TO THE BOARD OF APPEALS:
The Undersigned represent(s)that they are the owner(s)of a certain parcel of land located at:
Address: 12 LAUREL STREET Zoning District: R2
An application is being submitted to the Board of Appeals for the following reason(s):
The proposal is to construct a 2-story dwelling unit behind the existing residence and connected to it by
a Covered breezway. This is an existing single-family dwelling sitting on a lot which is nonconforming as to both frontage and lot
area, and is located in the R-2 Zoning District. The application will result in 2 connected dwelling units, which is an allowed use in the R-2
District, but will result in a dimensional nonconformity because there will be only 6,519 SF of lot area per dwelling unit, where the
Ordinance requires 7,500 SF per unit.
The addition will be a 2-story structure with a footprint will be about 38'x 22'. A covered breezeway will connect it to the original
structure,as shown on the Plans by Seger Architects, Inc. dated Mach 30,2022,as submitted. Four compliant parking spaces will be
provided on-site,as shown by the Zoning Board of Appeals Plan prepared, certified and signed by Gail Smith of North Shore Survey
Corporation, which exceeds the 3 spaces required.
For this reason,I am requesting:
[]Variance(s)from provisions of Section of the Zoning Ordinance, specifically from.
true A Special Permit under Section Section 3.32.5(3)(Nonconforming Single-and Two-Family Residential Structures of the Zoning
Ordinance in order to Theapplicant seeks approval to aleter and enlarge the existing structure and single-family use by constructing a
second dwelling unit on this nonconforming 13,035 SF lot, which will not contain the required 7,500 SF of lot area per dwelling unit.
[_)Appealing a Decision of the Building Inspector:
[I Comprehensive Permit:
Current Property Use: 1-family residence Are Lot Dimensions Included:Yes
The Undersigned hereby petitions the Board of Appeals to vary the terms of the Salem Zoning Ordinance and allow the project to be
constructed as per the plans submitted,as the enforcement of said Zoning By-Laws would involve practical difficulty or unnecessary
hardship to the Undersigned and relief may be granted without substantially derogating from the intent and purpose of the Zoning
Ordinance.
Statement of Hardship(for Variances):
Statement of Grounds(for Special Permits):
This enlargement of the structure and use are no more detrimettntal to the neighborhood that the existing use because:
a,the proposed 2-family use is allowed in this District, and the City's social and economic need for additional safe and code compliant
housing is met by this proposal.
b.the applicant will provide 4.on-site parking spaces for the occupants, which exceeds the 1.5 spaces per dwelling unit required by the
Ordlnanca.'There la more then than sufficient turn-around space for each parking apace,so no driver will need to back out onto Laurel
Street;the line-of-site up and down Laurel Street Is good in both directions,so there should be should no traffic hazard for vehicles
entering or exiting the site,or to traffic an Laurel Street,
c. all necessary public utility services already serve the site.
d. after the construction, the structure will cover only 17.4%of the lot area, leaving most of the large yard area open,so there should be
no significant negative impacts to the natural environment or drainage.
s. The proposed 2-family residential use is consistent with the existing character of the neighborhood. There will no significant changes
to the existing structure, and the architects have carefully designed the new addition to maintain the some height, scale and exterior
shape to be consistent with, and complimentary to the existing structure,so this proposal should have no negative Impact on the
neighborhood character.
f, adding the additional dwelling unit will Increase the assessed value of the property, and Increased real estate tax revenue will be paid
to the City annually. The construction of the addition will also provide at least temporary new jobs In the community,
