RE: Osco Drug - 45-53 and 59 Boston Street
On Thursday, May 4, 1995, the Planning Board of the City of Salem opened a public
hearing regarding the application of the Kennedy Development Group, 500 Broadway, Everett,
MA 02149, Section 7-18, Site Plan Review, of the Salem Zoning Ordinance, with respect to the
construction of a +/-13,237 s.f. Osco Drug store and associated improvements at 45-53 and 59
Boston Street, between Proctor and Pope Streets.
Board member John Moustakis recused himself from hearing this petition. The public
hearing was closed on July 6, 1995. At a regularly scheduled meeting of the Planning Board held
on July 6, 1995, the Board voted by a vote of six (6) in favor, one (1) opposed, to approve the
application as complying with the requirements of Site Plan Review, subject to the following
conditions:
1. Conformance With Plan
Work shall conform with set of plans entitled, "Site Plan Review Documents for Osco
Drug, Boston Street, Salem, MA", dated April 6, 1995, revised July 12, 1995 prepared by
Geller Associates, 77 North Washington Street, Boston. MA 02114, containing four
sheets, LR-1 through LR-4.
2. Amendments
Any amendments to the Site Plan or waiver of conditions contained within shall require the
approval of the Planning Board.
3. Traffic
a. There shall be no left turn exit out of the site onto Boston Street. The applicant, his
successors or assigns, shall provide a detailed plan to the City Planner for his written
approval depicting the construction of the exit driveway to prohibit left turns onto Boston
Street. The plan shall be approved prior to the issuance of a Building Permit.
b. The curb cut on Pope Street, closest to Boston Street, shall be an entrance and exit. The
rear curb cut on Pope Street shall be an exit only.
c. No Certificate of Occupancy shall be issued for this project until a fully actuated signal,
as approved by MHD, at Boston and Proctor Street is operating. Such signal shall have
the capacity to be coordinated with the proposed signal improvements on Bridge Street and
Boston Street.
d. The Applicant, his successors or assigns, shall receive written approval from the City
Planner and City Electrician for the re-timing of the signals at the Boston/Bridge/Proctor
intersection.
e. The Applicant, his successors or assigns, shall paint left and right turn arrows on Pope
Street. In addition, the Applicant, his successors or assigns, shall design and paint lines to
allow for parking on the east side of Pope Street.
f. The Applicant, his successors or assigns, shall receive all necessary approvals to allow
Proctor Street to become two-way from Boston Street to the end of the curb cut at the site
property line. This approval shall be in place prior to the issuance of a Building Permit.
g. Applicant, his successors or assigns, shall provide all necessary traffic signage on Pope,
Proctor and Putnam Streets.
4. Exterior Elevations
Final elevations, brick type and other building materials shall be reviewed and approved
by the City Planner in writing prior to the issuance of a Building Permit.
5. Salem Fire Memorial Marker
The Applicant, his successors or assigns, shall donate an amount not to exceed $1,000 to
the City to design and install a memorial marker commemorating the Great Salem Fire at
the intersection of Boston and Proctor Street. The funds shall be donated to the City prior
to the issuance of a Certificate of Occupancy. Location shall be approved by the City
Planner and the Ward Councillor.
6. Utilities
a. Utility installation shall be reviewed and approved by the City Engineer prior to the
issuance of a Building Permit.
b. Drainage shall be reviewed and approved by the City Engineer prior to the issuance of
a Building Permit.
7. Site Liehtine
a. A lighting plan shall be submitted to the City Planner for review and written approval
prior to,the issuance of a Building Permit.
b. All site lighting shall be installed and maintained in such a way so as to not reflect or
cause glare on abutting properties, or which adversely affect safe vision of operators of
vehicles moving on nearby streets.
8. Landscaping
a. Applicant, his successors or assigns, shall submit a detailed plant list indicating
quantities of proposed plantings to the City Planner for written approval prior to the
issuance of a Building Permit.
b. Trees shall be a minimum of 3 1/2" caliper.
c. Vertical granite curbing shall be installed at all entrance radii to Osco Drug.
d. Concrete curbing or sloped granite curbing shall be installed within the Osco site.
e. A concrete sidewalk , including the resetting of all existing concrete curbing, shall be
installed around the site on Pope Street and Boston Street and extend on Proctor Street to
the far side of 25 Proctor Street.
f. After all project landscaping is completed, and prior to the issuance of a Certificate of
Occupancy, the applicant, his successors or assigns, shall be required to add further
landscaping if such is required by the City Planner.
9. Signage
Proposed signage shall be reviewed and approved in writing by the City Planner, and may
be less than the signage allowed in the Salem Sign Ordinance.
10. Board of Health
All Board of Health requirements shall be strictly adhered to.
11. Water Test
The water system shall be tested by the City of Salem Clerk of the Works for pressure and
bacteria prior to the issuance of a Certificate of Occupancy.
12. Underground Utilities
All site utilities shall be installed underground.
13. Proctor Street Electric Lines
The Applicant, his successors or assigns, shall work with the Planning Board, Planning
Department and Massachusetts Electric to determine the feasibility of relocating the Proctor
Street electric lines underground. The applicant, his successors or assigns, shall agree to
contribute approximately $50,000 toward the cost of burying the lines underground if the
lines are to be buried. Hendricks style spacer cable shall be used if the lines are installed
overhead.,
14. Delively Hours
Deliveries shall be limited to the hours of 8:OOAM - 8:OOPM.
15. Parking Spaces
The parking spaces located behind the building shall be utilized for employee parking.
16. Clerk of Works
A Clerk of Works shall be provided and paid for by the applicant, his successors or
assigns, as deemed necessary by the City Planner.
17. Maintenance
a. The applicant, his successors or assigns, shall employ an acceptable method or means for
the holding and disposal of trash (rubbish) after site development with a copy of this
method sent to the Planning Department and Health Department in writing for their
approval.
b. Refuse removal, ground maintenance and snow removal shall be the responsibility of
the developer, his successors or assigns.
c. Winter snow in excess of the snow storage areas on the site shall be removed off site.
18. Construction Practices
All construction shall be carried out in accordance with the following conditions:
a. No work shall commence before 8:00 A.M. on weekdays and Saturdays. No work shall
continue beyond 5:00 P.M. There shall be no work conducted on Sundays and
holidays. Inside work of a quiet nature may be permitted at other times.
b. All reasonable action shall be taken to minimize the negative effects of construction on
abutters. Advance notice shall be provided to all abutters in writing at least 72 hours prior
to commencement of construction. Notification shall also be submitted to the Planning
Department.
c. Maintenance of all landscaping shall be the responsibility of the applicant, his successors
or assigns.
d. All construction shall be performed in accordance with the Rules and Regulations of the
Planning Board, and in accordance with any and all rules, regulations and ordinances of the
City of Salem.
19. As-Built Plans
As-built plans, stamped by a Registered Professional Engineer or Land Surveyor, shall be
submitted to the Planning Department and Engineering Department prior to the issuance
of a Certificate of Occupancy.
20. Violations
Violations,of any condition shall result in revocation of this permit by the Planning Board,
unless the violation of such condition is waived by a majority vote of the Planning Board.
I hereby certify that a copy of this decision and plans have been filed with the City Clerk
and copies are on file with the Planning Board. The Special Permit shall not take effect until a
copy of this decision bearing the certification of the City Clerk that twenty (20) days have elapsed
and no appeal has been filed or that if such appeal has been filed, and it has been dismissed or
denied, is recorded in the Essex South Registry of Deeds and is indexed under the name of the
owner of record or is recorded on the owner's Certificate of Title. The fee for recording or
registering shall be paid by the owner or applicant, his successors or assigns.

