J DATE: November 16, 19999 RE: Salem's Flynn Tan DemolAsbestos Project I've done some scouting on costs for removal of asbestos containing materials (ACM) Involving window caulking and roof flashing. The particular materials and the physical removal requirements for the material (such as scaffolding, removing and disposing of entire window with caulking, etc.) can significantly impact the costs. I talked to Covino Assoc. an asbestos removal consultant. I also considered that on the Rates School Project the contractor bid $10 per linear foot for removal of ACM caulking. Assuming the contractor is removing and disposing of the window and caulking together, Covino quoted a price of$100 per window as being typical. 1If only the ACM caulking around the window is to be removed, bids can range from $5-$10 per linear foot. Assuming a 6X4 window, that translates into 20 linear feet X$5 = $100 per window, or 20 linear feet X$10 = $200 per window. Under either estimating approach the $80 per window quoted by RIS sounds quite reasonable. For the removal and disposal of ACM roof flashing materials, Covino quoted a price of between $7 -$10 p.s.f. RIS' price of$5,50 p.s.f. sounds quite reasonable. If the City wants better pricing information, you could consult directly with an asbestos removal consultant who could give you a much firmer quote based on the ACM materials in question and the procedures required to remove them. Please feel free to call if you have any questions. Oppenheim Regional Industrial Services Corporation 79 Hixon Street Bellingham, MA 02019 Dear Mr. Oppenheim: Thank you for your letter of October 16, 1999 to Mr. Peter Strout, Director, Public Property regarding Asbestos Abatement of the Flynn Tan Building. In your letter you requested an additional $43, 800.00 for work you have declared as unforeseen the removal of flashing from the roofs and window glazing material, both categorized as hazardous material. The City of Salem disagrees with your interpretation of unforeseen pertaining to your request for an additional $43,800.00. The Bid Specifications explicitly calls for the removal of"any hazardous debris." See Bid Specification—Demolition of Flynntan Building, 19. It is my understanding that your subcontractor did attend the site inspection for preparation of the bid on this contract. It is the City of Salem's position that the roof flashing (adhesive) and the window glazing are"those ordinarily encountered and generally recognized as inherent in work of the character provided for in the plans and contract documents." See Mass. Gen. L. c. 30, § 39N. See also generally, Glynn v City of Gloucester, 9 Mass. App. Ct. 454 (1980)(discussing generally change order in public construction projects). According to the terms set forth in the contract documents, you are responsible for removal, disposal and took ownership of all hazardous material when you signed the contract. Moreover, with the experience demonstrated in your Certificate of Eligibility, the age of the building and the material being in your sight during the site visit, you had an opportunity to address the issues you are requesting additional funds for. Box 194 North Reading, MA. 01 864 Dear Paul, I just wanted to take a few minutes to tell you how pleased I am with your responsiveness at the Maine Mall Project. As with any renovation or demolition work, there always seems to be surprises. When we found them in the wall between the tenant spaces, Jim O'Connor immediately addressed it with the mall operations people and the Architect. I commend you and your staff for always taking the extra care to check things out before acting and causing more problems. It is this kind of service and professional approach to any task you do that keeps S.R. Weiner calling on American Environmental when ever we need a quality abatement contractor. Your company came highly recommended by Al Rocco, our Director of Community Centers for the smaller projects you helped him with. When we used American for the abatement at The Hanover Mall Renovations you proved you could also handle the big jobs too. Your staff brought solutions to tough problems and even the CM was impressed with the speed and cleanliness of your operation. Since that time I have had the opportunity use American Environmental for three additional projects and would be pleased to recommend them for others. In fact, please feel free to use my name ( or this letter) as a reference to future clients. I am confident that after working with a team like Jim, Pat and yourself, other developers and property owners will also share my appreciation. Thanks again to everyone for their help and I look forward to the next job together.
