As discussed at our meeting at your place of business located at 171 Boston Street on
Monday, January 11, 2016 with my representative. The `Donald Trump' political
campaign signage board that you stated was erected by you on the City property in front
of your business fronting Boston Street is in violation of the Salem Code of Ordinances,
Section 4-2,Posting advertisements on public streets, sidewalks,fences or in public
ways.
The signage shall be hereby removed by the City immediately. After review of this
violation with our Department's representatives it has been determined you have been
notified in the past of this ordinance and continue to ignore the City's rules and
regulations. Please find accompanying City of Salem,Notice of Violation of Municipal
Ordinance Violation ticket (#2501)
Illegal signage erected in the future on City property may result in further actions
being brought against you, up to and including the filing of complaints at District
Court

A hearing on this petition was held on February 17, 1999 with the following Board
Members present Nina Cohen, Chairman, Richard Dionne, Michael Ward, Stephen
Buczko and Stephen Hams. Notice of the hearing was sent to abutters and others and
notices of the hearing were properly published in the Salem Evening News in
accordance with Massachusetts General Laws Chapter 40A.
Petitioner is requesting a Special PermitNariance for additional Ryder Truck Renal, a
used car dealership, signage for.truck rentals and a Special Permit for paintispray booth
for the property located at 171 Boston Street.
The provision of the Salem Zoning Ordinance which is applicable to this request for a
Special Permit is Section 5-3 0), which provides as follows:
Notwithstanding anything to the contrary appearing in this Ordinance, the Board of
Appeal may, in accordance with the procedure and conditions set forth in Sections 8-6
and 9.4, grant Special Permits for alterations and reconstruction of nonconforming
structures, and for changes, enlargement, extension or expansion of nonconforming lots,
land, structures, and uses, provided, however, that such change, extension,
enlargement or expansion shall not be substantially more detrimental than the existing
nonconforming use to the neighborhood.
In more general terms, this Board is, when reviewing Special Permit requests, guided by
the rule that a Special Permit request may be granted upon a finding by the Board that
the grant of the Special Permit will promote the public health, safety, convenience and
welfare of the City's inhabitants.
The Board of Appeal, after careful consideration of the evidence presented at the
hearing and after reviewing the plans, makes the following findings of fact
1. Upon information and belief, petitioner operates the business known as All Star of
Woburn, Inc. at the above address. Neither petitioner nor his representative
Attended the public hearing conducted by the Zoning Board of Appeal
2. Petitioner sought special permits and variances to enable him to expand the services
offered by All Star of Woburn to include truck rentals, used car sales and automobile
painting.

3. At the hearing, Ward 5 Councillor Leonard O'Leary and Ward 6 Councillor Sally
Hayes stated that petitioner is currently in violation of zoning ordinance regulations
regarding the businesses in operation at 171 Boston Street Both city councillors
opposed the petition on the grounds that an expansion of the existing businesses
would have a detrimental impact on the surrounding neighborhood.
4. The petition was opposed by two neighbors, Bob Brophy of 165A Boston Street and
Francis Geany of 5 Bow Street, who stated that the petitioner's operations were
currently not in compliance with zoning regulations. The neighbors further stated
that they would oppose the installation of either a truck rental business or a used
car business at that site.
5. The Board was unable to find any basis for hardship in the materials submitted in
support of his petition.
On the basis of the above findings of fad, and on the evidence presented, the Board of
Appeal concludes as follows:
1. The Special Permit requested cannot be granted without substantial detriment
to the public good or without nullifying and substantially derogating from the
intent of the district or the purpose of the ordinance.
2. The granting of the Special Permit requested will not be in harmony with the
Neighborhood and will not promote the public health, safety, convenience and
Welfare of the City's inhabitants.
Therefore, the Zoning Board of Appeal voted unanimously 0 in favor and 5 in opposition
to the motion to grant the relief requested. Having failed to gamer the four affirmative
votes required to pass, the motion to grant fails and the petition for a Special Permit is
denied.

