In response to a complaint frau the Salem Police regarding your property
located at 1222 Boston Street, I investigated the complaint with the following
findings.
1. The front door was unlocked.
2. The rear door was unlocked.
3. The cellar door was open and a large amount of wood and paper at the bottom
of the stairs appeared to be a fire hazard.
4. The building appears to be vacant.
5. The building is located in a highly congested area.
In view of the above, as permitted by Section 123. (unsafe structures) of the
Mass State Building Code, 780 CMR, I am ordering you by twelve o'clock noon of the
day following your receipt of this notice to make the building secure from un-
authorized entry.
Should you fail to comply with this order, it is my intention to request that
the Mayor order this building a hazard to the public safety and to secure and place
a lein on the property as provided in Section 123.2 of the State Building Code.

Dear Mr. LeBlanc:
Due to complaints received at this office, an inspection was made at the
above referenced property.
On October 10, 1990, an investigation was conducted with the Assistant
Plumbing Inspector, Dennis Ross and yourself. Upon inspection, it was noted
the street side foundation stone wall was deteriorating and had bowed severely
against the existing gas main.
This is a violation of the Massachusetts State Building Code, Section 123.
(Unsafe structures) . This is a dangerous situation and requires immediate
attention. The building code states the following.
Anyone who shall violate a provision of this code shall be punishably by
a fine of not more than one thousand (1,000) dollars or by imprisonment
for not more than one year, or both for each violation. Each day during
which any portion of a violation continues shall constitute a separate
offense.
You have until 12:00 noon on the day following receipt of this letter to
begin the necessary repairs. Failure to comply with this notice will result in
this office taking legal action.

A hearing on this petition was held October 15, 1935 with the following Board
Members present: James Hacker, Chairman; Messrs. , Fleming, Luzinski, Strout and
Associate Member Labrecaue. Notice of the hearing was sent to abutters and others
and notices of the hearing were properly published in the Salem Evening News in
accordance with Massachusetts General Laws Chapter 40A.
Petitioner, owner of the property, requests a Special Permit to allow an existing
five family dwelling and to extend nonconforming front setback to allow corstruct.iop_,,,

The Board of Appeal, after hearing the application read by the Acting Secretary,
James Fleming, makes the following findings of fact:
1 . Neither the petitioner nor any representative for the petitioner
was present at the hearing.
On the basis of the above finding of fact, the Board of Appeal concludes as
follows:
i . There was no evidence presented or pians available to enable
the Board to grant the petition.
Therefore, the Zoning Board of Appeal voted unanimously, 5-0, against granting the
Special Permit and variance requested.

We have received a written complaint regarding the above
referenced property . It is apparent from our site visit today
that an exterior staircase has been constructed without a
building permit . As you are aware the Board of Appeals denied
your petition for this means of egress , October 15 , 1986 .
Under section 121 . 0 of the Mass . State Building Code there
are provisions to fine or imprison anyone who shall violate any
parts of the code .
Please contact this office within seven days from receipt
of this letter to resolve this matter .

Sir:
On April 9, 1986 I inspected the property at #1222 Boston Street for the purpose
of the issuance of. a Certificate of Compliance in accordance with the provisions
of Chapter 148, of the Massachusetts General Laws as provided in Section 26E and/or
'Section 26F. The following violations and/or discrepancies were noted:
1- At one point an ate an oil burner was installed on this property without the
inspection and r val of the Salem Fire Department'.
Violation of thechusetts Fire Prevention Regulation 527-CMR-4.00.
2- No boiler room. Vi a ion of the Massachusetts Building Code 780-CMR-1105.0
3- No secondary means x't from apartment #4. Violation of the Massachusetts
Building Code 780-CMR
4- All smoke detectors in nt#2R were either missing and/or not working.
Violation of Massachusett eneral Law Chapter 148, Section 26E.
The Salem Fire Department will not issue a compliance for this property until
such time that all related departments namely Health and Building report to this
Bureau that all items have been corrected.
