SECOND NOTICE
Dear Property Owner:
This office has received complaints that you are feeding birds on and adjacent to your property at 11 Glover Street,creating unsanitary and
nuisance conditions for neighbors in the area.
An on-site inspection was conducted on November 9,2016 by Elizabeth Gagakis,Senior Sanitarian for the Board of Health. It was
observed that a bird feeder in the yard had a large amount of pigeons congregated beneath it eating from the ground and the feeder.As
evidenced by photographs and information received by this department from the Animal Control Officer,you are being cited for the feeding
of birds in your yard and at/over the seawall adjacent to your property.
Complaints of the birds and ducks being fed on the beach over the seawall have continued.In addition to causing a nuisance by
attracting the birds,feeding birds and ducks bread and other items can be harmful to their health and is not advised by wildlife
experts.
Bird droppings contain bacteria that can cause diseases in humans. In addition,the droppings can deface and accelerate deterioration of
buildings and may kill lawns and shrubbery. The feeding of birds has also been known to attract rodents.
Therefore,the Salem Board of Health determines that these conditions create a public health nuisance. You are ordered to take
positive action to cease the causing of this nuisance in accordance with Mass General Laws chapter 111 section 123,and to notify this
department within thirty(30)days of that action. Failure on your part to comply within the specified time will result in a complaint
being sought against you in Salem District Court.
Should you be aggrieved by this order,you have the right to request a hearing before the Board of Health. A request for said hearing must be
received in writing in the office of the Board of Health within 7 Days of receipt of this order. At said hearing,you will be given an
opportunity to be heard and to present witness and documentary evidence as to why this order should be modified or withdrawn. You may be
represented by an attorney. Please also be informed that you have the right to inspect and obtain copies of all relevant inspection or
investigation reports,orders,and other documentary information in the possession of this Board,and that any adverse party has the right to be
present at the hearing.
