An application is being submitted to the Board of Appeals for the following reason(s):
Special Permit under Section 3.3.5 required to extend and alter an existing 1-family structure located in the R-2 Zoning District by
removing and rebuilding a portion of the existing building,and constructing a proposed
2-story addition,and a raised patio, all as shown on the plans submitted. The reconstruction and addition to the structure will be to
provide a new kitchen,dining room,kitchen/living room,and powder room to the first floor,and a master bedroom suite with bath,master
closet,master bath and dressing room on the second floor,all as laid out in the plans by Pitman&Wardley Associates Architectural
Design,as submitted. There is also a 1-family dwelling on the property on the second floor the existing carriage house,which is a
separate structure from the applicant's dwelling.
For this reason,I am requesting:

The Undersigned hereby petitions the Board of Appeals to vary the terms of the Salem Zoning Ordinance and allow the project to be
constructed as per the plans submitted,as the enforcement of said Zoning By-Laws would involve practical difficulty or unnecessary
hardship to the Undersigned and relief may be granted without substantially derogating from the intent and purpose of the Zoning
Ordinance.

The proposal will allow the owner to upgrade the residence and its facilities in compliance with
current building and safety codes and a more spacious floor plan. There are no additional dwelling
units being proposed, and the structure will remain single-family dwelling. The addition will not
increase the building height in feet or stories.
Petitioners seek approval of a Special Permit under Section 3.3.5 (Nonconforming Single-
and Two-Family Residential Structures), which provides that
"... In the event that ...the nonconforming nature of such structure would be increased by the
proposed ... extension, alteration or change, the Board of Appeals may, by special permit, allow
such ... extension, alteration of change where it determines that the proposed modification will not be
substantially more detrimental than the existing nonconforming structure to the neighborhood."
This applicant's proposed modification will not be substantially more detrimental than the
existing structure to the neighborhood, based upon the following criteria:
The social, economic and community need to provide improved, code compliant and safe family
housing is served by this proposal;
Traffic flow and safety are unaffected because, under this proposal, there are no additional
dwelling units being added, and there is adequate existing parking, so no adverse effects
should occur as to traffic or parking;
Adequate utilities and public services already service the property;
Impact on the natural environment and drainage are unaffected, as the plans maintain
significant landscaping improvements, and relatively little additional roof area is being added
to the structure;
The historic design and fabric of this historic structure are being preserved, as evidenced by
the plans and elevations by Pitman & Wardley as filed, and the " Conceptual Approval
Certificate of Appropriateness" for this proposal and Plans issued by the
Salem Historical Commission, dated September 1, 2021, a copy of which is filed with
this application.
The proposed improvements will certainly increase the assessed value of the property and
future increased real estate tax revenue, which will have positive fiscal impact
benefiting the City of Salem. The construction will also provide additional jobs in the City
during the construction.
