Mr. Chalupowski,
Our office is following up our violation letter, dated 10-25-2011,regarding your property located at 13
Beckett Street. Said property was found to be in violation of multiple Massachusetts State Building Code
requirements,this department thanks you for your prompt action to rectify two of the four issues as
stated in your letter to our office date,November 14, 2011.
Still outstanding as stated in said letter were the items pertaining to the chimney and the fire ladder on the
left side of the house. This department did receive a letter from your Architect,
Mr. John Falat dated December 1, 2011,but have had no success in contacting Mr. Falat as the number on
his letterhead and that he provide in his voice message states; "that the number is no longer in service".
In Mr. Falat's letter he provides no Massachusetts registered architectural wet stamp on his
correspondence, only in his words regarding the ladder; "It appeared to be O.K. to me." In addition
further discussion between Mr. Falat and this department are required regarding the chimney and Mr.
Falat's suggested fix. If you could please contact Mr. Falat and ask him to contact our office, and in
addition leave a valid and operable phone number upon receipt of this letter it would be appreciated.

This letter is in response to your facsimile transmittal received in our office at 1:34 p.m. on
January 17,2012 and our office's violation letter, dated October 25, 2011, regarding your property
located at 13 Beckett Street. It also shall embrace phone conversations with your Architect Mr. John Falat
on January 17,2012 and again on January 27,2012 at his 1-781-581-5103 phone number that for some
unknown reason is only is "out of service"when calling from our office's landline. This number appears
operable when calling from my city cellphone,personal cell phone or any other line that was used to
contact him,Mr. Falat was made aware of this issue during our conversation
Said property was found to be in violation of multiple Massachusetts State Building Code requirements,

As stated in prior letters still outstanding were the items pertaining to the chimney and the fire ladder
located on the left side of the house. In Mr. Falat's letter he provides no Massachusetts registered
architectural wet stamp on his correspondence, only in his words regarding the ladder; `It appeared to be
O.K. to me." This office is requesting an affidavit in lieu of a Live Load Test, with verification and
certification that all connections, supports and materials have been tested and acceptable by the registered
professional.
As stated in the Massachusetts State Building Code, Eighth Edition;
Section 1001.3 Testing and Certification—All exterior bridges, steel or wooden stairways,fire escapes
and egress balconies shall be examined and or tested, and certified for structural adequacy and safety
every five years, by a Massachusetts Registered professional Engineer, or other qualified and
acceptable to the Building Official, who shall then submit an affidavit to the Building Official.

In my phone conversations with Mr. Falat he assured me that this affidavit as required by 780 CMR
1001.3,would be sent to our office affixed with his Massachusetts registered architectural wet stamp and
signature. As of this date our office has received no such affidavit, thus the violation regarding the egress
ladder is still outstanding. Considering the life safety factors associated with this egress ladder for the
tenants of the building this office is now demanding a review and/or an affidavit immediately as required
by Section 1001.3 from Mr. Falat or another qualified professional to the ladders status.
Furthermore this office still has outstanding violations related to the exterior chimney, a recent site visit
by our office did reveal that the gap between the chimney and building has been filled, but the matter of
why this separation occurred is still needs to be resolved. Mr. Fallet in his letter states; "The chimney
does not appear to have shifted or moved from where it was constructed and is braced and adequately
attached to the building.", this does not answer the question of how the separation occurred. An affidavit
with Mr. Fallet or by a Massachusetts Registered Professional Engineer, or other qualified professional
assuring this office that that the chimney is not in a condition detrimental to the public safety, shall only
be acceptable to assure compliance. Additionally cracks in the concrete masonry blocks and deterioration
of the mortar joists are evident, and the work stated in Mr. Fallet's letter to remove, prime and paint the
chimney bracing is still complete. Also noted during the visit was the clean out door is also in need of
repair.
For the reasons stated above it is asked that schedule a meeting with our office immediately upon receipt of this letter
with our department to discuss these matters. The inclusion of you Registered professional would be welcomed at this
meeting. Or you are hereby ordered to begin to rectify these conditions within 7 days of receipt of this notice.
Failure to do so may result in further actions being brought against you,up to and including the filing of
criminal complaints at District Court.
You have the right to appeal this order to the State Board of Building Regulations at One
Ashburton Place; Boston, Ma.

