This action places the public's health at risk for numerous blood- borne diseases, including hepatitis B and C and skin infections. Furthermore, microblading is not currently permitted under Salem Board of Regulation #27. This unlawful body art operation is in violation of Salem Board of Health Regulation #27, Section 4.0 Body Art Practitioner: Requirements and Practices paragraph 3 and 4 A through G and Section 6.0 Facilities and Equipment paragraphs 1 through 16. Therefore, in accordance with the 105 CMR 400.00 State Sanitary Code Chapter I, "General Administrative Procedures", Massachusetts General Law Chapter 111, Section 122 and Salem Board of Health Regulation #27. You are hereby ordered to immediately cease and desist all body art activities, including microblading you conduct in the City of Salem. .You are further ordered to contact the Salem Board of Health within 7 days of receipt of this order to address the issue of your unpermitted body art practice. Failure to comply with this order will result in further action being taken against you including daily monetary fines of$1000.00 per day or court action against you. Orders of the Board of Health may be enforced by an application to Superior Court. Should you be aggrieved by this Order, you have the right to request a hearing before the Board of Health. A request for such a hearing must be received in writing in this office of the Board of Health within seven (7) days of receipt of this Order. At said hearing, you will be given the opportunity to be heard and to present witness and documentary evidence as to why this Order should be modified or withdrawn. You may be represented by an attorney. Please also be informed that you have the right to inspect and obtain copies of all relevant inspection or investigation reports, orders, and other documentary information in the possession of this Board, and that any adverse party has the right to be present at the hearing.
