Hopper, Feeherry and Hacker and Associate Member Piemonte. Notices of the hearing were sent to abutters and others and a notice of the hearing was published in the Salem Evening News on May 7, 1980 and May 14, 1980 in accordance with Massachusetts General Laws, Chapter 40A. The Petition of Pilgrim Motel, Inc. requests a variance to install sinks, cooking units and refrigerators in eight of the motel rooms at an existing motel at 40 Bridge Street, A variance is required because the proposed changes at the petitioner' s motel would in effect change the property into a multi-unit dwelling. The location in question is in a B-2 zoning district where the multi-family dwellings are prohibited. ' The Board of Appeals, after consideration of the evidence presented at the public hearing and after viewing the property makes the following findings of fact: 1. Under the terms of the Salem Zoning Ordinance, a motel is defined as follows: "Hotel, Motel, or Inn -- a building containing rooms rented or hired out, or designed to be rented or hired out, for sleeping purposes by guests. A general kitchen, dining room, drugstore, or newstand intended primarily for serving the buildings' occupants and only incidentally the public may be be provided within the building or in an accessory building." 2. The petitioner's proposal will, if allowed, change the petitioner's motel into a multi-family dwelling. 3. A multi-family dwelling is inappropriate in any B-2 zoning district. Moreover, such a use is particularly inappropriate in a congested area such as the Bridge Street area. On the basis of the above findings of fact, and other evidence presented at the public hearing, the Board of Appeals concludes as follows: A. The Petitioner failed to establish circumstances relating to the land or structure which affect that property but do not generally affect the zoning district in which the property is located, B. The Petitioner failed to establish that:a literal enforcement :of the provisions of. the Salem Zbning Ordinance as applied to 40 Bridge Street would involve sub staintial hardship to the Petitioner... May 20, 1980 Salem Board of Appeal Res Andrew J. Abdo d/b/a James H. Boulger, Jr. Pilgrim Motel One Salem Green 40 Bridge Street Salem, Mass. 01970 Salem, Mass. Sirt The Salem Fire Prevention Bureau has noted the public hearing notice which appeared in the Salem News, on May 14, 1980= and requests the j following items be made a part of the hearing proceedure to be held on May 21, 1980. 1. The Salem Fire Prevention Bureau, has not been informed of the proposed change in occupancy, to apartment use; other than the public notice. 2. It is the opinion of this office that the change in use group will require the installation of smoke detectors and manual fire alarm devices, throughout the entire structure at the time of change of said use. Said fire alarm system shall be an approved system, with plans submitted to this office for approval. 3. It has been noted that the hazard index has not been increased, but provisions of Chapter 148, Section 26C will be taking effect, shortly, and will pertain to this type of occupancy, notwith- standing provisions of Chapter 22 of the Mass. State Building Code. We are therefor requesting that the Board include in its decision, a provision that an approved fire alarm system be installed in this occupancy. This will serve as notice to the owner that some additional expense will be incurred as a result of the conversion, but also will be required anyhow as a result of the Salem City Council acceptance of Chapter 148, Section 26C of the Mass. Israel Kaplan Health Center off Jefferson Avenue Salem, MA 01970 RE: APPLICATION OF ANDREW J . ABDO d/b/a PILGRIM MOTEL -Dear-Mr—. Blenk1yorn: I have reviewed your recent correspondence concerning the application by the above-captioned to the Board of Health for permission to add a sink and cooking stove to each of twenty-four (24) separate Motel rooms, and this letter is in response thereto. I share your concern that if the owner is allowed to do so, he may in effect be creating a lodging house within the meaning of Mass . G.L . c . 140, §22 and 22A, As would require a licensing procedure by the Salem Licensing Board. My further concern is that such action by Mr. Abdo may violate the provisions of the Salem Zoning Ordinance . The existing motel is located in a B-2 zone, where motels are Per- mitted uses . The zoning ordinance defines a "Hotel, Motel, or Inn as "a building containing rooms rented out . . . for sleeping pur- poses by guests. A general kitchen, dining room . . . may be pro- vided within the building . I. . " Residential uses are specifically prohibited in a B-2 zone by the zoning ordinance (§V, A. 5 (a) ) . Residential uses would include any single-or multiple-family dwelling. The zoning ordinance defines a "dwelling unit" as "a building, or portion thereof, providing com- plete housekeeping and cooking facilities for one family" . A "mulit-family" dwelling is defined as a building . . . occupied by three or more families with separate housekeeping and cooking faci- lities for each. In sum, then, the actions proposed by Mr . Abdo would be a conversion Robert Blenkhorn, Health Agent Board of Health January 23, 1980 Page Two of his motel into a multi-family dwelling within the definitions of the Salem Zoning Ordinance. We are hearing that the recent tree clearing is to make way for a parking area for Brake and Clutch to store vehicles. Parking lots that are not ancillary to the main use of the property are not an allowed use anywhere in the City. If this information is not correct, please let me know. If the information is correct, a parking area,as described, would violate Salem Zoning, Salem Engineering requirements for paving and likely a violation of the City's new Tree Ordinance. If you have any questions, please let me know. Sin7ely, Lv" Thomas St.Pierre