In response to your letter dated February 8,2012, please be advised that it is my position
that I have met the requirement of your letter dated October 25,2011 where you
requested inspection of the ladder at 13 Becket Street by a professional along with other
issues. I do not believe that I should now be required to spend more of my limited
resources on additional professional service.
Nevertheless, if you insist, I will welpome the opportunity to meet with you in person to
discuss the matter as suggested by you in your letter. Please let me know what time you
would be available to meet with me. I may exercise my right to bring to said meeting my
architect, Mr. John Falat, as well as my attorney.
As to your comments concerning the function of Mr. Falat's office answering service,
please be advised that I do not have any control over the matter, and I do not believe that
this matter is in any way relevant to the issue at hand.

Our office received a complaint regarding your property located at 11 Beckett Street. The complaints
were investigated on Wednesday, April 4, 2012, said property was found to be in violation of
Massachusetts State Building Code requirements.
Conditions that have been deemed to be insufficient;
Numerous locations on the building's wood exterior deck and stairway are deteriorating and in need of
repair constituting a hazard to the public and current occupants of the dwelling. The most glaring of
these is the gap between the decking and the exterior siding of the dwelling.
Under the provisions of Massachusetts State Building Code(780 CMR Section 3400.4)
Railing attachments to the buildings structure at rear third floor deck landing entrance is not in
accordance with State Building Code requirements.
Under the provisions of Massachusetts State Building Code(780 CMR Section 3400.4)
Guard rail needs to be installed on outside of second floor double hung window located on upper mid-
level landing of rear wood stair.
Under the provisions of Massachusetts State Building Code(780 CMR Section 1013.0)
Railing attachment at the bottom portion ofstairway into the unit is not in accordance with State Building
Code requirements.

Back in June of 2002, you had our Department along with Fire Prevention do an
inspection of your property for condo conversion. There was one or two apartment that
didn't meet egress codes and an up to date fire protection. Not happy with our answers,
you then called State Building Inspector, John McCarthy and he once again agreed with
our decision. You've continued on not adhering to our decisions. You've had for sale
signs on City property and private property, and have still insisted on going ahead with
this project. The State Building Department has agreed with our decision Therefore, I
ask you to stop the condo conversion until City and State Department are satisfied.
If you are feel aggrieved by this decision you may appeal to the Board of Building
Regulations and Standards at One Ashburton Place, Boston, Ma.
You have 15 days to adhere to this order or a complaint will be issued in Salem District
Court.

Our office received a complaint regarding your property located at 13 Beckett Street. The
complaints were investigated on Wednesday, October 12, 2011 along with David Greenbaum
and Elizabeth Salandrea of the Salem Health Department. Said property was found to be in
violation of multiple Massachusetts State Building Code requirements.
Conditions that have been deemed to be insufficient;
Numerous locations on the building's exterior trim and clapboards are deteriorating and thus
constituting a hazard to the public and current occupants of the dwelling. This continued neglect
of the building's envelope is allowing for the continued decline to the structures exterior. Under
the provisions of Massachusetts State Building Code (780 CMR Section 3400.4)
The chimney at the rear of the structure has separated from the buildings facade and appears to be in danger
of collapse. Presently the chimney's separation from the building is causing the inside cavity of exterior wood
stud wall to be exposed to the weather. The present method of securing the chimney is inadequate, a licensed
Massachusetts's Registered Design Professional shall be required to review this situation.

Section 107.6.2 and Massachusetts General Law's Chapter 143)

