Chapter 11: Minimum Standards of Fitness for Human Habitation,an inspection was conducted of the property 158
Boston Street Unit 1 permitted by occupant Courtney McGarry conducted by Jeffrey Barosy,Sanitarian on June
8,2022 at 9:30am.
Notice: if this rental unit is occupied by a child or children under the age of 6 years, it is the property owner's
responsibility to notify tenants of lead related reports and tests,and to ensure that this unit complies fully with 105
CMR 460:000: Regulations for Lead Poisoning Prevention and Control. For further information or to request an
inspection,contact the Salem Board of Health at 978-741-1800.
You are_hereby ORDERED to make a good-faith effort to correct the violations listed on the enclosed inspection
report and to take all positive action to prevent these violations from occurring again in the future.
Failure on your part to comply within the time specified on the enclosed inspection report will result in a complaint
being sought against you in Trial Court. Time for compliance begins with receipt of this Order.
Should you be aggrieved by this Order,you have the right to request a hearing before the Board of Health. A request
for said hearing must be received in writing in the office of the Board of Health within 7 days of receipt of this Order.
At said hearing,you will be given an opportunity to be heard and to present witness and documentary evidence as to
why this Order should be modified or withdrawn.You may be represented by an attorney. Please also be informed
that you have the right to inspect and obtain copies of all relevant inspection in investigation reports,orders and other
documentary information in the possession of this Board,and that any adverse party has the right to be present at the
hearing.
Please be advised that the conditions noted may enable the occupant(s)to use one or more of the statutory remedies

Based upon a tenant complaint a permitted inspection was conducted in
accordance with Article II of the State Sanitary Code, 105 CMR 410.000. Upon
Inspection the following were noted:
7 Days .500 1. Bathroom ceiling has chipping and peeling paint. Scrape off chipping
and peeling paint and repaint affected areas. Owner has 7 DAYS to
start making a good-faith effort to correct violations.
.500 2. In bathroom there are holes in the floor and wall behind the toilet with
24 Hours .750 (K) one of these holes reaching to the outdoors. Repair floor and walls
behind toilet so that they exclude wind, rain, and snow, are rodent-
proof, and are in good repair and in every way fit for the use intended.
Owner has 24 HOURS to start making a good-faith effort to correct
violations.
.500 3. In the bathroom there is a long crack running vertically down a wall
24 Hours behind toilet towards the right. Repair crack in wall so that it is in good
repair and in every way fit for the use intended. Owner has 24
HOURS to start making agood-faith effort to correct violations.
.500 4. Bathroom's floor tiles are cracking and deteriorating. Repair or
7 Days replace affected floor tiles so that they are in good repair and in every
way fit for their intended use. Owner has 7 DAYS to start making a
good-faith effort to correct violations.
.500 5. In the bathroom on the wall the shower head is on, on the outside of
7 Days the tub near the floor, this portion of the wall is moldy and
deteriorating. Repair this portion of this wall so that it is in good repair
and in every way fit for the use intended. Owner has 7 DAYS to start
making a_good-faith effort to correct violations.
.550 6. In kitchen mice droppings were found in cupboards beneath kitchen
24 Hours .750 (0) sink and beneath cabinet in wall to the right of the sink. Owner is to
hire a professionally licensed exterminator and have the exterminator
exterminate the dwelling unit and all ad
'acent walls. Any holes leading
into the dwelling unit must be plugged to prevent re-entry from mice.
Owner must send extermination report to the Salem Board of Health
after the extermination has taken place. Exterminator is to return as
often as needed until mice no longer present a public health
nuisance in the dwelling unit. Owner has 24 HOURS to start
makina aood-faith effort to correct violation.
.351 7. Stove burners and oven do not turn on and there is no hot water
24 Hours .750 (C) because gas has been cut off. Occupant informed inspector that gas
was ordered to be turned off due to tampering and has been off since
May 271, 2022. Owner has been found to not be the cause of the gas
being turned off, but the City of Salem Interim Plumbing Inspector
informed the Salem Board of Health that the Owner is responsible for
having gas turned back on. Owner has 24 HOURS to start making
good-faith effort to correct violation.
.351 8. Kitchen ceiling light is always on and switch for light does not work.
7 Days Have a licensed electrician repair ceiling light so it can turn on and off
with use of a switch as it was designed. Owner has 7 DAYS to start
making good-faith effort to correct violation.
.500 9. Living room has a window,on the left with a bottom sash that falls
7 Days when lifted. Repair window so sash opens and closes with ease and
can stay open under its own power. Owner has 7 DAYS to start
making good-faith effort to correct violation.
.351 10. Living room's ceiling light does not turn on. Have a licensed
7 Days electrician repair light so that it turns on and off when the switch is
activated as designed. Owner has 7 DAYS to start making good-faith
effort to correct violation.
.351 11. In the bedroom down hallway off living room, the ceiling light does not
7 Days stay on, flickering on and off when turned on. Have a licensed
electrician repair light so it turns on and off without any malfunction as
designed. Owner has 7 DAYS to start making good-faith effort to
correct violation.
.500 12. In bedroom adjacent to master bedroom, the window's bottom sash is
7 Days difficult to move and has a crack around where its right-side spring is
located. Repair window so there are no cracks in sash and sash
opens and closes with ease. Owner has 7 DAYS to start making
good-faith effort to correct violation.
.500 13. In bedroom down hallway off living room, the pipes running vertically
7 Days in the corner of the room between both windows have holes in the
ceiling where the escutcheons have fallen. Repair escutcheons so
that they cover holes in ceiling around pipes as designed. Owner has
7 DAYS to start making good-faith effort to correct violation.
.500 14. In bedroom adjacent to master bedroom, there are three pipes
7 Days running vertically that have holes in the ceiling where the
escutcheons have fallen. Repair escutcheons so that they cover
holes in the ceiling around pipes as designed. Owner has 7 DAYS to
start making good-faith effort to correct violation.
N/A 15. Owner has 30 DAYS to correct all violations listed in this report.
N/A Owner must start making good-faith effort(reporting to the Salem
Board of Health what actions will be taken in writing, hiring
contractors that may be needed, or starting necessary work on
