On Friday December 28�', I was asked to Join Salem Fire Prevention<Fire Marshall Gallant, at your property.
A quick inspection revealed that workmen had disconnected the Fire alarm system in the Building. This is a
violation of the Mass Fire Laws and falls within the jurisdiction of the Fire Department. Additionally, there
were no Carbon Monoxide detectors,numerous wiring violations,numerous Building Code violations as well as
the fact that the building,s central heat was not working. At this point `I am removing the Occupancy Permits
for the building. The building is not to be occupied until all code violations are corrected and all Inspections
have been conducted. These include, Building,Plumbing, Fire Prevention and Health.
If you feel you are aggrieved by this action,your Appeal is to the Board of Buildings, Regulations and
Standards in Boston. If you have any questions, please contact us directly.

2-Storied Residential building with 3 Rental units, owner's office, and an
unoccupied commercial space at 1 st floor, and basement.
Per 2009 IEBC Section 104.2.1.1 I have done a walk-through of the basement, all 3 rental units,
office area, commercial space, and public halls. My evaluation follows below:
1 hr Fire Rated Separation:
Ceiling of 1st floor commercial space must have a lhr fire rated separation. At this time there
are ceiling holes or just tin ceiling. I recommend completing all electrical work and fastening
2x4's over the existing tin ceiling to allow space for wiring below existing ceiling. Subsequently
install 3/4" wood strapping at 16" o.c. and 1 laver 5/8" Type X fire code
gvosum board on wood strapping--over entire ceiling. Soffits may be installed at dropped
beams using same layer of 5/8" Type X gypsum board.
NOTE THAT YOU MUST APPLY FOR A BUILDING PERMIT TO DO ANY WORK
Egress Signs:
Lighted"EXIT" signs have been installed.
Emergency Hall Lights:
Hard-wired Emergency lights with back-up battery packs have been installed.
Public Hall Railings & Ballustrades:
One railing is still contrary to code. It is inturupted by a vertical post and appears, partly, to
be a 2x4 that is too large to hold. Railings that prevent continuous sliding of hands must be
removed and replaced with a railing of 11/2" diameter with 11/2" space between railing
and wall. Railing should be 34" to 36" above the nosing of stairs
Smoke Detectors and Carbon Monoxide Detectors:
In one apartment unit there is no Carbon Monoxide Detector within 10 feet of a bedroom.
This must be remedied with the installation of one more Carbon Monoxide Detector.

Apartment doors have non-approved locking devices called "SLIDE BOLTS". These
SLIDE BOLTS must be removed. Night Chains can exist but must be installed within 34" to
48" above finished floor per 2009 IBC Code Section 1008.1.9.2
Per 2009 IBC Code Section 1008.1.9.3.4 "approved locks & latches" can be "night latches,
dead bolts, or security chains". Slide bolts, door bars, or any device that takes a key, tool, or
two actions to release it are not approved and must not exist on doors.

the public hallway's indicating the direction of egress.

A few existing smoke detectors appeared old to me due to style, dust encrusting, and aged
discoloration of plastic. These smoke detectors shall be replaced. Carbon Monoxide detectors
shall be placed within 10 feet outside bedroom doors. In most cases Carbon Monoxide detec-
tors are placed inside bedrooms. Owner shall confer with electrical inspector to determine if this
placement location is acceptable. The first floor studio apartment there seemed to be no smoke
detector or Carbon Monoxide Detector in the main room.

there are many holes in the plaster of the ceiling. I recommend completing electrical work,
removing all metal ceiling tin, and fastening 5/8" Type X fire rated gypsum board to the ceil-
ing where there are holes in the plaster. Metal ceiling is not proper fire separation alone. Only
gypsum board or existing plaster is allowed.
Knox Box Key Holder:
Outside of the main entry door there must be a Knox Box key holder installed to make an
entry key available to the Fire Department in the event of emergency. Key should be outside
door were there is the fire alarm panel.
Stair Hall Head Height:
Hall Head Height on stair is Existing/Non-Conforming at 5'-5". Though not required for a
Certificate of Occupancy at this time I suggest increasing the head height to 6'-8" in the future.
As the stair header seems to be part of a stuctural bearing wall I recommend that an Architect or
Engineer be hired by the owner in the future to analyse the building and make a drawing
showing a new structural header and vertical supports.

Dear Mr. Cerullo,
You have asked about the status of an occupancy permit for the building at 122 Boston Street. I issued a letter
on January 212015, in which I removed the Occupancy of the entire building. The letter included my
requirements for the owner,Trinh Ma, to complete before an occupancy permit would be issued. We also
posted the Building with a legal notice revoking the Occupancy Permit.
In late April „ I was informed that the building was again being occupied. I visited the property and informed
the owner that she was in violation of Mass State Building Code and again referred to my previous letter which
had the requirements necessary to obtain an Occupancy Permit . Since that time ,the owner did hire an
Architect to do a code review and that document was produced by Architect Paul Lessard and was received on
May 5°i of this year.
To date no Building permit has been pulled , no Building inspections have been conducted and the building
remains illegally occupied.

