This use may continue. However, the property is located in the B-2 district which prohibits residential uses and the minimum lot size in a B-2 district is 12,000 square feet. Article VIII, Section 8-3 of the City of Salem, a copy of which I have enclosed, clearly states that no nonconforming structure in the City can be rebuilt except in conformance with today's zoning requirements. To rebuild this structure, should it be destroyed more than fifty (50%) percent would require action from the City of Salem Zoning Board of Appeal, it would also require a Variance with regard to the residential use.