1. This is an appeal from a decision by the Zoning Board of Appeal of the City of
Salem, Massachusetts, (hereinafter the "Board") wherein by denying a
petition to grant a special permit for extension of nonconforming use or grant
a special permit use with reference to the land and building at 171 Boston
Street, Salem, Massachusetts, (hereinafter "Premises"), the Board exceeded
its authority, acted in an arbitrary and unfair manner, and based its decision
on a legally untenable ground.
Parties
2. The Plaintiff Robert H. Cucurull is a natural person and President of a
Massachusetts corporation known as All Star of Woburn, Inc. having a
principal place of business at 171 Boston Street, Salem, Massachusetts
01970.
3. The Defendant Nina Cohen is a member of the Board and resides at 22
Chestnut Street, Salem, Massachusetts 01970.
4. The Defendant Richard Dionne is a member of the Board and resides 23
Gardner Street, Salem, Massachusetts 01970.
5. The Defendant Michael Ward is a member of the Board and resides at 4
Hilton Street, Salem, Massachusetts 01970.
6. The Defendant Stephen Buczko is a member of the Board and resides at 27
Surrey Road, Salem, Massachusetts 01970.
7. The Defendant Stephen Harris is a member of the Board and resides at 148
North Street, Salem, Massachusetts 01970.
Jurisdiction
8. This court has jurisdiction to hear this matter pursuant to Massachusetts
General Laws Chapter 40A, Section 17.
9. On or about January 19, 1999, Plaintiff submitted an application to the Board
for a special permit to use the Premises for a truck rental business, and for
sales and service of motor vehicles. The Premises is located in a Business
(B-2) zoning district under the provisions of the Salem Zoning Ordinance
("Ordinance").
10.Prior use of the Premises consisted of sales, service, and painting of
industrial machinery which use existed prior to the current ordinance.
11.The Ordinance allows as a matter of right in the zoning district, "automobile
service stations" defined in the Ordinance as a "retail place of business
engaged in supplying goods and services essential for the normal operation
of a motor vehicle."

12. In accordance with a letter determination of the Inspector of Buildings and
Zoning Enforcement Officer of the City of Salem, Plaintiff has conducted a
vehicle towing and storage business at the Premises.
13.On February 17, 1999, the Board conducted a hearing without the Plaintiff or
a representative of the Plaintiff being present and reached its decision (a)
without evidence as to the nature of the prior nonconforming uses maintained
in the Premises, (b) without a determination as to existing uses which are
allowed by right in the zoning district, and (c) without a fair determination as to
whether the rejected uses are contemplated by the Ordinance as being
allowable by special permit.
14.After public hearing, the Board denied Plaintiffs petition by written decision
dated February 17, 1999, filed with the Salem City Clerk February 25,1999. A
certified copy of said decision is attached herewith as Exhibit 1.
15.The Board's decision is arbitrary and unfair since its decision was made
following a hearing conducted without the presence of Plaintiff or a
representative of the Plaintiff and without presentation of evidence on behalf
of the Plaintiff.
16.The Board's decision is legally untenable with regard to the request for
extension of a nonconforming use in accordance with Section 5-30) of the
Ordinance, since the Board failed to examine or obtain evidence as to the
nature of prior nonconforming uses in the Premises and failed to compare the
said prior uses with the proposed uses.

17.The Board decision exceeded its authority in that it failed to consider that
certain of the proposed uses are allowed by right or are uses contemplated by
the Ordinance as being allowable by Special Permit.
18.The Plaintiff is a person aggrieved by the decision of the Board in that his
property interests are severely, adversely, and irreparably harmed by said
decision.
WHEREFORE, Plaintiff prays that the decision of the Board be annulled and
the matter be remanded to the Board for rehearing.

1. Allstar of Woburn, Inc. operates as one (1) business
2. As you and your department are well aware of, Attorney George
Atkins represents Allstar of Woburn, Inc. In regards to the matter of
special permits.
3. Trespass tows of motor vehicles in the city of Salem are disposed
of when storage and tow exceeds the value of the vehicle.
4. Allstar does not dismantle or repair vehicles on public ways and
never has. I would like to inquire as to where and from whom this
information is being taken from as I would like very much to
address the Individuals) and have this matter settled and all
parties involved have all facts straight.

