An example is stainless steel, "glassboard" or equivalent material. - You stated that the floor is to be covered with quarry tile and serviced by floor drains. - All equipment and utensils to be constructed of srainless steel or an equivalent smooth easily cleanable material. , Equzpment to be installed with adequate space surrounding it to allow for regular, effective cleaning. - A three compartment sink to be installed for warewashing. A drain- board to be installed at end of sink to allow for air drying. - Wall-hung handwashing sinks with liquid soap and paper towel dispensers to be installed in food-preparation area, (stainless steel) . - In new establishments at least one (1) service sink or curbed cleaning facility with a floor drain shall be provided and used for the cleaning of mops or similar cleaning tools and for the disposal of mopwater. Notice of the hearing was sent to abutters and others and notices of the hearing were properly published in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A. The petitioner is requesting a Variance to allow an Authentic Sports Pub which will serve alcoholic beverage in this B-4 zone. The property is owner by Nondas Lagonakis. The Variance which has been requested may be granted upon a finding by this Board that: a. special conditions and circumstances exist which especially affect the land, building or structure involved and which are not generally affecting other lands, buildings or structures in the same district. b. literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise, to the petitioner; c. desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent of the district or the purpose of the Ordinance. That there was no opposition to the petition. 6. That strict enforcement of the Zoning Ordinance would create a particular and substantial hardship to the petitioner. Application Item 7 We have been notified by the Building Department , City of Salem, that the masonry column at the building entry is in violation of Section 26-2 of the Rules and Regulations of the Architectural Barriers _Board . We did not interpret the text or drawings of the rule book to require the 18" clearance at the latch pull side of the door to extend 60" in front of the door. We pro- vided for 48" clear walkway across the front of the building, level for over 60" in front of the door, and we provided for 18" clear area at the latch pull side of the door. The clear distance from the door sidelight to the masonry column is 3 ' -4" . The clear distance from the column across the walkway , to ';the building face is 48" . We believe that the entry door- way as constructed is accessible to a handicapped person using a wheelchair. The masonry pier encloses a structural steel column, and the store front corner mullion at the door sidelight encloses another structural steel column. Relocating the masonry column would involve significant demolition and reconstruction of the masonry exterior walls , including foundation and structural ; steel work. The cost would probably exceed $30 ,000. Relocat- ing the existing doorway would require demolition and alter- ation- of existing store front framing and glazing, alterations to structural steel and foundation work. The cost would probably exceed $15 ,000. We believe that the building design and construction does comply with the Rules and Regulations of the Architectural Barriers Board and that the entrance is accessible to handi- capped persons .
