I do realize that you have your parents living with you and this is a legal use in a single family dwelling. I would also caution you that at the time of my inspection you had no seperation from the 1st floor to 2nd floor. As I understand it, the petitioner in an appeal granted on December 7, 1988 was to have secured an easement from his neighbor so as to provide a driveway fourteen feet in width. It is my further understanding that easement has not been given and the owner is now occupying the property as a two family. Much confusion has arisen in connection with multi-unit buildings, but it appears clear that if a building has permanent provisions for living, sleeping, eating, cooking and sanitation that it will be considered as a dwelling unit. My understanding is that the property in question does fit that definition and is therefore considered as having two dwelling units. I have received word from the neighbor who has indicated that the owner has never sought easement from him in connection with this matter. In view of the two foregoing issues that appear outstanding, it is my suggestion that the house in question be viewed and if it contains more than one dwelling unit that the unit be shut down or that the matter be taken to court by this department. The lot size is the lot size, but the closeness of houses make for a quaint and tory place. Enforcement of the provisions of the ordinance will cause financial hardship to me and my family. Cost keep going up, and the need for additional income is here. The foot print of the building will remain the same, as will the interior floor plan. Constructed as a two family over two hundred years ago, and maintained as one by the Kawczynski family from 1909 through 1987.