APPLICATION OF FLAMMABLE FINISHES BY SPRAY, DIP,
COATING. TREATING OR FINISHING
1. This regulation shall apply to locations or areas where the
following activities are a part of the normal routine of the
business conducted on any premises within the City of Salem.
(A) Where the application of flammable or combustible paint,
varnish, lacquer, stain or other flammable or combustible .
liquid applied as a spray by whatever means, noncontinuous or ,
intermittent process.
(B) Dip tank operations in which articles or materials are passed
through contents of tanks, vats or containers of flammable or
combustible liquids, including coating, finishing, treating
or similar processes.
2. Application shall be made to the Salem Fire Prevention Bureau for a
permit to install a spray area, to conduct operations as detailed
in items A and B above, or to store and/or use any of the products
listed as Class I and Class II flammables. The permit for shall be
in accordance with the current fee schedule.
3. Application shall be made to the Salem Building Inspector for a
permit to construct any booth or necessary structure to provide an
area for production of any type utilizing any Class I or, Class II
product.
4. Application shall be made to the Salem Electrical Department for a
permit to install and use electricity in any area where Class I or
Class II products are used or stored.
5. All booths for storage of Class I or Class II flammable products
shall meet the applicable standards as set forth In the Fire
Prevention Regulations of the Department of Public Safety, the
Salem Fire Code, NFiPA Standard #33, and/or the Massachusetts State
Building Code.
6. A partial sprinkler system shall be provided as required by ,the

Salem Fire Prevention Bureau and the Massachusetts State Building
Code. A plumbing permit is required, and the use of 1-1/2" iron
pipe or 1 " copper, from the meter area, is the minimum size to be
used.
7. All future operations are subject to the regulations of the Salem
Fire Prevention Bureau. An annual renewable permit shall be
required for the operation and storage of flamm ables after the
approval of the installation.

DECISION ON THE PETITION OF ROBERT H. CURCURULL REQUESTING A_

A hearing on this petition was held on February 17, 1999 with the following Board
Members present: Nina Cohen, Chairman, Richard Dionne, Michael Ward, Stephen
Buczko and Stephen Hams. Notice of the hearing was sent to abutters and others and
notices of the hearing were properly published in the Salem Evening News in
accordance with Massachusetts General Laws Chapter 40A.
Petitioner is requesting a Special Permit/Variance for additional Ryder TruckWanal�a
used car dealership, signage for truck rentals and a Special Permit for paint/spray booth
for the property located at 171 Boston Street.
The provision of the Salem Zoning Ordinance which is applicable to this request for a
Special Permit is Section 5-3 Q), which provides as follows:
Notwithstanding anything to the contrary appearing in this Ordinance, the Board of
Appeal may, in accordance with the procedure and conditions set forth in Sections 8-6
and 9-4, grant Special Permits for alterations and reconstruction of nonconforming
structures, and for changes, enlargement, extension or expansion of nonconforming lots,
land, structures, and uses, provided, however, that such change, extension,
enlargement or expansion shall not be substantially more detrimental than the existing
nonconforming use to the neighborhood.
In more general terms, this Board is, when reviewing Special Permit requests, guided by
the rule that a Special Permit request may be granted upon a finding by the Board that
the grant of the Special Permit will promote the public health, safety, convenience and
welfare of the City's inhabitants.
The Board of Appeal, after careful consideration of the evidence presented at the
hearing and after reviewing the plans, makes the following findings of fact:
1. Upon information and belief, petitioner operates the business known as All Star of
Woburn, Inc. at the above address. Neither petitioner nor his representative
Attended the public hearing conducted by the Zoning Board of Appeal
2. Petitioner sought special permits and variances to enable him to expand the services
offered by All Star of Woburn to include truck rentals, used car sales and automobile
painting.

