A hearing on this Petition was held on March 23, 1983 with the following Board Members present: James Hacker, Chairman; Messrs. LaBrecque, Hopper, Feeherry and Piemonte. Notice of the hearing was sent to abutters and others and notices of the hearing were published in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A. The Petitioner has requested a Special Permit to reduce the size of an already non-conforming lot and thereby extend the non-conformity of the lot. The provision of the Sale__ Zoning Ordinance which is applicable to this request for a Special Permit is Section V B 10, which provides as ,follows: Notwithstanding anything to the contrary appearing in this Ordinance, the Board of Appeal may, in accordance with the procedure and conditions set forth in Section VIII F and IX D, grant Special Permits for alterations and reconstruction of nonconforming structures, and for changes, - enlargement, extension or expansion of nonconforming lots, land, structures, and uses, provided, however, that such change, extension, enlargement or expansion shall not be substantially more detrimental than the existing non- conforming use to the neighborhood. It is also our belief that this dwelling is presently being used as a 3 family house; that Mrs. O'Hare lives there herself on the first floor, rents the second floor to a separate party and that the basement area is being rented to a third party or parties. Although it is simply "hearsay", I have been informed by one neighbor that Mrs. O'Hare is aware of this situation (infringement) when it was mentioned to her, that there was "no way the city could force her to abide by the 2-family regulation placed on her dwelling". It is also our belief that Mrs. O'Hare is advertising this dwelling to sell, as a two family with an "mother-in-law apartment" (for all practical purposes, it appears that she might be representing this house as a 3-family dwelling) . We in the neighborhood would really appreciate it if you could involve yourself in your capacity as building inspector and make an appropriate inspection of this dwelling; and that if you discover infrimgements, as we anticipate that there may be, that you would see to it that Mrs. O'Hare follows the zoning regulations that are presently placed on her dwelling. I have seen one or more of the first floor tenants working on these and other vehicles at varying hours and on weekends since they moved into the property, and it appears to me that these individuals may be conducting an auto repair business at the site. S . One case in point occurred on Tuesday, February 3 , 1987 when the same individuals were changing a transmission in front of my house on River Street. At approximately 2 _ 10 : 30 p.m. the Police came and .informed these individuals that they could not perform the work there and that unless the car were taken off its blocks and removed soon, it would be towed. I do not know whether the Police did this on their own initiative, or whether they were called; I only know that I had nothing to do with it. 9 . Attached are photographs =ken from my house on Saturday afternoon, February 7, 19c showing the rear of 30 Beckford Street and the number of cars there that afternoon. (This is exclusive of the owner ' s vehicle, which was recently towed by the Police , and two vehicles associated with the couple who live with the owner on the second floor, which were parked in front on the street) . Note that the hoods of three automobiles are up and are being worked on. As stated above, some of these are not regularly at the property. 10 . Beginning February 2 , 1987 I have on three occasions been unable to get out of my backyard driveway, due to the public way being blocked by various cars associated with the first floor tenants next door. 11 . I have lived at my current address for 10; years and never before have I ever experienced the foregoing . 12 . I have expended considerable effort and expense in improving my property since moving here , as have many of my neighbors , and I would hate to see the integrity of our ! neighborhood eroded by violations of the Zoning Ordinance . To me there are at least three issues besides the fact that the property is being operated as a three-family dwelling in an R-2 zone: a. whether it is permissable under the Zoning Ordinance . for the owner to have an unrelated couple residing in her unit; b. whether the number of tenants residing on the first_ floor are related, based on the foregoing number of cars , or otherwise exceed the number permitted by the zoning or health codes ; C . whether there is an auto repair or related business being operated out of the site . 14 .
