400.00;State Sanitary Code,Chapter 1: General Administrative Procedures and 105 CMR 410.00:State
Sanitary Code, Chapter 11: Minimum Standards of Fitness for Human Habitation,an inspection of the
property 12-14 Cherry Street was conducted by Elizabeth Gagakis,Sanitarian on December 10 2013 at
10:00 a.m.
Notice:if this rental unit is occupied by a child or children under the age of 6 years,it is the property owner's
responsibility to notify tenants of lead related reports and tests, and to ensure that this unit complies fully
with 105 CMR 460:000: Regulations for Lead Poisoning Prevention and Control. For further information or
to request an inspection,contact the Salem Board of Health at 978-741-1800.
You are hereby ORDERED to make a good-faith effort to correct the violations listed on the enclosed
inspection report.
Failure on your part to comply within the time specified on the enclosed inspection report will result in a
complaint being sought against you in Trial Court. Time for compliance begins with receipt of this Order.
Should you be aggrieved by this Order,you have the right to request a hearing before the Board of Health.
A request for said hearing must be received in writing in the office of the Board of Health within 7 days of
receipt of this Order. At said hearing,you will be given an opportunity to be heard and to present witness
and documentary evidence as to why this Order should be modified or withdrawn.You may be represented
by an attorney. Please also be informed that you have the right to inspect and obtain copies of all relevant
inspection and investigation reports,orders and other documentary information in the possession of this
Board,and that any adverse party has the right to be present at the hearing.

Rent Withholding(General Laws Chapter 239 Section 8A)
If Code Violations Are Not Being Corrected, you may be entitled to hold back your rent payments. You can do this
without being evicted if:
A. You can prove that your dwelling unit or common areas contain code violations which are serious enough to
endanger or materially impair your health or safety and that your landbrd knew about the violations before you were
beNnd it your rent.
B. You did not cause the violations and they can be repaired while you continue to live in the budding.
C. You are prepared to pay any portion of the rent into court if a judge orders you to pay 1L (For this it is best to put the rent
money aside.in a safe place.)

The law sometimes allow you t"se your rent money to make the repairs yourself. ff your local code enforcement
agency certifies that there are code violations which endanger or materially Impair your health,safety or well-being and
your landlord.has received written notice of%the violations,you may be able to use this remedy. If the owner fails to
begin necessary repairs (or to enter Into a written contract to have them made) within five days after notice or to
complete repairs within 14 days after notice you can use up to four months rent in any year to make the repairs.
2etarratory Rent Increases or Evictions Prohibited(General Laws Chapter 186.Section 18 and Chapter 239 Section 2A).
The owner may,not increase your rent or evict you in retaliation for making a complaint to your local code enforcement
agency about code violations.-!f the owner raised your rent or tries to evict within six months after you have made the
complaint he or she will have to show a good'reason for the Increase or eviction which Is unrelated to your complaint.
You may be able to sue the landlord for the damages if he or she tries this.
Pent Receivership(General Laws Chapter 111 Section 127C-H).
The occupants andfor the board of health may petition the District or Superior Court to allow rent to be paid into court
rather than to the owner. The court may then appoint a "receiver"who may spend as much of the rent money as is
needed to correct;the violation. The receiver is not subject to a spending limitation of four months rent.
Breach of Warranty of Habttabirty..
You may be entitled to sue.your landlord to have all or some of your rent returned if your dwelling unit does not
meet minimum standards of habitability.
Unfair and Deceptive Practices(General Laws Chapter 93A).
Renting an apartment with code violations is a violation of the consumer protection act and regulations for which you
may sue an owner.

Dear Owner/Manager:
This department has recently received numerous new complaints about your property regarding improper storage of trash
and the maintenance of your property free from rubbish and garbage. These complaints date as far back as January of
2007. In an attempt to work with you to minimize the trash violations on your property this office has notified you of any
complaints received regarding trash violations on your property. This courtesy does not seem to have had any impact on
the trash violations on your property.
In accordance with Board of Health regulation 7, Section 3:10 and CMR 410.600- .602 it is the responsibility of the
property owner to insure that trash and garbage is properly contained in weather tight, rodent proof trash receptacles and
to maintain your property free from rubbish and garbage.
A dumpster was provided to you by North Side Carting, please ensure the dumpster is being utilized and is kept closed
when not in use to prevent the spread of trash and debris and the accumulation of rain or ice in the dumpster.
This letter will serve as the final warning about trash violations on your property. Should this department continue to
receive complaints about your property monetary citations starting at$100.00 will be issued.
If you have any questions, please do not hesitate to call the Board of Health office at 978-741-1800.

It appears that the second story balcony (facing the street) of 12 - 14 Cherry is being used to store trash
between collection days. Currently, there are several full trash-bags that can be seen as you drive by,
along with cloths that have been hung on the (open) exterior door for over four days now. The
landlord/property manager was here this weekend, but I guess he didn't see it.
Also, at 11 - 13 Cherry,there is a pile of carpet in the driveway (on the 13 side) that has been there for
about 2 weeks.
Any assistance you can provide will be appreciated.

I live on,Cherry st. It is,a very small street and the trash can be seen on the ground all the time.
The tenents don't-usually use trash plastic bags and the trash is all over. On weekends my
neighborand nd-I-clean the street. We have enough signs. The owners of those rental places should
screen their tenents better. And also tell them about trash collection and I believe it is obligatory
to use bags. Come on Thursdays or Friday in the morning and see with your own eyes. I took
pictures but deleted them however next time will send to you. Not sure what to do. I just keep
cleaning the street and praying for these people to learn that trash brings rats, other animals and
diseases.

