U.S. BANK,N.A.,AS TRUSTEE FOR THE HOLDERS OF THE MERRILL LYNCH FIRST FRANKLIN MORTGAGE LOAN TRUST, MORTGAGE LOAN ASSET-BACKED CERTIFICATES, SERIES 2007-1, as the owner of the property located at 16 Eden Street, Salem, Massachusetts, Respondent. AFFIDAVIT OF DAVID GREENBAUM I, DAVID GREENBAUM, for my affidavit under oath state: 1. I am currently employed as the health agent for the City of Salem since January 30,2019. 2. In this capacity, I am authorized and mandated to have properties inspected and enforce ordinances,rules, and regulations under the Massachusetts State Sanitary Code, and the regulations promulgated thereunder, 105 CMR 400.00—410.00 (the"Code"). 3. I am familiar with the facts underlying the conditions at the residential property located at 16 Eden Street, Salem, Massachusetts (the "Property"),which is the subject of the receivership petition by the Attorney General and the City of Salem in the captioned matter, as set forth in this affidavit. 1 4. The Board of Health received complaints from residents of Salem regarding conditions and possible violations at this Property. 5. The Property is a single-family residential dwelling. 6. Upon information and belief,the Property has been vacant since the house fire that occurred at the Property on December 10, 2019. 7. Inspections of the exterior of this property were conducted on July 7, 2021, August 12, 2021, November 12, 2021. , 8. During the July 7, 2021 inspection of the Property, I observed conditions present that created an imminent health hazard and public health nuisance, which caused me to issue a Violations Order on the same day directing the owner to abate these nuisance conditions and take positive action to repair property to habitable condition. See Exhibit A(a true and accurate copy of Violations Letter and Order to Abate, dated July 7, 2021). 9. On or about December 1, 2021,the City of Salem was carbon copied on letters from the Attorney General's Office informing the owner and interest holders of the violations present at the Property and the Attorney General's intent to seek receivership if the violations were not remedied. 10. I have continued to monitor the Property and have not seen the above-mentioned violations addressed since this letter. 11. The Property, in its present condition, is unfit for human habitation and has the potential to endanger or materially impair the health, safety, and well-being of occupants,neighbors, and/or the public. 12. Unless action is taken immediately, the conditions will continue unabated, and the public will continue to face risks to its safety. 2 13. Attached as Exhibit B are miscellaneous photographs of the Property accurately representing its condition on July 7, 2021, the date of my last visit.
