Owners,
Our Department's recent inspection of the above referenced property revealed that two
illegal dwelling units have been created one(1)- unit in the basement and; one (1)-unit on
the third floor.
The following actions are required immediately to briny the property into compliance
with the Massachusetts State Building Code and City of Salem Zoning Ordinances:
1. File building Permits and arrange inspections for the complete removal of the
basement kitchen area and bathroom including removal ofplumbing behind the
finished wall, any and all partitions that constitute a living or sleeping area in any
way.
2. File building Permits and arrange inspections for the complete removal of the
third floor kitchen, bathroom, laundry area including removal ofplumbing behind
the finished wall, any and all partitions that constitute a living or sleeping area in
any way.
3. Submit a signed and notarized affidavit that you shall not occupy the basement unit
or third floor unit until all work itemized above is completed and signed off by this
department and any other City department having jurisdiction.
You are hereby directed to immediately contact this Department upon receipt of this letter to notify it of your
course of action to bring your building into compliance. Failure to respond to this notification will be
construed as non- compliance, with issuance of Municipal tickets and including the filing of criminal
complaints at District Court.

As previously mentioned this Department has no record of special permits, variances or building permits for
these units. If you feel you are aggrieved by my zoning interpretation,your Appeal is to the Salem Zoning
Board of Appeals, remember the burden is yours to produce special permits, variances or building permits for
these units. If you feel you are aggrieved by the Building code sections, your Appeal is to the Board of
Buildings, Regulations and Standards in Boston.

The above referenced property has come to the attention of this department for the following reason(s):
A report has been made to this office that there are two(2) -illegal apartment units located in this permitted two(2) -
unit building in an R2 Zoning district. Upon investigation on January 14, 2013 it was noted that an illegal and non-
permitted unit does exist in the basement and the information regarding the alleged unit on the third floor has
validation. For this reason an inspection must be conducted by our office to assure compliance with the code and city
ordinance. Additionally there is concern by that heat from one unit is supplying heat to the illegal basement unit and
improperly installed,A Required Inspection must be conducted by our Department to assure compliance with the State
Building code and city ordinances.
Under the provisions of 780 CMR, Section 104.6—Right ofEntry, of the State Building Code, access to this property
must be granted for the purposes of this inspection. Please call this office upon receipt of this letter, if this property has
rental units these tenants must be notified in advance of this inspection so that access to these spaces may also be
accomplished.
This Required Inspection shall be conducted by this office on Tuesday, January 22, 2012 at 10:00 a.m.; failure to
respond to this notification will be construed as non- compliance, with issuance of Municipal tickets and as such an
Administrative Search Warrant will be sought, so as to allow the lawful inspection of this property. If you feel you are
aggrieved by my zoning interpretation, your Appeal is to the Salem Zoning Board of Appeals. If you feel you are
aggrieved by the Building code sections, your Appeal is to the Board of Buildings,Regulations and Standards in Boston.

DECISION ON__THE-PE-T-ITI01 OF DONALD KAUFMAN FOR A VARIANCE
AT {10'BOARDMAN `
A hearing on this petition was held February 15, 1988 with the following Board
Members present: James Fleming, Chairman; Richard A. Bencal, Vice Chairman;
John Nutting, Secretary, Edward Luzinski and Peter Strout. Notice of the hearing
was sent to abutters and others and notices of the hearing were properly published
in the Salem Evening News in accordance with Massachusetts General Laws Chapter 401
Petitioner, owner of the property, requests variances to allow an existing three
family dwelling, and from parking in this R-2 zone.
The Variance which has been requested may be granted upon a finding of the
Board that:
a. special conditions and circumstances exist which especially affect the land,
building or structure involved and which are not generally affecting other
lands, buildings or structures in the same district;
b. literal enforcement of the provisions of the zoning Ordinance would involve
substantial hardship, financial or otherwise, to the petitioner;
c. desirable relief may be granted without substantial detriment to the public
good and without nullifying or substantially derogating from the intent of
the district or the purpose of the Ordinance.
The Board of Appeal, after careful consideration of the evidence presented and
after viewing the plans, makes the following findings of fact:
1 . Both support and opposition to the variance was presented by
neighbors, abutters and others;
2. Petitioner purchased the property in 1981 as a two family dwelling
and has been using it intermittently since then as a three family;
3. The use of the property as three family has caused an increase i
neighborhood congestion;
4. Any hardship, economic or otherwise, claimed by the petitioner was
self created.
On the basis of the above findings of fact, and on the evidence presented,
the Board of Appeal concludes as follows:
1 . Special conditions do not exist which especially affect the subject
property and not the district generally;
