dwelling and appurtenant grading at 79 Almeda Street in the City of Salem, with
the following conditions:
1) The design proposal concur with the City Engineering Department and City
Plumbing Inspector for utility tie-ins for drinking water, sanitary waste
(sewage), gas lines, and/or any other utility service.
1A) Measures be taken to assure that the extention of the drinking water lines
do not create a negative or low pressure situation.
2) Employ an acceptable method for removal of all construction debris, and any
unacceptable excavation material from the site during construction.
3) Employ an acceptable method for dust and street cleaning control during site
construction and submit a copy of the method utilized to the Health and Planning
Departments in writing.
4) Prior to site start-up and also during site construction employ a licensed
pest control firm for site evaluation and service with a copy of the service
program sent to the Health and Planning Departments.
5) All backfilling be done in accordance with good engineering practices to
prevent future damage to all underground utilities.

B. In the Wetlands District, a determination by a qualified engineer
of the seasonal high water table, performed during the last two
weeks of March or the first three weeks of April. A minimum of
two percolation tests for each leaching area shall be performed.
C. In cases of flood -proofing or pile construction, certification
by a registered professional engineer or architect as to the
elevation of flood -proofing measures and as to compliance with the
applicable sections of the Massachusetts State Building Code
concerned with flood depths, pressures, velocities, impact and
uplift forces, and other factors associated with the base flood.
Where specific methods or techniques have been previously certi-
fied, the Planning Board may waive this requirement.
D. A list of Federal, State, and other local permits required by the
applicant.
E. Descriptions relative to all conditions applicable in Section III
below.
III. Conditions (Complete those sections indicated (X) by the Building Inspector)
In the Wetlands and Flood Hazard Districts no structure or building,
including pipes and wells, shall be erected, constructed, substantially
improved, enlarged, or otherwise created or moved; no area shall be
paved, no earth or other material shall be stored, dumped, used as
fill, excavated, or transferred; and no sediment shall be caused to
be discharged from or onto a wetland, unless all the following condi-
tions are found to exist as part of the granting of a Special Permit by
the Planning Board (Use additional pages if necessary):

IV Procedure
The Planning Board shall, within 7 days after the filing of this
application, transmit one copy of said application, plans and all other
submitted information to the Inspector of Buildings, City Engineer, Board
of Health and Conservation Commission who may, at their discretion,
investigate the application and report in writing their recommendation
to the Planning Board. The Planning Board shall not take final action
on such application until it has received a report thereon from the
Inspector of Buildings, City Engineer, Board of Health and Conservation
Commission or until thirty-five (35) days have elapsed after dis-
tribution of such application without a submission of a report. The
Planning Board Shall hold a Public Hearing on said application as soon
as possible after receiving the above reports, in accordance with
Chapter 40A of the Massachusetts General laws. The Planning Board
shall notify the applicant in writing of its decision on the special
permit. The decision shall document the proposed development or use
and the grounds for granting or refusing the special permit. The
Planning Board may, as a condition of approval, require that the appli-
cant give effective notice to prospective purchasers, by signs or
by recording the special permit at the Registry of Deeds, of the wet-
land or flood hazard conditions associated with said premises and the
steps undertaken by the petitioner or his successgr in title,to
alleviate the effects of same.

On -Thursday, January 9, 1986, the Planning Board of the City of Salem
held a public hearing regarding the application of Mr. Stanley Mikulski
for a Special Permit under Section P, Wetlands and Flood Hazard
Districts, of the Salem Zoning Ordinance, with respect to the
construction of two single—family residences on Almeda St. adjacent to a
wetland area.
At a regularly—scheduled meeting of the Planning Board held on
Thursday, January 23, 1986, the Board voted, by a vote of six in favor,
none opposed to approve the application as complying with the
requirements for the issuance of the Special Permit with the following
conditions:
1. All work shall conform to plan entitled, "Plan to Accompany a Notice
-.of Intent", prepared by Hancock Survey, dated November 27, 1985, revised
,December 16, 1985.
2. Conditions set forth in Order of Conditions #64— issued by Salem
Conservation Commission dated November 27, 1985, revised December 16,
1985, shall be strictly adhered to.
3. A plan showing utility installations for each structure shall be
supplied to the Planning Department and Engineering Department for
approval prior to issuance of a building permit

