Dear Mr. Shehu,
On May 18,_2013 and May 19, 2013 you were observed on a closed circuit camera illegally
dumping two loads of grass clippings and yard waste from your green Chevy Silverado, MA
registration 468 XXL, on the property located at 56 Swampscott Road in Salem, MA. This is a
violation of 310 CMR 19.014(2) No person shall dispose or contract for the disposal of solid
waste at any place in Massachusetts which has not been approved by the Department pursuant
to M.G.L. c.111,§ 150A, 310 CMR 16.00 or 310 CMR 19.000.
Therefore, you are hereby ordered to pay a fine of$500.00, $250.00 for each violation. Payment
of this fine must be received in the Board of Health office within 21 days of receipt of this order.
Additionally, you are ordered to remove all the grass clippings and yard waste dumped by you
from this site and dispose of said waste properly.
Failure to do so will result in a criminal complaint being sought against you in Salem District
Court.
Should you be aggrieved by this Order, you have the right to request a hearing before the Board
of Health. A request for such a hearing must be received in writing in this office of the Board of
Health within seven (7) days of receipt of this Order. At said hearing, you will be given the
opportunity to be heard and to present witness and documentary evidence as to why this Order
should be modified or withdrawn. You may be represented by an attorney. Please also be
informed that you have the right to inspect and obtain copies of all relevant inspection or
investigation reports, orders, and other documentary information in the possession of this Board,
and that any adverse party has the right to be present at the hearing.
