Dear Mr. Lenzi:
Following reports of possible health and safety conditions in unit
14 by the property owner, and in accordance with Massachusetts
General Law, Chapter 111 , Sections 127A and 127 B and 105 CMR:
410.000: Chapter II, State Sanitary Code, Minimum Standards of
Fitness for Human Habitation; an inspection of Unit 14 located at 2-4
Howard Street was conducted by David Greenbaum, Senior
Sanitarian and Justina. Polvere, Public Health Nurse on September 6,
201. A complete inspection of the unit was not done at the time
because of unsanitary and dangerous conditions which may have
endangered an inspector and/or made it impossible to see the entire
area.
Extreme unsanitary conditions were noted in Unit 14, including
human feces and urine was observed in the unit. Trash was in a pile
and strewn all over the floor of the unit. Based upon the findings of
the inspection, the Board of Health has determined that the Unit 14 is
unfit for human habitation. The danger to the life or health of the
occupant is so immediate that immediate condemnation is
ordered and the hearing requirements of 105CMR 410.831 B and
C are waived. Access to the unit may be made only for the

purposes of cleaning and making repairs between the hours of
8AM and 512M. If any person refuses to leave the unit they may be
forcibly removed by the Board of Health or by local police authorities
on the request of the Board of Health.
Should you be aggrieved by this Order, you have the right to
request a hearing before the Board of Health. A request for such a
hearing must be received in writing in this office of the Board of
Health within seven (7) days of receipt of this Order. At said
hearing, you will be given the opportunity to be heard and to present
witness and documentary evidence as to why this Order should be
modified or withdrawn. An attorney may represent you. Please also
be informed that you have the right to inspect and obtain copies of all
relevant inspection or investigation reports, orders, and other
documentary information in the possession of this Board, and that
any adverse party has the right to be present.
Any cost borne by the Board of Health is a debt to the City and
shall be recoverable from the owner in an action of contract.
No_dwelling or portion thereof, which has been condemned and
placarded as unfit for human habitation, shall again be used for
human habitation until written approval is secured from, and the
Board of Health removes such placard. No person shall deface or
remove the placard, except the Board of Health shall remove it
whenever the defect or defects upon which the condemnation and
placarding action was based have been eliminated.