Therefore, the Commission hereby finds that the following conditic
necessary, in accordance with the Performance Standards set forth in the regulations, to protect those inter-
ests checked above. The Commission orders that all work shall be performed
in accordance with said conditions and with the Notice of Intent referenced above. To the extent that the fol-
lowing conditions modify or differ from the plans, specifications or other proposals submitted with the Notice
of Intent, the conditions shall control.
General Conditions
1. Failure to comply with all conditions stated herein, and with all related statutes and other regulatory meas-
ures, shall be deemed cause to revoke or modify this Order.
2. This Order does not grant any property rights or any exclusive privileges; it does not authorize any injury
to private property or invasion of private rights.

4. The work authorized hereunder shalt be completed within three years from the date of this Order unless
either of the foflowing apply:
(a) the work is a maintenance dredging project as provided for in the Act; or
(b) the time for completion has been extended to a specified date more than three years, but less than
five years, from the date of issuance and both that date and the special circumstances warranting
the extended time period are set forth in this Order.
'5. This Order may be extended by the issuing authority for one or more periods of up to three years each
upon application to the issuing authority at least 30 days prior to ttie expiration date of tha Order.
6. Any fill used in connection with this project shaii be clean fill, containing no trash, refuse, rubbish or de-
bris, including but not limited to lumber, bricks, plaster, wire, lath, paper, cardboard, pipe, fires, ashes,
refrigerators, motor vehicles or parts of any of the foregoing.
7. No work shall be undertaken until all administrative appeal periods from this Order have elapsed or, if
such an appeal has been filed, until all proceedings before the Department have been completed.
8. No work shall be undertaken until the Final Order has been recorded in the Registry of Deeds or the land
Court for the district in which the land is located, within the chain of title of the affected property. in the
case of recorded land, the Final Order shall also be noted in the Registry's Grantor Index under the name
of the owner of the land upon which the proposed work is to be done. In the case of registered land, the
Final Order shall also oe noted on the Land Court Certificate of Title of the owner of the land upon which
the proposed work is to be done. The recording information shall be submitted to the Commission
on the form at the end of this Order prior to commencement of the work.
9. A sign shall be displayed at the site not less than two square feet or more than three square feet in size
bearing the words, "Massachusetts Department of Environmental Quality Engineering,

On Thursday, April 189 1991, the Salem Planning Board held a public hearing under
Section VII -P Wetlands and Flood Hazard District Special Permit of the City of Salem
Zoning Ordinance for the construction of a single family dwelling at 79 Almeda Street,
within a wetland buffer zone.
At a regularly scheduled meeting of the Planning Board held on April 18, 1991, the
Board voted by a vote of seven in favor, none opposed, to approve the application as
complying with the requirements of a Special Permit, subject to the following conditions:
Conformance with Plan
Work shall conform to plan entitled "Plan of Land to Accompany a Notice of Intent,"
prepared by Hancock Survey Associates, Inc., dated March 25, 1991.
2. Conservation Commission
All conditions set forth in Order of Conditions #64-196 issued by the Salem
Conservation Commission, dated April 11, 1991, shall be strictrly adhered to.
3. Board of Health
Board of Health requirements stated in a letter dated April 11, 1991, shall be
strictly adhered to.
4. Construction Practices
All construction shall be performed in accordance with the Rules and Regulations of
the Planning Board, and in accordance with any and all applicable City of Salem
regulations.
Posting
Planning Board and Conservation Commission approvals shall be posted in a visib e
location on the site throughout construction.
6. Violations
Any violations of these conditions shall result in revocation of this permit by the
Planning Board.
I hereby certify that a copy of this decision and plans have been filed with the City
Clerk and copies are on file with the Planning Board. The Special Permit shall not take
effect until a copy of this decision bearing the certification of the City Clerk that twenty
(20) days have elapsed and no appeal has been filed or that if such appeal has been filed,
and it has been dismissed or denied, is recorded in the Essex County Registry of Deeds and
is indexed under the name of the owner of record or is recorded on the owner's Certificate

