Dear Mr. Lenzi;
As I stated during your annual inspection on July 18, 2007, it is required under the
State Building Code, 780 CMR Section 1028.3, that all Fire Escapes shall be tested and
certified every five years. Affidavit of such certification must then be forwarded to this
office. During this conversation you suggested that you would just remove this Fire
Escape, rather than having it inspected. Let me remind you that any installed system
must be maintained in a working fashion,per the Code. Removal of this means of egress
could only be accomplished if an Architect performs a Chapter 34 review and through
that, deems that use of this Fire Escape can be abandoned without compromising the
safety of the residents of this building. This would have to be filed with this office, and
the proper Building Permits would have to be applied for and granted,prior to the
removal of this Fire Escape. Removal of this Fire Escape without going through this
process would be a violation of the Code and as such a Criminal Act that could be
punishable through charges filed at the District Court.
