A copy of the application for a building permit of Mr. Surrette and a copy of the building permit approved by Mr. Macintosh are also attached. The specific grounds of this appeal is that the action of Mir. MacIntosh in granting the building permit to Mr. Surrette at 34 Bridge Street in Salem, Massachusetts , violates Section VIII D of the Salem Zoning Ordinance regarding nonconforming structures which states: "Where a structure exists which could not be built under the terms of this Ordinance by reason of restrictions on area, lot coverage, height, yard dimensions , or other ccga-racteristics of the structure or its location on the lot, such structure may be continued so long as it remains otherwise lawful, subject to the following provision: July 12, 1984 Page two 2. Should such structure be destroyed by any means to an extent of more than fifty percent of its replacement costs , or more than fifty percent of its floor area at the time of destruction, it shall not be reconstructed except in conformity with the provisions of this Ordinance. A copy of the June 15, 1984 , letter from Mr. Lagonakis to Mr. MacIntosh is attached hereto as is a copy of the response from Mr. MacIntosh to Mr. Lagonakis dated June 27 , 1984 . A copy of the application for a building permit of Mr. Surrette and a copy of the building permit approved by Mr. Macintosh are also attached. The specific grounds of this appeal is that the action of Mr. MacIntosh in granting the building permit to Mr. Surrette at 34 Bridge Street in Salem, Massachusetts , violates Section VIII D of the Salem Zoning Ordinance regarding nonconforming structures which states: "Where a structure exists which could not be built under the terms of this .Ordinance by reason of restrictions on area, lot coverage, height, yard dimensions , or other c >�aracteristics of the structure or its location on the lot, .such structure may be continued so long as it remains T otherwise lawful, subject to the following provision: 3: ' h City Clerk July 12, 1984 Page two 2.
