The stockade fence has deteriorated and fell over in the last year. The operator,when told of the need to have the fence repaired ,only replaced part of the fence. Inspector One Salem Green Salem, Massachusetts 01970 RE: 146 Boston Street Shell Gas Station Building Permit in B2—Highway Business District Dear Inspector Tremblay: Pursuant to the request of Attorney Nancy Attaya who represents Shell in the above captioned matter, I have reviewed the submitted plans and pertinent sections of the Salem Zoning Ordinance. There have been several concerns raised by the neighborhood and Councilors O'Leary and Hayes regarding the proposed addition of the car wash at this location. Based upon my review and further discussion with City Solicitor Robert Ledoux, it is my opinion this project complies with specifications of the Zoning Ordinance meeting the necessary set back and density requirements. This is a permitted use in the highway business district. Furthermore, it appears clear from my review of the records in the assessor's office that Section 7-9 of the City Ordinance applies as this piece of property was"a lot of record" at the time of adopting the zoning ordinance which created the R2/B2 boundary line which horizontally dissects the approximate back third of the lot. The portion of the lot in question has been a contiguous lot since at least 1946 —well before the adoption of the Zoning Ordinance in 1965. Thus, the regulations of the less restricted B2 portion of this lot may extend up to thirty (30) feet in the more restricted R2 district. I will inform Attorney Attaya of this opinion and that building permit #141-97 is to be reissued upon the request of the Lamontain Brothers, Inc. Thank you for your attention to this matter.
