Petition of HIPPOLITO MADERA requesting a Special Permit from Sec. 3.1.2 of the Salem Zoning
Ordinance to allow a change of a motor vehicle service use to a motor vehicle general and body repair use
at the property located at 35 BRIDGE STREET(Map 36 Lot 235) (B-4 Zoning District).
A public hearing on the above Petition was opened on November 21,2015 pursuant to M.G.L Ch. 40A,§ 11.The
hearing was dosed on that date with the following Salem Board of Appeals members present Rebecca Curran (Chair)
Peter A. Copelas,James Tsitsinos,Tom Watkins,Mike Duffy.
The Petitioner seeks a Special Permit from the provisions of Sec. 3.0 Table of Prineipal and Accessory Use Regulations of the
Salem Zoning Ordinance, to a allow a change of use from a motor vehicle general to a motor vehicle body repair shop.
Statements of fact:
1. In the petition date-stamped October 27, 2015, the Petitioner requested a Special Permit per See. 3.0 Table of
Principal and Accessary Use Regulation of the Salem Zoning Ordinance, to allow a change of use from a motor
vehicle general service garage to a motor vehicle body repair shop.
2. Attorney Grover presented the petition on behalf of the applicant.
3. The property is located in a Wholesale Automotive Zoning District (B-4).
4. The property was used within two(2)years as an auto-repair garage,which has since vacated the building in the
last several months.The property at one time operated a spray paint booth.
5. The petitioner intends to relocate an existing business on Florence Street to this location and install a spray
paint booth.
6. Under the City of Salem Zoning Ordinance, the proposed use of a motor vehicle body repair shop requires a
Special Permit under Section 3.1.2.
7. The petitioner proposes to a spray paint booth for light auto body work and plastic bumper painting.
8. The requested relief, if granted, would allow the petitioner to change the use from a motor vehicle service
garage to a motor vehicle body repair shop.
9. At the public heating,no (0)members of the public spoke in support and no (0) members spoke in opposition
to the petition.
10. The Salem Board of Appeals, after careful consideration of the evidence presented at the public hearing, and
after thorough review of the petition,including the application narrative,makes the following findings:

Findings for Special Permit:
1. Soc'A economic, or community needs served by the proposal to retain an existing business in the City that fits
with the automotive and industrial character of the neighborhood.
2. There are no negative impacts of traffic flow and safety, including parking and loading pertaining to the
proposal.
3. Adequacy of utilities and other public services will not be affected.
4. Impacts on the natural environment,including drainage will not be affected.
5. The proposal will not have negative impacts on the neighborhood character.
6. Potential fiscal impact,including impact on the City tax base and employment may be positive.
(0)On the basis of the above statements of facts and findings, the Salem Board of Appeals voted five(5)in favor and none
opposed, (Rebecca Curran, Peter A. Copelas,James Tsitsmos, Tom Watkins,Mike Duffy) to approve the requested
Special Permit to allow a change of use from a motor vehicle service garage to a motor vehicle body repair shop subject
to the following terms,conditions and safeguards:
Standard:
1. Petitioner shall comply with all city and state statues,ordinances,codes and regulations.
2. All construction shall be done as per the plans and dimensions submitted to and approved by the Building
Commissioner.
3. All requirements of the Salem Fire Department relative to smoke and fire safety,shall be strictly adhered to.
4. Petitioner shall obtain a building permit prior to beginning any construction.
5. Exterior finishes of the new construction shall be in harmony with the existing structure.
6. A Certificate of Occupancy is to be obtained.
7. A Certificate of Inspection is to be obtained.
8. Petitioner is to obtain approval from any City Board or Commission having jurisdiction including, but not
limited to the Planning Board.
Special Condition:
1. No vehicles or dumpsters may be located on the property along the entire length of Ferry Street

This Department has identified a Zoning Violation at your property. The wood fence,recently
erected, was installed without the required permit and is a violation of Salem Zoning section
8.2.4. This section States that fences in an entrance corridor shall not be higher than four feet
and requires a permit from the Building Inspector. Additionally there are no land use permits for
the area behind the fence. Several unregistered vehicles are being stored there. It was also
discovered that an Auto repair shop is running out of the garage at the rear of the property. This
garage does not have an Occupancy Permit in violation of the Mass. State Building Code.
Permits had been issued to make some exterior repairs to the garage, but your Contractor was
warned that the permits were not sufficient to allow a specific use and that further permits would
be required before the Building could be reused. The most glaring Code concern is the lack of
proper egress doors. This constitutes an Unsafe Egress section 3400.4.1 and must be dealt with
immediately.
You are ordered to respond to this letter upon receipt to discuss your plan to bring this property
into compliance with all applicable State Codes and regulations and with Salem Zoning. You are
further ordered to retain the services of a Licensed Architect to conduct a Code review of the
repair garage. Failure to respond will result in further enforcement action including fines and a
possible complaint being filed in District Court. .

