Greenbaum CommMsloner Joseph Jones ;rain :.tai� gab: 4 Waters Street Salem, MA 01970 Dear Mr. Jones: MAR -1 1993 RE: SALEM — Metropolitan Boston/Northeast Region 310 CMR 7.02 - Plans Approval Appl.No. MBR-92-COM-032 Transmittal No. 51495 The Metropolitan Boston/Northeast Region of the Department of Environmental Protection, Division of Air Quality Control, has reviewed your Limited Plan Application submittal regarding the proposed replacement of an existing Hodges boiler with a new Cleaver -Brooks boiler at your 4 Waters Street facility in Salem, Massachusetts. This office's review of your application commenced on December.22, 1992. - This review by Department engineers indicates that the new Cleaver -Brooks Model.CB-600 boiler will combust No. 4 oil, having a maximum sulfur content of 1.0 percent, by weight, as the only fuel of use. As proposed, the boiler will have a maximum fuel firing rate of 56 gallons per hour and a maximum energy input rating of 8.23 million Btu per hour. The combustion products from the new boiler will exit through an existing stack, having a stack exit height of 85 feet above the ground and 70 feet above the roof. The Department is of the opinion that your application is administratively complete and that your proposal is in conformance with current air pollution control engineering practice, and hereby grants TDOMMUMMOM for the project as submitted, with the following provisos: 1. That this Regional Office shall be notified in writing, attention Air Quality Section Chief, when the new boiler commences operating at your. facility.. That should any nuisance condition(s) be generated by the operation of this facility then appropriate steps will immediately be taken by Mason Tanning Company to abate said nuisance condition(s).. That a copy of this approval letter shall be affixed in an accessible location of the boiler room. 4. That the particulate emission rate for the described unit may not exceed 0.10 pounds per million Btu at any firing rate, and the ability of the equipment to maintain an emission rate at or below this level must be demonstrated when and if, in the opinion of the Department, such should prove necessary. 5. That should asbestos removal be necessary as part of the. Hodges boiler replacement, then said removal shall be carried out in compliance with Regulation 310 CMR 7.15 in its entirety. Failure to comply with any of the above stated provisions will constitute a violation of the "Regulations", and can result in the revocation of the approval granted herein. This approval may also be revoked if the boiler replacement is not begun within two years from the date of issuance of this approval or if the boiler replacement is suspended for one year or more. The Department has determined that the filing of an Environmental Notification Form (ENF) with the Secretary of Environmental Affairs, for air quality control purposes, was not required prior to this action by the Department. Notwithstanding this determination, the Massachusetts Environmental Policy Act (MEPA) and Regulation 301 CMR 11.00, Section 11.03, provide certain "Fail -Safe Provisions" which allow the Secretary to require the filing of an ENF and/or an Environmental Impact Report at a later time. This plan approval is an action of the Department. If you are aggrieved by this action, you may request an adjudicatory hearing. A request for a hearing must be made in writing and postmarked within twenty-one (21) days of the date you received this plan approval. Under 310 CMR 1.01(6)(b), the request must state clearly and concisely the facts which are the grounds for the request, and the relief sought. Additionally, the request must state why the plan approval is not consistent with applicable laws and regulations. Mason Tanning Co, Inc. The filing fee is not required if the appellant is a city or town (or municipal agency) , county, or district of the Commonwealth of Massachusetts, or a municipal housing authority. The Department may waive the adjudicatory hearing filing fee for a person who shows that paying the fee will create an undue financial hardship. A person seeking a waiver must file, together with the hearing request as providedabove, an affidavit setting forth the facts believed to support the claim of undue financial hardship. Please be advised that this approval does not negate the responsibility of Mason Tanning Company to comply with this or any other applicable federal, state, or local regulations in the future.
