PRIVATE POOL - DEFINITION Any pool intended to be used primarily by occupants of a one or two family dwelling. Any such pool more than 24 inches deep or having a surface area greater than 250 square feet ( 18 foot diameter) requires a building permit before installation, enlargement or alteration. 2. PERMITS Applications for a permit shall be accompanied by 2 copies of a plot plan bearing the stamp of a registered surveyor (scale not less than 1 " - 201 ) , fully dimensioned, showing pool location on property, relation of structures on the property, location of all fences and gate, and abutters names. Applications for a pool shall also be accompanied by 2 sets of plans and specifications, acceptable to the Inspector of Buildings, bearing the stamp of a qualified professional engineer. 3. POOL LOCATION No side of any pool shall be closer than 6 feet to side or rear property lines, no closer to front yard lines than the zoning setback requirements, or loser than 10 feet to any building foundation. Variances from these requirements shall be permitted only by Special Permit from the Board of Appeal. 4. SAFETY REQUIREMENTS Pools will be surrounded by a fence at least 4 feet high and no further than 25 feet from the sides of the pool. Rail fences will not be permitted. Pools shall comply with all applicable codes. ONE 3 foot wide gate with closing and locking device will be permitted. 5. CERTIFICATE OF COMPLIANCE Before a wiring permit can be obtained a Certificate of Compliance must be issued. Said certificate will be issued only after a new certified plot plan showing that the pool is properly sited has been filed with the Inspector of Buildings, or a request for an on-site inspection has been honored by the Inspector of Buildings. The plot plan shall be filed following placement of reinforcement but prior to pouring of concrete. Noncunformities shall not be enlarged upoi , expanded, or extended , nor be used as grounds for adding other pro- hibited structures or uses elso"here in the same district . A nonconforming use of a structure , a nonconforming usp of land, or a nonconforming use of a structure and land shall not be entended or enlarged by attachment on a build- ing or promises of additional signs which are intended to be seen from off the premises , or by the addition of other uses of a nature which would be prohibited generally in the district involved. Provided however and notoithstanding any other provisions of this Ordinance to the contrary an existing nonconforming building or use may be altered or enlarged in that use, subject to the granting of a permit therefore by the Board of Appeals as provided in Section IX-D. Nothing in this Ordinance shall be deemed to require a change in the plans , construction , or designated use of any buildin.- for which a building permit was issued prior to the notice of hearing before the Planning Board provided that actual con- struction shall begin within six months after the permit is issued and shall be diligently carried on until completion of the building. "Actual construction" is hereby defined to include the placing of construction materials in permanent position and fastened in a permanent manner. Where demolition or removal of an existing building has been substantially begun preparatory to rebuilding , such demolition or removal shall be deemed to he actual construction , provided that work shall be diligently carried on until completion of the building involved. Nothing in this Ordinance shall be deemed to prevent the strength- ening or restoring to a. safe condition of any building or part thereof declared to be unsafe by any official charged with pro- tectinZ the public safety , upon order of such official _ Any use for which a Special Permit is granted as provided in t.hi.:_. G:dinanoc shall not be deemed a nonconforming use . 82 NONCONFORMITY SECTION ill B. Nonconforming; Lot Where a lot or lots exist which could not be built upon for residential purposes under the terms of this Ordinance by reason of restrictions on lot area or lot width , such lot or lots may be used , subject to the following provisions : 1 . Any increase in area , frontage , width , yard or depth regr. ire- ments of a zoning ordinance or by-law shall not apply to a lot for single and two-family residential use which at the time of recording or endorsement , whichever occurs sooner was not held in common ownership with any adjoining land , conformed to then existing requirements and had less than the proposed requirement but at least five thousand square feet of area and fifty feet of frontage. The provisions of this paragraph , shall not be construed to prohibit a lot being built upon , if at the time of the building, building upon such lot is not prohibited by the Salem Zoning Ordinance . 2 . If two or more lots , or combinations of lots and portions of lots , with continuous frontage in single ownership Are of record less than five years at the time of adoption of this Ordinance , and if all or part of the lots do not meet the requirements for 1Dt width and area as established by this Ordinance , such lots may be built upon for single family residential use within a period not exceeding five years from the date of such recording, provided that Mh lots each have a minimum area of five thousand square feet. and a minimum frontage of fifty feet . 