This Department has received and confirmed a complaint regarding bushes and shrubbery overhanging the
sidewalk at your property.This violates City Ordinance 38-9 which prohibits the obstruction of sidewalks by
shrubbery . You are directed to cut back all of the overgrowth that hangs over the sidewalks within ten days of
this notice.Failure to comply will result in Municipal Code tickets and further enforcement activities.Please

Mr. Charos,
As a result of the inspection conducted by this office on Monday, January 27, 2014, it has been
determined that you have created and have tenants occupying an illegal 3d floor dwelling unit at
40 Boardman Street in violation of the City of Salem Zoning Ordinance chapter 6-1 for a three (3)
- unit building in a location zoned for(R-2) two family dwellings. This office has no records of
permits for this construction and/or variance or special permit approvals for this third floor unit.
Furthermore the unit in violation contains no secondary means of egress as required by the
Massachusetts State Building.
You are hereby ordered to secure permits for its removal or legal inclusion with the second
floor apartment unit within twenty four hours(24) hours of receiving this notice and relocate
tenants from this unit immediately. You are hereby ordered to immediately contact this office
upon receipt of this notice; failure to respond to this notification will be construed as non-
compliance, with issuance of Municipal tickets and including the filing of criminal complaints at
District Court.
If you feel aggrieved by the Building Codes issues you have the right to appeal this order to the
State Board of Building Regulations at One Ashburton Place, Boston, Ma. If you feel you are
aggrieved by the Zoning decision of this order, your Appeal is to the Salem Zoning Board of
Appeals.

with shrubbery. I have enclosed a copy of the Ordinance for you to review. The Rose
bushes are extending over the sidewalk impeding pedestrian travel.
Said violations must begin to be corrected, repaired, and/or brought into compliance
within 7 days of your receipt of this notice. Failure to do so may result in further actions
being brought against you, up to and including fines and the filing of complaints at
District Court.