Plans submitted Sept. 18, 1981 to this office for review, covering the
proposed work at Ideal Finishing Co . 59 Boston Street, Salem, Mass. have
been checked and the following items shall be required for stamped approval .
1 . A fire department Siamese connection shall be required on the building.
This will provide compliance with current codes .
2. An inspectors test gauge shall be provided at furthurmost point of
the sprinkler system at the inspectors test pipe.
3. Note to be provided on the plan indicating a complete external weld
is required on all duct work and on collars at each hood connection.
4 . Clean out doors, properly sealed in accordance with recognized engineering
practices shall be provided on at least twenty foot intervals on all
duct work.
5. A letter of addendum shall be submitted with revised plans stating
compliance with Items #1 and #2. This shall be on the letterhead of
Melvin First, Sc.D and shall be made a part of the submission.
6. Plans shall be furthur adjusted to show the notes requested in Items #3 6 A.
7. A Salem Fire Dept. Form #81 shall be submitted with the revised plans
for stamped approval of the plans . Fee $5 .00
8. The sprinkler contractor shall submit Salem Fire Dept. Form #81E , with
a fee of $5.00, for approval of the sprinkler contractor. A test of the
system shall be required upon completion.
9 • Decals shall be provided for both entries to flammable storage room.
These decals shall be of the new DOT approved type with numbers indi-
cating each type of flammable stored within the room, for any amount
over 55 gallons of each type.

relocated to conform to current code requirements. All exhaust ducts
shall lead to the outside,exhaust at least fourty inches above the x, �`
roof. Said duct shall be installed per EPA regulations for collection

cleaning & maintainance of the ducts. No long horizontal runs are
permitted. No product may be exhausted within twenty feet of any•„ a ;

3. The roof shall be protected from collection of residue by a metal"
pan which will accept all residue. Said residue shall be kept from `'