3 . If two or more lots , or combinations of lots and portions of lots , with continuous frontage in single ownership ,ire of record for more than five years at the time of adoption of this Ordinance , and if all or part of the lots do not meet the requirements for lot width and area as established by this Ordinance, the lands involved shall be considered to be an undivided parcel for the purpose oP this Ordinance , and no portion of said parcel shall be used or sold which does not meet lot width and area requirements establish=, by this Ordinance , nor shall any division of the parcel be made which leaves remaining any lot with width or area below the requirements stated in this Ordinance . S. NONCONFORMITY C. Noncon`ormin Use of Land ;here use of land exists that is made no longer pn nissablc under the terms of this Ordinance or amendment , such use may be caktinsed so long as it remains otherwKe lawful , subject to the following provisions : 1 . Such nonconforming use shall net be enlarged , increased , or extended to occupy a greater area of lard than was occupied at the effective date of adoption or nm endmant of. this Ordinance. 2 . No such nonconforming use shall be moved in whole or in part to any other portion of the lot or parcel occupied by such use at the effective date of adoption or amendment of this Ordinance. 3. If any such nonconforming use of land is discontinued for any reason for a period of twelve consecutive months , any subsequent use of such land shall conform to the regulation specified by this Ordinance for the district in which such land is located. y4 NONCONFORMITY SECTION V1 D. Nonconforming Structure Where a structure exists which could not be built under the terms of this Ordinance by reason of restrictions on area, lot coverage, height , yard dimensions, or other characteristics of the structure or its location on the lot, such structure may be continued so long as it remains otherwise lawful, subject to the following provisions : 1 . No such structure may be enlarged or altered in a way which increases its nonconformity, except as provided for in Section VIII - F. In addition, such structure may not be increased in height , excent as n_ rovided for in Section VIII-F. 2. Should such structure be destroyed by any means to an extent of more than fifty percent of its replace- ment cost , or more than fifty percent of its floor area at the time of destruction, it - shall not be reconstructed except in conformity with the pro- visions of this Ordinance. 3. Should such structure be moved for any reason for any distance whatsoever , it shall thereafter conform to the regulations for the district in which it is located after it is moved. NONCONFORMITY SECTION 'u' lll E. Nonconforming Use of Structure If a use of a structure, or a structure and premises in combination exists that would not be allowed in the disLrict under the terms of this Ordinance or amendment , the use may be continued so long as it remains otherwise lawful , subject to the following provisions : 1 . No existing structure devoted to a use not permitted by this Ordinance in the district in which it is locatod shall be enlarged , extended, constructed , reconstructed , moved , or structurally altered except in changing the use of the structure to a use permitted in the district in which it is located. 2. Any nonconforming use may be extended throughout any parts of a building which were manifestly arranged or designed for such use at the time of adoption or amend- ment of this Ordinance , but no such use shall be extended to occupy any land outside such building . 3 . On any building devoted in whole or in part to any non- conforming use, work may be done in any period of twelve consecutive months on ordinary repairs , or on repair or replacement of nonbearing walls, fixtures, wiring or plumbing to an extent not exceeding ten percent of the current replacement value of the building, provided the cubic content of the building as it existed at the time of passage or amendment of this Ordinance shall not be increased. 4 . If no structural alterations are made , any nonconforming use of a structure, or structure and premises , may be changed to another nonconforming use provided that the Board of Appeals , either by general rule or by making findings in the specific case , shall find that the proposed use is equally appropriate or more appropriate to the district than the existing nonconforming use . In permitting such change , the Board of Appeals may require appropriate conditions and safeguards in accord with the provisions of this Ordinance . 5. Any structure , or structure and land in combination , in or on which a nonconforming use is superceded by a permitted use , shall thereafter conform to the regulations for the district in which such structure is located and the non- conforming use may not thereafter be resumed . .
