I have examined a letter from the present owner as well as four affidavits from former owners and abutters . There is also documentation from various city departments consistent with use of this dwelling as five-units . Based on my review of the documentation, it is my opinion that this dwelling was a lawful five-unit residence prior to the adoption of the City ' s Zoning Ordinance in 1965 . It is my opinion that this dwelling should be afforded the protection of Section VIII ( E ) of the aforementioned ordinance relative to non-conforming uses and this dwelling ' s current use as a five-family unit is permissible . We have known many of the tenants who have lived there over the years and we know that at least for the past 28 years that it has been a five family building . The present landlord , Dick Savickey has been the best land— lord of that property since we have been here at 177 Boston Street . He has kept the property clean and updated and has improved the class of tenants that are in that building . Once again, since we purchased our house at 177 Boston Street in 1962 there have always been five apartments at 175 Boston Street . Dear Mr . Munroe : On March 1 , 1984 I entered into a Purchase and Sale Agreement with Peter K. & Rebecca N . Tirrell , as Sellers , for the purchase of 175 Boston Street which was therein described as a five ( 5) Unit dwelling. Before I purchased the property I went to the Salem Building Inspectors office to make sure this was recognized as a five ( 5) Unit dwelling and spoke to Mr . Richard MacIntosh , then the City Building Inspector . He told me to get some letters from persons who had been familiar with the house over the years so I got notarized letters from the owner and from the owner of the house next door who were acquainted with the use of 175 Boston Street over the years and brought them to Mr . McIntosh for his records . I told him I could get more letters but he said two were enough , that he recognized the property as a five unit dwelling. The original of these letters have been in the Building Inspectors file since 1984 and I submit copies as Exhibits with this letter . Having confirmed that this was a five unit house I then completed the purchase of the house and became the owner . As the new owner I wanted to make various improvements to the building. After I bought the house I wanted to put in a sixth electric meter to take care -of the electric usage of the common areas , furnace and fire alarm system, which had been on the owner ' s meter of the top floor unit when the previous owner and his wife occupied that apartment . I went to the office of the Electric inspector who told me I would have to clear with the Building Inspector as to the number of dwelling Units in the building so I went back to Mr .MacIntosh who authorized the Electrical Inspector to issue a permit for installation of the sixth meter . I also wanted to make some changes at the building and applied for a building permit on May 11 , 1984 to do such work . Mr. MacIntosh issued a building permit for this job and the permit also set forth that this building was a fuve Unit building. On May 11 , 1984 I applied for a permit to install five water heaters , one for each dwelling unit , because it was inefficient to continue to supply hot water off the boiler of the heating system, and this permit was also issued . There were five gas meters , one for each apartment at that time and we did not need a permit to install any gas meters . Now that this question has arisen I have spoken to the owners of the adjoining houses and they have given me letters which I enclose that this property to their certain knowledge has been utilized as a five apartment building since before we had a zoning law. I submit the following documents to substantiate the above statement of facts : r) , 1 . Letter of Tirrell of May 1 , 1984 . 2. Letter of LaRoche of May 10 , 1984 . 3 • Building Permit of May 11 , 1984 noting that this is a five Unit dwelling, signed by Mr. MacIntosh . 4 . Authorizing permit to install electric meter of June 4 , 1984 . 5 • Permit to install five gas water heaters of 5/ 18/84 . 6 . Letter of Ray and Carol Borden of November 14 , 1990. 7• Letter of Sahag Sahagian of Nov . 14 , 1990. I verified that this was a recognized five unit building by checking with the Building Inspector before I completed the purchase and the Building Inspector stated it was a five unit building when he issued the building permit to me . Mr . David Harris of the Building Inspector 's office observes that Mr . MacIntosh did not make a notation on the office "card" that it was a five unit building but he very clearly did so on the permit he issued to me . I had no opportunity to double check what was on the card and did not evem know the records were kept that way . The property is just the same now as it was when I bought it except for the improvements I made with proper building permits . Mr . Harris has informed me that there should be changes in the second exit and I am prepared to make such change immediately when he can issue a building permit to do so . I need the approval of the Building Inspector to build a fire escape , just as I needed his approval when I put in an additional meter, water heaters , and when I built a new deck . The Building Inspector 's office and the Health Department would like to have the second exit change as soon as possible , as I do . Will you kindly ask the City Solicitor to give us his decision on this matter as soon as possible . The Magistrate Robert Grant of the District Court has asked us to come back to see him next Wednesday , November 21 .