Per 2009 IEBC Section 104.2.1.1 1 have done a walk-through of the basement, all 3 rental units,
office area, commercial space, and public halls. My evaluation follows below:

2x4's over the existing tin ceiling to allow space for wiring below existing ceiling. Subsequently
install 3/4" wood strapping at 16" o.c. and I laver 5/8" Ulle X fire code
gypsum board on wood strapping over entire ceiling. Soffits may be installed at dropped
beams using same layer of 5/8" Type X gypsum board.
NOTE THAT YOU MUST APPLY FOR A BUILDING PERMIT TO DO ANY WORK.
Egress Signs:
Lighted "EXIT" signs have been installed.
Emergency Hall Lights:
Hard-wired Emergency lights with back-up battery packs have been installed.
Public Hall Railings & Ballustrades:
One railing is still contrary to code. It is inturupted by a vertical post and appears, partly, to
be a 2x4 that is too large to hold. Railings that prevent continuous sliding of hands must be
removed and replaced with a railing of 11/2" diameter with 11/2" space between railing
and wall. Railing should be 3411 to 36" above the nosing of stairs,
Smoke Detectors and Carbon Monoxide Detectors:
In one apartment unit there is no Carbon Monoxide Detector within 10 feet of a bedroom.
This must be remedied with the installation of one more Carbon Monoxide Detector.

Door locking devices:
. Apartment doors have non-approved locking devices called "SLIDE BOLTS". These
SLIDE BOLTS must be removed. Night Chains can exist but must be installed within 34" to
48" above finished floor per 2009 IBC Code Section 1008.1.9.2
Per 2009 IBC Code Section 1008.1.9.3.4 "approved locks & latches" can be "night latches,
dead bolts, or security chains". Slide bolts, door bars, or any device that takes a key, tool, or
two actions to release it are not approved and must not exist on doors.

A hearing on this petition was held on October 27, 1982, with the following Board Members
present: James Hacker, Chairman; Messrs. Hopper, Feeherry and Associate Member Luzinski.
Notices of the hearing were sent to abutters and others and a notice orf the hearing,yas
published in the Salem Evening News in accordance with Massachusetts General Laws - "r'"'�
Chapter 40A.
The Petitioner has requested a variance to use a portion of the first floor
of the premises for a one-bedroom apartment. A variance is required because the property
is in a B-2 zoning district where residential dwellings are prohibited.
The Board of Appeal, after consideration of the evidence presented at the
public hearing and after viewing the property makes the following findings of fact:
1) Petitioner's proposed use of the property for a third residential unit
will have no adverse effect on the area.
2) Petitioners proposed use of the property was unopposed by his abutters.
3) Petitioner intends to use this residential unit as a low-income rental unit under
a HUD program. The proposed use of the property will thus add a much needed rental unit to
Cthe city's stock of low-income housing.
On the basis of the above findings of fact, and the evidence presented at the
public hearing, the Board of Appeal concludes as follows:
1) The property in question is unique because of its present mixed use which limits
its use for business.
2) The conditions described above especially affect the land in question
but do not generally affect the zoning district in which the land is located.
3) The conditions described above which affect the land in question, but not
the zoning district generally cause the following special hardship: unless
a variance is granted, it will be virtually impossible to use .the property for business
purposes.
4) The desired variance may be granted without substantial detriment to the public good.
Therefore the Board of Appeal unanimously voted in favor of granting the requested relief.
The Board granted a variance to the Petitioner on the following terms:
1) A variance is granted to allow use of one half of the first floor of the site, in
accordance with plans submitted to the Board, as a one bedroom residential apartment.
2) Petitioner shall obtain a Certificate of Use and Occupancy prior to using this third
( residential unit at the site.
3) Petitioner shall submit adequate plans to the Building Inspector in connection with
his building permit application.

Hearing on this petition was held on February 24, 1976 with Chairman John M.
Gray Sr. , and members Jane T. Lundre,�an, William Abbott, Arthur LaBrecque and
Associate Member Donald Eames present. Notices were duly mailed to .abutters and
others in accordance with Massachusetts`Law..: Chapter 808. .
Atty. Robert Ledoux appeared for the petitioner. He stated that Mr. Lumbard purchased
the property in 1975. The property had formerly been used for storage. The
building is brick and there is ample narking in th^ yard for two apartments. The
attorney submitted a petition from the abutters in favor of the petition. Councillor
Grace appeared in favor. There was no opposition. The premises in question have
been used for a number of years both for offices and storage, and qualify as a
non-conforming use in both a B-2 and R-2 Zone, There are a number of two family
houses located on both Beaver Street and Boston Street.
The Board voted unanimously to grant the Special Permit requested by the petitioner.
The Board found that the conversion of the property to two studio apartments would
be an asset to the neighborhood because it would result in the rehabilitation of
the building which is presently in disrepair. The neighborhood in which the
building is located is predominately residential, and therefore the Board further
found that the proposed use was appropriate to the surrounding neighborhood,
Appeals from this decision, if any, should be made pursuant to Chapter 808, Section
17 and shall be filed within 20 days after the filing of this notice in the. office
of the City Clerk.

Dear Mr. Lumbard:
This department has been involved with your building for about 10 months. Initially,
work was being done without any building permits.
As you are aware, building permits were pulled to finish the work that was started. Our
plumbing inspector, Dennis Ross, instructed your contractor to have a licensed plumber
look at the work that had been done prior to permits being issued.
The plumber notified the contractor the asbestos had been disturbed in the area where the
rr_ code_defieient pl mbrng,had_been d_on_e.
He currently refused to do any work until the asbestos was handled properly according to
D.E.P. regulations.
At this point, I have notified the northeast D.E.P. of this condition.
No further work is to be performed in this building, until this situation is corrected. (780
CMR, Section 119 Stop Work Order)
You are directed to contact this office and the Salem Board of Health immediately upon
receipt of this letter.
Failure to comply with these orders will result in a complaint being filed in Salem
District Court.
