LOCATED AT 30-32-34 BOSTON STREET LOCATED :IN AN R-2 DISTRICT
A hearing on this petition was held Noverioer 29, 1977 with Board members Donald
Eames, Jane Lundregan, Arthur Labrecque, William Abbott and Douglas Hopper present.
Notices were sent to abutters and others in accordance with iMass. Gen. Lavas, Chapter
808.
The Petitioner represented himself before the Board. The Petitioner wishes to
tear down the present structures located. at 32-34 Boston St. , which is presently
zoned R-2 which has a small office structure on it. They propose to build a new
building to b„ used as a greenhouse plant store. Tb- Petitioner clavned that the lot
is not presently suited for a tao family residential use because the area surrotuidin.g
tl:e lot is basically business and across the street is zoned B-2. They argued %hat
s nce the main lots on the other side of the street are of co;tunercial use and the
opposite side of the street is zoned B-2, the proposed use will not derogate from th--
intent of the zoning ordinance.
The Board granted the variance requested and the Board also granted the necessary
variances :from the density requirements to allow the building to be built, es sholKIL on
the plans submitted wit], the petition. 1he Board found that the area, although zoned
R-2, is basically business use and to deny the Petitioner the use of the property for
business purposes would create a substantia]. hardship to til-- Peti-tioner.
The Board found that it could grant the variance without derogating from the intent
of the zoning by -laws or without detrirent to the surroc :ding neighborhood. T7ierefore,
the Petitioner is granted the variance to build at 30-32-34 Boston St. and to use the
property for bus Mess purposes. Variances were also granted from the necessary density
requirements.

PROPERTY LOCATED AT 30 BOSTON STREET—R-2 DISTRICT
A hearing on this petition was held on April 25, 1978 with the following members
present: Donald Eames, Jane Lundregan, Arthur Labrecque, liilliam Abbott, James Boulger
and Associate Member Douglas Hopper. Notices were sent •to abutters and others in
accordance with Mass. General Laws, Chapter 808.
Atty. James Murphy represented the Petitioner before the Board. He noted that
in seeking financing for a one story building, the bank would not provide the financing
unless residential use was included in the construction plan. A financial hardship was
claimed by the Petitioner because unless they have a second level, the bank will not
go along with financing a one story building for commercial use only.
The Petitioners had already obtained a variance for a small greenhouse plant store.
There would be no change in the proposed structure except that an apartment will be
located on the upper level. of the building.
The Board voted to grant the Petition requested with the following restrictions:
1) The Petitioner will brick the street face of the building;
2) The electrical pole will be relocated to the west, if possible;
3) The fence will be repaired.
The vote was made to grant the variance requested in accordance with the plans
submitted with the above conditions noted. The Board found that it could grant said
variance without derogating from the intent of the Salem Zoning Ordinance or without
substantial detriment to the surrounding neighborhood. The Board also found that
to deny the petition requested would cause financial and other hardship to the Petitioner.

Dear Sir:
With reference to your letter of October 15, 1955 regarding
the proposed bakery on Boston Street, Salem, Mass., I assume the loca-
tion to which you refer in your letter is where a small metal office
building is located rather than the two car garage mentioned in your
letter. The address is 32 Bost Street and this particular area is
zoned for business.
The erection of a tuakery on this site would not be in
violation of the Zoning Ordinance, and in accordance with the Building
Ordinance can be erected up to the lot line, provided the walls along
the lot lines are of 12 inch brick construction without openings.
However, the building would require a rear exit and a passageway on one
side or the other along the building from the rear of the building to
the street.
With reference to your question regarding marquees, the Bity
Ordinance pertaining to marquees reads as follows:
The City Council may grant permit to erect marquees, the sides of which
may be used for advertising purposes. Any application for such a permit
shall be approved by the superintendent of streets and the inspector of
buildings before presentation to the city council for consideration.
Sucg marqueesrp when erected, shall be not less than ten feet above the
sidewalk, and a plan fully describing the same shall be filed with the
application for a permit.

Dear Sir:
I have a client who is contemplating the construction of a bakery
on Salem Street. The location of the lot is directly opposite the Auto Body
Shop on Boston Street, (between Sylvania and Essex Streets). At present,
there is a two car garage on the site which will be demolished in favor of the
new building. The garage is located five feet from the lot line facing Boston
Street, and approximately one foot from the group of stores located on the next
lot, and starting on the common lot line.
Your answers to the following questions would be extremely helpful to
me. First, can the new building start at the lot line, and second, is there any
limitation to the distance which an over-hang or marquee can extent over e si e-
iralk.
I have presented you with as complete a picture as possible at this
stage of development. If there is any information on zoning or building which
you know of that is applicable to this project, I would appreciate your advising
me immediately. ,
I do not have, in my office, a copy of Salem's building code or zoning
regulations. Would you please include a copy of each with your reply. I hope
that this matter will receive your prompt attention.
