Although not required in the covenant, I have installed a new manhole at the most Southwesterly end of this sewer main at the request of our City Engineer and at an ,added cost of approximately $300.00. Also, the sewer main 1:_vert elevations conform to those specified by our City Engineer and dated May 30, 1973 (copy attached to plan) . 2:) Although the covenant calls for a two inch (2") copper tub- ing water supply along Border Street, I have installed a four inch (4 ") cast iron water main for the distance and in the location specified, after consultations with our City Engineer. The added cost of this larger supply was approx- imately $200.00. Note : I also arranged for ##3 Border Street ( owned by R. Rozumek) to oe" connected to this new water main during our installation to eliminate a freeze-up problem existing at that location since that home was built four years ago. 3) I have extended the existing roadway for a distance of one hundred thirty-five ( 135) feet as agreed. Although the covenant calls for a roadway "in kind and size'', the new roadway exceeds the thickness of the existing roadway. All of the above may be confirmed by our City Engineer, Mr. Ralph Tedford. Hosman Dear Mr. O'Brien: It was recently presented to the officials of the City of Salem a proposal by James R. Hosman to merge four lots on Border Street into two lots, each new lot being the size of two former lots. This action does not constitute subdivision activity and does not require action by the Planning Board or the submission of an approved Plan to the Registry. Request has been made for issuance -of a building permit for each of the new lots which will result from the above-noted merger. The lots are in a Rl district and fulfill frontage and square footage requirements. At the present time utilities and street surfacing have not been completed. However, Mr. Hosman has presented a letter to the City Engineer covenanting that he will install and connect water and sewer lines to present operating facilities in a specific manner satisfactory to the City Engineer and will surface the street in front of the two new lots. This work and covenant, I understand, is satisfactory to the City Engineer. Accordingly, the proposed construction will be on an improved street and you may issue building permits. As an abutter, and as a citizen of Salem, I am opposed to the approval of Building Permits on all land shown as lots #4, #5, #6, #7 , #9', and #10 on the plan of "Land of Francis X. Cullen, Ord Street, Salem, Massachusetts , July 1956, Edwin T. Brudzynski , Surveyor" recorded with Essex South District Registry of Deeds in Book 4437, page 105, (copy supplied you on April 29, 1969) unless the Building Permits are issued under and within the provisions and conditions of the Sub- Division Control Law of the City of Salem, Massachusetts. All of these lots are located on a "Proposed Street" , as shown on the plan. The street abutting each of these lots is unpaved and does not include any of the Municipal Services available to all other homes in the immediate area. Construction activity by a Company, Corporation, or Trust with the declared intention of eventually erecting buildings on all of the above land by persons planning to lease or sell , and not intending to occupy the dwellings being constructed would seem to clearly constitute Sub-Division activity. It is my understanding that the Developer does not intend to install storm or sewer drains , sidewalks , or lighting on the Proposed Street. As a resident of the immediate area, I believe that any building construction on lots #4, #5, #6, #7, and #10 as described above, if done without these betterments , will cause a health and safety hazard to all residents of the area. Flooding conditions exist on those lots under certain weather conditions. Street surfacing, .drainage, sidewalks, lighting, etc. , less than that required under the Salem Sub- Division Control Law will be detrimental to property values in the immediate area, will be directly opposed to the implied intent of that law, and will burden the City of Salem with the expense of providing those required services at a later date. For these reasons, I request that Building Permits be withheld,-]on the above land unless issued under and within the provisions and conditions of the Sub-Division Control Law. Book number 5603, on pages 382 and 384 in the Essex South District Registry of Deeds records the transfer of title on lots #9 and #10 on April 24, 1969 from Francis X. Cullen to Joseph Astuccio "as he is Trustee of Pilot Homes Trust under a Declaration of Trust dated April 23, 1969 to be recorded herewith, of 32 Ocean Avenue, Lynn, Essex County, Massachusetts. " I believe Francis X. Cullen is still the owner of lots #4, #5, #6, and #7 as shown on his plan although Mr. Astuccio implied ownership in my conversation with him on April 28, 1969. Please be advised that all other lots on Francis X. Cullen's plan, and owned by him, except lots #1 and #2, were purchased by individuals who had homes constructed for their own use. Homes on lots #1 and #2 were constructed approximately 13 years ago by a Salem builder for resale to their present owners. Building on all of "Cullen' s" lots, except the current activity on lots #9 and #10, were done prior to 1965. Please consider this letter my request, as an abutter, for a hearing before your Board unless all lots (#4, #5, #6, #7, #9, and #10) as shown on "Cullen's" plan (mentioned above) are declared subject to, and under the provisions of, Salem's Sub- Division Control Law. The owners did not know that Mr. Hanson was not licensed to work in Massachusetts, nor did he pull a building permit. The deck he constructed has several structural and code problems. Mr. Hanson appeared before Clerk Magistrate,Robert Grant. Mr. Grant directed the owners of 2 Boarder Street to solicit 3 prices to rebuild the deck. Mr. Hanson was then directed to pay the full amount to rebuild the deck. To date, this hasn't happened and that brings us to today's date.