Dear Mr. Lutrzykowski:
I am in receipt of your letter dated October 25, 2011 about a complaint received by your
office regarding the condition of my 3-family residential building located at 13 Becket
Street in Salem.
Please be advised that immediately after receiving your letter I did begin to rectify the
four areas of concern listed in your letter.
1. I carefully inspected the building's exterior(or envelope as referred to in your
letter). The building was renovated and painted in its entirety at a great financial
expense in the summer of 2001. While there are some areas of chipping of the
paint, I would not agree that said chippings could constitute a hazard to the public
or current occupants. Nevertheless, I do intend to renovate the building, weather
conditions and my finances permitting. My plan is to perform the capital
renovation of the exterior of the building in the spring on 2011
2. Regarding the condition of the chimney at the left side of the rear part of the
building, I am in the process of retaining a licensed professional to review the
situation as suggested in your letter. I will notify you promptly about the result of
said review.
3. The railing attachments at both entrances stairs have been fixed and stabilized by
an experienced contractor immediately upon receipt of your letter.
4. Regarding the ladder designated as a second means of egress on the left side of
the building, I am in the process of retaining a licensed professional to inspect and
certify it for structural adequacies. As in the case of the chimney referred to
above, I will notify you promptly about the result of said inspection.
Please be advised that I monitor the condition of my property on a regular basis, and do
perform any necessary repairs and improvements when necessary through my reliable
and capable contractor, who is always available on a very short notice.
I have owned this property for almost 25 years with overall occupancy rate close to 90%.
I have been always in full compliance with all applicable laws and building codes.
Please be advised that in July 2006, while doing some renovations of the roof of the
building, I suffered a 30-foot fall resulting in a serious spinal injury, which required a
complicated neurosurgical intervention involving insertion of 15" long titanium rods. As
a result of said injury I am currently disabled and the rental property is my only income.
Therefore any renovations requiring immediate expenditure of large sums of money
would constitute a considerable hardship for me.
Out of the four areas of concern, one (0) has already been remedied. Two issues
requiring a review by a licensed professional (42 and#4) are being currently addressed.
The issue (41) of the chipping paint of the exterior of the building will be addressed in
due course. I hope we can agree that it does not require immediate attention, and the plan
to have the renovation in the spring of 2012 would be acceptable to you.

Mr. Chalupowski has asked me to examine the chimney at the rear of the building on
13 Becket St. in Salem to see if it appears to be in danger of collapsing and if the
present method of securing the chimney to the building is adequate. He has also
requested that I examine the ladder attached to the left side of the building for
structural adequacy.
On November 25, 20111 was able to visit the house at 13 Becket Street and make
the following observations: I!
1) The chimney does not appear to have shifted or moved from where it was
constructed and is braced and adequately attached to the Building.
2) The ladder on the left side of the dwelling was tested for structural
stability. It appeared to be O.K, tome.
I have suggested the following improvements to Mr. Chalupowski.: I
1) That the void between the building and the chimney be filled with
insulation and the missing trim boards sealing the space be replaced so
that water is not allowed to enter the void.
2) That the rust on metal brackets supporting the chimney and the ladder be
removed and the metal primed and painted.

Background: In his letter, dated April 8, 2003, Mr. Thomas St. Pierre, Building Inspector for the
City of Salem, served a letter to Mr. Chester Chalapowski, in reference to the following Section of
780 CMR, Sixth Edition (the State Building Code), 1004.4.2 #1, for property located at 13 Beckett
Street. A copy of said letter is made part of this decision.
The construction type of the subject building is 5B, and the use groups contained within are Assembly
(A-2)and Residential (R-2).
Relief Requested:The Appellant requested relief in the form of an order to lift the local building
official's order that the second means of egress as dangerous since it has been in existence for many
years, and no work.
Appellant:
The appellant testified that the he bought the property in question in 1987 as a three-family dwelling, and
has a letter from the city building inspector/zoning officer back in 1987 that the property is a three-family
dwelling. He has tax statements and health certificates stating it is a three-family.

The appellant testified that during an inspection by the local fire inspector on upgrading the smoke alarms,
the inspector had concern with the second egress for the third unit and notified the building department.
Subsequently,the appellant received a copy of a complaint filed by the building official in the local court
for a"dangerous egress".
Municipal Building Official:
The building official was present at the hearing, and testified in opposition of the requested variance
because he believes the egress is"unsafe".
The building official testified that the egress is a ladder, not a fire escape which leads out a bathroom
window and down the ladder with no "backing". The ladder is a tube ladder,which is three-stories high,
and has no platform.
The building official testified that the ladder is above an alley, which is 4-5 feet wide between the two
buildings.
The building official testified that he believes a building inspector can determine whether an egress is
dangerous and unsafe and it is retroactive.
T-he-building official testified that he-withdraws his-complaint against the owner-since-he can not prove--
when
rovewhen the ladder was installed and a letter from the city in 1987 granted the building as a three-family.
