Brennan Salem Fire Department Salem, Mass. Sir: On this date I inspected the vacant, two-and-a-half story dwelling at 2 Blaney Street to determine if this building represents a fire hazard. Following this' in- spection, it is my opinion that this buildingwhich has deteriorated beyond any reasonable expectation of repair; is a fire hazard. Some conditons which were noted: Absence of most windows on the second and third floors, leaving the building open to the elements. Rooms on all floors contain Targe amounts of abandoned furniture, personal and household effects,, which make for an increased fire load. The. foundation wall at the right rear is broken, leaving an opening about three feet wide into the cellar.The VFW has repeatedly boarded this opening and just as repeatedly, the covering have been torn off. There is a continuing problem with children' removing first floor coverings and enetering the building.Mr. Morin of the VFW, reports an occasional problem with vagrantss in the building. . The roof is useless and the second and 'third floor rear walls seem to be pulling away. from the structure, probably, a result of the weather., Interior damage to this houseis so extensive as to preclude any efforts at re- habilitation and it would be my recommendation that this building be removed as soon as possible. Structural joists and girts have deteriorated to a point that they and the exterior sills would have to be replaced, Upon further inspection it is my professional opinion that the structure is well over 50% un-rehabitable. Section 123 of of the Commonwealth of Massachusetts State Building 'Code places responsibility for determining whether or not a structure is dangerous to life or limb and ought, as a result, be removed or made safe with the Inspector of Buildings. As I indicated earlier (see attached opinion January 24, 1979) , a determination by the Building Inspector that a building is unsafe or dangerous would permit the structure' s demolition even though the building is located in a duly established Historic District. Because I can find no statutory authority delegatinq to the City Council the responsibility for determining a building to be unsafe or dangerous , that portion of the Order directinq the Building Inspector to issue a demolition permit has no legally operative effect. However, I recommend that the Order be considered to be "information" under Section 123 which requires the Building Inspector to inspect the premises. Article IV of Ch: 19 of the Code parallels M_G.L. Ch. 40C. Section 8 of Ch. 40C provides in part, that nothing in Chapter 40C shall be construed: to prevent the demolition of any feature (including a building ) , which the Building j Inspector shall certify is required by the public safety r because of an unsafe or dangerous condition. S; nce' I am _ not aware that any such certification has been determined by the Salem BuildingInspector -theprovisions of Section 8 remain in full force.- The relevant section of Ch. 40C in this instance is Section 3, which deals with the establishment, enlargement, or reduction of an existing district and with the procedure for creating by ordinance and amending such ordinance, such an historic district.' A copy of Ch. 40C, Section 3 , appears as Appendix A to this opinion. The structure is now vacant and in an extremely deteriorated condition. Windows and doors are broken, portions of the roof are missing, exposing roof timbers to the elements , sections of the foundation have collapsed and supporting building members are victims of rot and termites. The structural stability of the building is questionable. In its present state, this building is a target for vandalism, a threat to the safety of the public because of its weakened condition and an ever present fire hazard in a combustible and congested neighborhood. Powers, Building Inspector SUBJECT: Request for appraisal of the building at 2 Blaney Street, Salem, MA Subject building is located in a B-1 Zone which in essence may be catagorized as a neighborhood business district which is intended for uses meeting daily shopping needs for the convience of the adjacent residential area, which has considerable historic significance. The building previously was utilized as a multi-use catagory with a restaurant of sorts on the street floor and the remainder utilized residentially. Evidently in time past the framing of the first floor showed some signs of failure and dry rot, and repairs were attempted in the form of shoring. Although the repair work was formidable, no real attempt was made to establish "footings" for the bracing. If the building is to be renovated, this condition should be given immediate attention as unquestionably the dry rot in some of the lumber is progressive. The roof of the building is leaking in numerous places and moisture at this time has permeated the walls and ceilings, causing plaster to flake off, and pieces of the ceiling to fall. There is no heat in the building to halt the destruction that will be caused by this condition. There are holes in the foundation of the building which could cause an . infestation of rats or mice but this could be corrected fairly easily by caulking of parging, and grouting. Unquestionably the plumbing and wiring of the building will call for practically complete replacement and at considerable expense, and it is evident that the building is a constant victim of vandalism. In summerization the building is not structurally dangerous or unsound at this time, but should be given immediate attention as it can become both a fire hazard and health problem if not given attention immediately. Financially speaking it is also possible the renovations called for may not be feasable. The location of the 2 Blaney Street property in both the rby Street Historic District (local) and its listing as part of Derby Waterfront District on the National Register of Historic Places attest to its significance both locally and nationally. While 10 Blaney is jut outside these districts and despite its present condition, its high architectural significance makes it a very important Salem asset.