DECISION OF THE PETITION OF ENTERPRISE RENT A CAR REQUESTING
A VARIANCE FOR THE PROPERTY LOCATED AT. 35 BRIDGE:STREET (B-4 )
A hearing on this petition was held July 26, 1995 with the following Board
members present: Stephen Touchette, Chairman; Gary Barrett, Albert Hill,
Nina Cohen and Arthur LeBrecque. Notice of the hearing was sent to
abutters and others and notices of the hearing were properly published in
the Salem Evening News in accordance with Massachusetts General Laws
Chapter 40A.
Petitioner, owners of the property request a Variance for a Change in Use
(Rent-A-Car) for the property located at 35 Bridge Street. (B-4)
The Variance which has been requested may be granted upon a finding of this
Board that:
1. Special conditions and circumstances exist which especially affect the
land, building or structure involved and which are not generally affecting
other land, buildings, or structures in the same district.
2. Literal enforcement of the provisions of the Zoning Ordinance would
involve substantial hardship, financial or otherwise, to the petitioner.
3. Desirable relief may be granted without substantial detriment to the
public good and without nullifying or substantially derogation from the
intent of the district or the purpose of the Ordinance.
The Board of Appeal, after careful considerations the evidence presented at
the hearing, makes the following findings of fact:
1. Dennis Finkel, General Manager for the petitioner appeared on behalf of
the petitioner.
2. Petitioner has signed a lease for interior space in the building
located at 35 Bridge St. as well as for 3300 square feet of exterior
lot space on Lot 233 located on Ferry & Waite Streets.
3. Petitioner's operations will employee a staff of four (4) and will
operate Monday - Friday, 8:00 am - 6:00 pm and on Saturday 9:00-12:00.
4. Petitioner's business consists of renting\leasing cars to individuals
who are in need of rental cars because of an auto accident of repairs.
5. Witch City Auto Body currently operated out of the 35 Bridge St.
property.
6. Petitioner plans to park 12 cars on Lot 233 located on Ferry & Waite St
7. Petitioner will be remodeling interior office space and will do minimal
exterior construction.
8. Petitioner will register its vehicles in Salem resulting in additional
revenue for excise tax for the City.
9. There was no opposition to the Petitioner's request.
10. Richard Deschamps, 15 Crosby St. & Steven Pelechowicz, 12 Phillips St.
spoke in favor of the petition.
11. Petitioner's business will be complimentary to the other businesses in
the area.
On the basis of the above findings of fact, and on the evidence presented
at the hearings, the Board of Appeal concludes as follows:
1. Special conditions exist which especially affect the subject property
and not the district in general.

Hello Mr. Tremblay,
With further reference to our telephone conversation on July 20, 1995 about the above
property, I am enclosing a copy of the structural engineer's July 27th report which confirms the
safety of the body shop floor.
As to the adjacent stair area, Mr. O'Connell tells me that supporting the existing brick
columns on either side is acceptable for now, and he recommends replacement of the brick
columns before next winter. My client will be obtaining quotes for the job shortly and a permit
will be applied for in the usual course.
On the basis of this information, no dangerous condition exists on the premises.

Dear Mr. Cunha:
At your request, I made a structural inspection of portions of
the basement of your building at 35 Bridge Street, Salem, on July
26, 1995 . Two specific areas were investigated.
The body shop floor above the open basement area is framed
with double 2x8 ' s at 16-inch centers . The joists are supported by
stone walls and a central 6x8 carrying beam. The beam is supported
by various types of columns at an approximately 7-feet spacing.
This floor system has a live load capacity of 100 psf . The
Massachusetts Building Code requires that garages have a
distributed live load capacity of 50 psf, and a concentrated live
load capacity of 2000 lbs . spread over a 6-inch x 6-inch area.
Your floor more than meets these requirements and safely supports
the loads .
The floor system appears to be in acceptable condition, and no
signs of distress were observed. The adjacent crawl space was
inaccessible, but no signs of distress were observed from the few
wall openings, and the floor appeared to be appropriately framed.
The second area of concern was at the foot of the stairs near
Bridge Street. The required remediation measures are shown on the
two attached sketches . I feel that the brick columns should be
replaced rather than be supported on each side because these brick
columns are supporting the roof as well as the floor.