3. At the hearing;Wardy5_Councillor Leonard O'Leary and Ward 6 Councillor Sally
Hayes stated that petitioner is currently in violation of zoning ordinance regulations
regarding the businesses in operation at 171 Boston Street. Both city councillors
opposed the petition on the grounds that an expansion of the existing businesses
would have a detrimental impact on the surrounding neighborhood.
4. The petition was opposed by two neighbors, Bob Brophy of 165A Boston Street and
Francis Geany of 5 Bow Street, who stated that the petitioner's operations were
currently not in compliance with zoning regulations. The neighbors further stated
that they would oppose the installation of either a truck rental business or a used
car business at that site.
5. The Board was unable to find any basis for hardship in the materials submitted in
support of his petition.
On the basis of the above findings of fad, and on the evidence presented, the Board of
Appeal concludes as follows:
1. The Special Permit requested cannot be granted without substantial detriment
to the public good or without nullifying and substantially derogating from the
intent of the district or the purpose of the ordinance.
2. The granting of the Special Permit requested will not be in harmony with the
Neighborhood and will not promote the public health, safety, convenience and
Welfare of the City's inhabitants.
Therefore, the Zoning Board of Appeal voted unanimously 0 in favor and 5 in opposition
to the motion to grant the relief requested. Having failed to garner the four affirmative
votes required to pass, the motion to grant fails and the petition for a Special Permit is
denied.

Dear Mr. Curcurull:
So there is no confusion from our meeting, Wed, Feb 9, 2000, we discussed a couple of
minor violations with your building, exit signs above the door in the office, we talked
about cars staying past the required time. We also had discussions on auto body verses
Auto repair. But the biggest thing was the Ryder Truck situation. The Building Dept. has
given you until Feb 23, 2000, to try to rectify in principal the situation regarding this
matter.
Failure to comply with these orders in fourteen (14) days will result in legal action taken
against you in Salem District Court.

On October 7 , 1997 I conducted an inspection at 171
Boston Street and the following facts were found per your
request :
1 . The property is no longer owned by Rod' s Towing, it is
now owned by All Star of Woburn, Inc.
Z . The property has no permits issued for a junkyard
operation.
3 . All Star of Woburn, Inc. is a auto repair business , and
has towing vehicles as does most repair shops .
4 . All Star has a business certificate registered with the
City of Salem Clerk' s Office. It is located in a
Business District which allows auto repairs and storage
while under repair.
5 . 171 Boston Street is now owned by All Star of Woburn,
Inc.
If this office can be of any further assistance in
this matter, please do sot hesitate to call .

Dear Mr. Canty:
Due to a complaint received by the Neighborhood Improvement Task Force, we
conducted an inspection of your property located at 171 Boston Street and found the
following violations;
1. Electrical wiring exposed on ceiling fans and disconnect switches on wall.
2. Illegal second business, Ryder Truck Rental located at 171 Boston Street.
3. No permits for exterior signage on building.
4. Illegal use of renting out space/use to public to repair cars.
Please notify this department within ten (10) days upon receipt of this letter, to inform us
as to what course of action you will take to rectify these violations. Failure to do so will
result in legal action being taken against you in Salem District Court.

CANTY (OWNER) , FOR A VARIANCE ATL171;BOSTON STREET-- Z (B-2)
A hearing on this petition was held August 17, 1994 with the
following Board Members present: Stephen Touchette, Chairman, Gary
Barrett, Stephen O'Grady, Nina Cohen and Associate Member Arthur
Labrecque. Notice of the hearing was sent to abutters and others
and notices of the hearing were properly published in the Salem
Evening News in accordance with Massachusetts General Laws Chapter
40A.
The petitioner, Robert Cucurull, 109 Boston St. , Salem is requesting
a Variance to allow the property to be used for auto body work, auto
repair, spray painting and to store vehicles. The property is owned
by Edward Canty and is located in the B-2 district.
The petitioner requested leave to withdraw this petition without
prejudice to allow him the opportunity to meet with the neighbors and
to re-apply at a later date.
The Board of Appeal voted unanimously 5-0 to grant petitioners
request for leave to withdraw this petition for a Variances without
prejudice.