Hazard District, Salvatore Orlando, Applicant
RE: Special Permit Application dated March 22, 1991 (and support-
ing plans and documents) filed by Hancock Survey Assoc., Inc.
I have reviewed the above -referenced Special Permit Application
for work to be done in the buffer zone of the Wetlands District at
79 Almeda Street (Assessors' Map 15, Parcel 433) by Salvatore
Orlando, including a "Plan of Land to Accompany Notice of Intent,"
prepared by Hancock Survey Associates, Inc., 2 Electronics Avenue,
Danvers, Massachusetts on March 25, 1991, and find the following
discrepancies that should be addressed before your Board completes
its review:
1) Proposed contours at elevations 82 through 90 are
shown extending onto the abutting property of Frank
Lento et al (Lot 199 on accompanying utility plan/pro-
file). If an easement has been obtained for such fill
and embankment grading operations, the limits of the
easement should be defined on the plan. If the abuttors
have not been approached to obtain such easement, the
plan as proposed should be revised. Note #2 on the plan
describes proposed grading as "...an as -built condition
not verified in detail by field survey." Before you can
reasonably be expected to approve this application, the
applicant's surveyor should determine the existing con-
ditions and reflect both them and real proposed contours
(within the locus parcel) on the plan.
2) The area described as "proposed bituminous concrete
driveway" in the right-of-way of Almeda Street, curving
off the end of the area described as "existing edge of
pavement," is not acceptable, as it constitutes a drive-

way extension of (and within) an existing paved way.
The paved portion of Almeda Street should be extended
(using approved depth of base course and pavement) to
opposite the southerly sideline of the lot being
improved, with a "Tee turn -out" (bituminous concrete
paved) provided for turning around snowplows and
emergency vehicles such as fire engines and ambulances.
Alternatively, the proposed dwelling should be relocated
to the northern side of the lot, and the "Tee turn -out"
added to the end of the existing street beyond the
driveway into the lot, in such a manner that the
driveway traffic patterns do not interfere with the
turn -out traffic patterns.
3) The proposed embankment slope in the rear yard of
the proposed dwelling is 2:1 (2 horizontal:l vertical),
with a height of proposed embankment of ten (10') feet.
Means of stabilizing such embankment immediately during
and after its construction, as well as permanently, to
prevent erosion and wash-out of same into the bordering
vegetated wetlands, should be clearly described on the
plan (under "NOTES") and in the Special Permit Applica-
tion. The "Soil Survey of Essex County, Massachusetts,
Southern Part" describes soils in this vicinity as Chat-
field -Hollis -Rock outcrop complex, 15 to 35 percent
slopes (CrD), which are generally quite shallow and ex-
cessively drained in this area. Fill over such soils
must be of a relatively excessively -drained nature to be
compatible with the natural underlying soils, and vege-
tative ground slope protection and temporary slope pro-
tection should be planned for the dry conditions which
will naturally result from such subsurface conditions.
4) While the plan reviewed carries the name of the firm
preparing it, 'there is no professional stamp indicating
by whom it was prepared. Accordingly, it would be best
if the firm's name and address, and the professional
stamp of the reviewing engineer, were to be placed on
the accompanying utility plan/profile. If this is not
possible, it would be helpful if some clarification of
the date of its preparation and name of the preparer
could be affixed to the plan/profile.
5) It appears, from symbols on the March 25, 1991 plan,
that a water service to the proposed dwelling is planned
to be installed at the end of the 8 -inch water main in
Almeda Street. This service should be provided upstream
of the gate and blow -off appliances (preferably so the
water service may be maintained at least ten (10') feet

north of the proposed sewer service), so the thrust
block at the end of the water main is not disturbed. A
regular corporation stop should be tapped into the pipe
sidewall, with a continuous gooseneck being provided
over or under the existing sewer collector. Water
service should be continuous type "K" copper tubing, at
least 1/2 -inch diameter.