Hi Lynn,
Thanks for the update on the St.Joseph's project. Do they have a time for the start and finish? Or
still on paper???I really wish this area can get better so we can move on to other projects. I also
would like to know what is the best way to complaint about trash issues. Our street is very small
however the Landlords over populate their houses. You should see after the trash pick up. They
leave the big trash containers out on the street or even worse on the sidewalk blocking them. I
emailed pictures to the board of health and don't see much change. Every week is something
new. I pick up trash going to work and coming back. It is so bad. Please not sure if you can help
me with that. but it is good to inform and maybe someone can really talk to these Landlords and
fix this situation so can really be over.
I don't bring friends to our home anymore because am so embarrassed. Some dogs in those
units poop in front of their houses and nobody picks up. No license for the dogs either. It is a
mess. We live in the end of the street and it should not be like that. I am just venting out.
Ok. Life is good anyways. I hope you enjoyed today.

Redevelopment of this site is a high priority of the Mayor. I know that the owner of the site,
Planning Office for Urban Affairs, has beenconsidering other options for the first floor of the
proposed new building in combinationwith affordable housing since the community life/senior
center did not get the necessaryapprovals. The plan called for the rectory and the school to be
preserved,with construction of one new building on the site.
I agree with you that it is a great site in a great locationand that redevelopment is very important
for the neighborhood. Pleasecall me if you have any other questions.

I would first like to say I have noticed a marked improvement at 9 Cherry. I am assuming it is
because they complied with the request to fix the problem.
The reason I am writing today is because of a trend that is flaring back up at 12 - 14 Cherry. It would
be extremely disappointing if things were set back to square one, and the meeting between Mr. Quill and
the city was all for not.
One of the two dumpsters that Robbie George donated to Mr. Quill has been left on the curb since
030708 (for over 2 pickup cycles). If you recall, Mr. George donated two of them and specifically asked
that they be kept behind the property, and that no construction materials were to be placed in them,etc.
It appeared that someone began throwing large furniture items(framing, springs, couch cushions,
etc.)into one of them this past Wednesday (031208). Figuring this might have been the purpose for
leaving it out, I didn't report. However, the dumpster has remained out there, even until now. It is full
of rubbish and large pieces of broken furniture, with other scattered trash around it. In addition,the
remaining pieces of the broken furniture has been dumped next to the porch, and even thrown out onto
the 2ND story balcony.
My neighbor called Mr. Quill this past Friday, and told him that he would like to give him the
opportunity to correct the problem himself. This was because Mr. Quill had once, specifically, asked
him to do so before contacting the authorities. Needless to say,the request was seemingly ignored.
Since contacting him has yields no result, I am reaching out to your department for assistance again.
It would be greatly appreciated if you could remind Mr. Quill, by any means you deem necessary, of

Dear Mr. Quill:
In accordance with Chapter II of the State Sanitary Code, 105 CMR 410.000, Minimum Standards of
Fitness for Human Habitation, a recent reinspection was conducted of your property located at 16 Cherry
Street#2, conducted by David Greenbaum, Sanitarian of the Salem Board of Health on August 31,
2007. At that time the following items were still outstanding:
Item#10: The Back door and Screen door are disrepair and are not weather tight. Repair doors
to good working order to be weather tight and open and close freely.
Item#11: The back exterior door has no lock. Provide a lock on this door.
Item#13: The second floor back hall is obstructed. No egress can be used for storage. All items
in the back hall must be removed.
Please note that temperature requirements could not be checked and the tenant was informed to
notify the Board of Health if there is no heat during the heating season.

A recent visit by both the Health Dept. and the Building Dept. revealed
enough violations to warrant a closer inspection of this property. Access to all
areas of this property will be required.
Under the provisions of 780 CMR, Section 115.6, State Building Code, access to
this property must be granted for the purposes of inspection. Please call this office upon
receipt of this letter to schedule this required inspection. If this property has rental units
these tenants must be notified in advance ufthis inspection, so that access to these
spaces may also be accomplished.
This inspection must be completed on or before August 10, 2007; failure to respond to
this notification will be construed as non-compliance, and as such an Administrative Search

Dear Mr. Quill;
The Salem Board of Health has received many complaints regarding the handling of trash on
Cherry Street. We have conducted subsequent inspections and have observed multiple
violations of the trash regulations. These violations include the following:
• Trash not stored in rodent-proof containers
• Loose trash stored at the sides of buildings
• Loose trash placed out for municipal pick-up
• Wind blown trash not being picked up by those responsible
Following up on trash concerns at Cherry Street has been taking too many of the Board's
resources. Therefore, we invite you and other Cherry Street property owners to a meeting to
discuss more lasting, long-term solutions to the trash issues.
This meeting will take place on Tuesday, April 24th at 10.30, in the 3rd Floor Conference Room,
120 Washington Street.

I just wanted to thank you for arranging the meeting with the landlords of. 11 -
13, and 12 - 16 Cherry Street. For my wife and I, it was a morning well spent. I
truly hope that your input and instruction will motivate the landlords to take the
proper corrective actions to address the waste issues with their properties.
You have been more than fair in dealing with these landlords. And although I
cannot speak for them, I would hope that they could see and appreciate your
willingness to help them solve the problem this way.
I truly appreciate your words of support—towards my wife and 1—during he
meeting. Thanks, most of all, for setting aside the time to address this issue.
