enclosing the area with an eight foot fence. Mr. O'Keefe stated that as the petitioner is now in violation as per above items and is also using the area which the petition for Special Permit is requested, that said petitioner should be ordered to comply with the Zon- ing Code before any consideration is given to any extension and use . Mr. Ruane appeared in opposition and stated he agreed with Mr. O'Keefe ' s objections. The residents of the area , named above , also agreed with Mr. O.!Keefe ' s ob- jection to the petition. J The Board studied the facts presented by the p&titioner and opponents as follows: , The petition for a Special Permit to continue the use of the present open area on Planters Street for storage of plumbing supplies and extending the area to include an adjacent lot. fronting approximately 50 feet on Planters Street and approximately 50 feet back to the line of the . Electric Vight Company' s property, a total of 2500. square feet. The property of the petitioner fronts on Bridge Street and extends south. on Planters Street and with the exception of the 50 foot lot on the south side of the property, the Owners have occupied and ,used the area for ap- proximately 27 years for the sale and storage of plumbing, heating and related sulplies. „� 2 As stated above, a portion of the original property the open storage area) is non-conforming, in accordance with the Zoning Act of 1965• The area of 2500 square feet which is in the R-2 district, was purchased by the petitioner to extend his open storage area . This area because of size is impossible for the building of any structure -to comply with R-2 zoning, and it would be a hardship on the owner to be pro- hibited from using the space of this isolated parcel. After a study of the .facts presented at the hearing, the Appeals Board vo- ted unanimously to approve of the petition for a Special Permit to comply with the following conditions: 1. 'Che area may be 'used for storage of plumbing, heating, and related supplies. 2. No trailer trucks shall be allowed for storage on any of the exist- ing property of the petitioner. 3. In the storage of any material , it shall be agreed that the total height of said material shall not exceed 6 feet from the ground area to the top of the storage supplies. 4. The fencing which maybe chain link type shall not exceed -8 feet in height. 5. The entire storage area shall be kept in a clean and orderly con- dition at all times. The structure is a 3 story combination wood frame and structural steel building. Plan dimensions are 36 ' X 100 ' . The structure shows signs of past overloadings as indicated by the wracking of the building. This movement appears to have ceased and no further significant movement is anticipated. I recommend that this be monitored in another six months , and again one year from this date in order to ascertain this . The second floor support structure is adequate to support a live load of 2oo psf if the storage arrangement presently in use is maintained, ( i .e . storage rooms located off of two aisles ) . A column placed under one of the girders in the past was found to be carrying no load at the present time . It is not required under the present loading conditions and could be removed. Details of the support framing at an old closed over floor opening could not be inspected at this time . The third floor structure is capable of supporting a live load of 125 psf , if the same room arrangement as the second floor is followed. The flooring in the northeast corner must be repaired. Shoring used to support a single cracked joist can be removed and another joist placed along side the single failed one . For many years, this parcel, #263, has been a vacant lot. It is my under- standing that Salem Plumbing Supply recently purchased this lot, paved it and undoubtedly plans to use the lot for storage. From ny cursory examination of the City of Salem Zoning Ordinances, the B-4 District on Bridge Street runs back from the center line of Bridge Street to a line running parallel to Waite Street. If this is, in fact, an extent of the B-4 District, Salem Plumbing Supply has no right to expand their business into an R-2 Residential Two Family District. Attached is a copy of a map of the area with zoning lines as I see them and the lot in question marked in red. CITY ENGINEER October 25, 2011 Water, Sewer and Drainage Requirements Regarding the Demolition of Structures within the City of Salem In accordance with the provisions of the General Laws of the Commonwealth of Massachusetts and the Salem Water and Sewer Department, the following regulations governing the demolition of structures within the City of Salem shall be followed. This regulation is made in the interest of protecting the city's water, sewer, drainage and public way infrastructure at each connection located within the City of Salem, as well as to prevent conditions which may cause danger to public safety, result in water loss, or damage to city or private property due to water or sewer loss or back-ups, or cause pollution of the city's storm water receiving waters. 1. Prior to demolition of structure, a licensed plumber shall ascertain where all water, sewer and drainage lines are located entering and leaving said structure. The plumber shall make a determination of existing or prior use of each line, including, but not limited to domestic, commercial or industrial use; irrigation; fire suppression; sewer, storm drain or septic system; roof drain; or sump pump. After all lines have been located, the plumber shall make a formal written report with plans of all lines found to the City Engineer. 2. Once the plumber's report has been reviewed and approved by the City Engineer; a Registered Professional Civil Engineer (hereinafter referred to as "the Engineer") shall make a determination of the point of origin or discharge on each city main, for each line identified in the plumbers report. The Engineer shall also ascertain the location, use, and point of origin or discharge of any other lines on the property that may or may not be affected by the demolition or connected to the structure. The Engineer shall provide the City Engineer, for review and approval, a stamped plan of the property and adjacent City utilities, indicating the results of his investigations. 3. A request to the Department of Public Services, for assistance in shutting down any water main, prior to cutting and capping it, shall be made only after the City Engineer has approved the written reports and plans described above. Prior to demolition of the structure and immediately following item #3 above, a City of Salem licensed drain layer shall cut and cap the water, sewer and drainage lines at the city main and arrange for an inspection by the Department of Public Services prior to backfill. In the event that the lines will be used immediately after demolition for construction purposes, a set of plans and/or dra.. ngs, stamped by a Registered Professional Fngi^eer, describing the lines to be used during construction, must be provided to the City Engineer for review and approval,prior to obtaining a building demolition permit. Prior to receiving approval to re-use any lines, the lines shall be inspected for condition and capacity. Sewer and drain lines proposed for re-use shall be inspected by a Licensed Drainlayer with closed circuit television equipment and a copy of the resulting DVD shall be submitted to the City Engineer for review.
